A RESOLUTION URGING THE DIRECTOR OF THE OHIO E.P.A. TO I

INCLUDE IN ANY PERMITS TO INSTALL AL TERNA TIVE W ASTEW A TER l
TREA TMENT SYSTEMS ISSUED IN CENTRAL OHIO, ADEQUATE TERMS !
AND CONDITIONS TO ENSURE STABILITY AND OVERSIGHT OF THE i

WHEREAS, alternative wastewater treatment systems, such as constructed wetlands and
irrigation systems, which have been designated as zero discharge systems by the Ohio E,P.A.
have the potential, if improperly constructed or operated, to pollute the waters of the state;
and
WHEREAS, Central Ohio is experiencing a dramatic increase in the construction of
alternative wastewater treatment systems; and
WHEREAS, the Ohio E.P.A. does not have a formal mechanism for oversight of continuing
operations of the alternative wastewater treatment systems; and
WHEREAS, without the requirement of an NPDES permit, financial assurance or means
test, operator requirements, inspections, or operational standards, alternative wastewater
treatment systems function without regulatory oversight; and
WHEREAS, alternative wastewater treatment systems promote rural development at
densities which require urban planning often before comprehensive plans, storm water
management plans, or traffic control plans are in place; and

WHEREAS, urban sprawl has been identified as the leading cause of river degradation,
which is of particular concern in the fragile Darby Watershed; and
WHEREAS, area-wide waste treatment management is recognized by Congress under the
terms of the Clean Water Act to be the environmentally superior method of wastewater
treatment. (Section 208 Federal Water Pollution Control Act, 33 U.S,C. Section 1288); and
WHEREAS, the failure of alternative wastewater treatment systems place burdens on local
government to correct the problems created by such failed systems; and
WHEREAS, the operators of such alternative wastewater treatment systems need not
demonstrate sufficient financial stability to assure long term management of alternative
wastewater treatment systems; and
WHEREAS, despite local efforts toward comprehensive land use planning, alternative
wastewater treatment systems spawn islands of development which create needs for
municipal services such as police and fire protection and infrastructure development.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of
Ohio, '2- members concurring that:
Section 1. Dublin City Council does hereby urge the Director of the Ohio E.P,A. to
include in any Permits To Install which he may issue within Central Ohio, such terms and
conditions as may be necessary to ensure adequate stability and oversight of the alternative
wastewater treatment systems.
Section 2. This Resolution is effective upon passage in accordance with Section 4,04(a)
of the Revised Charter.
