WHEREAS, a petition for the annexation of 92.888+/- acres from Jerome Township was
duly filed by Stephen J. Smith on September 29, 1997 on behalf of petitioners Christopher
Mohr, Dublin City Schools, 7030 Coffman Road, Dublin, Ohio; Sandra Wilson Smith,
319 Old Spring Court, Dublin, Ohio; and R.L. Richards, The Shawnee Hills Land
Company, 5131 Post Road, Suite 203, Dublin, Ohio; and
WHEREAS, a public hearing has been scheduled before the Union County
Commissioners on Monday, December 8, 1997 at 2:00 p.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, Dublin City Council adopted an interim annexation policy on June 20, 1994
to provide policy directive regarding proposed annexations to the City of Dublin.
NOW, TIlEREFORE, BE IT RFSOLVED, by the Council of the City of Dublin, State
of Ohio, 1 of the members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the
92.888+/- acres in Jerome Township, Union County upon the annexation of the area to
the City of Dublin, Ohio:
~. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other municipalities. The
annexation area lies approximately two miles northwest of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately five minutes for an emergency situation should be
expected for this area.
Fire. Fire and emergency medical services protection is currently provided by
well-staffed departments in Jerome and Washington townships. They, too, have
mutual aid agreements with other municipalities. This annexation would not
change fIre department jurisdictional boundaries, and therefore response times for
fire and emergency medical services will not be affected. The Jerome Township
Fire Station is approximately six miles from the annexation area and normal
response times should be approximately seven minutes. However, due to an
existing automatic response agreement, the area is also served by the Washington
Township Fire Station 93 which is located approximately one mile away, and
normal response time would be approximately three minutes.
Street Maintenance. The City has a Streets and Utilities Division which provides
excellent service in the area of street and road maintenance. I

Section 2. The City has SEWER and WATER service area contracts with the City of I
Columbus, and the subject property is within the service areas. Conditioned on the ability !
of the City of Columbus to provide WATER, and to provide sufficient SEWERAGE
disposal capacity, the City of Dublin will have the ability to service the area. I

Section 3. This resolution shall be in force and effect immediately upon its passage as i

provided under Section 4.04(a) of the Revised Charter. !

annexation of certain real property located in the Township of

The undersigned ("Peti tioners" ) petition for the
annexation of the real property described in Exhibit A attached to
this Petition (the "Territory") to the City of Dublin, Ohio (the
"City"). The Territory consists of 92.88 acres, more or less,
located contiguous and adjacent to the City. Petitioners have
attached as Exhibit, B and made a part of this Petition an accurate
plat showing the boundaries of the Territory. The number of owners
of real estate in the Territory is five. Stephen J. Smith of
Carlile Patchen & Murphy LLP, 366 East Broad Street, Columbus, Ohio
43215, (614) 228-6135, is appointed agent for the Petitioners as
required by section 709.02 of the Ohio Revised Code and is granted
full power and authority to amend, alter, change, correct, withdraw
or refile this Petition, increase or decrease the size of the
Territory and do any and all things necessary pertaining to the
granting of this Petition. The agent's authority includes, but is
not limited to, the authority to make any amendment and/or deletion
in order to correct any discrepancy or mistake noted by the Union
County Engin3e~ in his examination of this Petition, description
and plat. Ar, amendment for that purpose shall be made by the
presentation of an amended plat and description to the Board of

WHEREAS , Dublin Schools has entered into purchase agreements for
three parcels of land totalling approximately 92.25 acres located
in Jerome Township, Union County, Ohio for the construction of a
high school;
WHEREAS, the subject property is located contiguous and adjacent to
the City of Dublin;
WHEREAS , Dublin Schools desires to annex the subject property to
the City of DUblin, Ohio; and
liiiEREAB, the annexation procedure must be initiated by petition to
the Union County Board of. commissioners pursuant to Ohio Revised
Code Sections 709.02 through 709.~2.
HOW, THEREFORE BB :tT RESOLVED by the Board of Education of Dublin
City Schools, Dublin, State of Ohio, all of the elected members
concurring that:
Section 1. The Board of Education considers it necessary to
annex the subject property to the City of Dublin for the purpose of
constructing a high school.
Section 2. The Superintendent of Dublin city Schools is hereby
authorized to petition the Union County, Commissioners for
annexation of approximately 92.25 acres of land located in Jerome
Township, Union County, Ohio.
Section 3. This Resolution shall take effect and be in force
from and after the earliest date permitted by law.

acres are within Virginia Military Survey 3452, 24.996 acres are within Virginia Military Survey Number 2925 and of which 24.996 acres
are within said Board of Education 25,614 acre tract, 40.575 acres are within said Board of Education 41.167 acre tract, 25.469 acres are
all of said Board of Education 25.469 acre tract, 0,808 acre is within said Bishop 11.333 acre tract, 0.341 acre is within said Smith 29.229
acre tract 0.349 acre is within said Starkey 20,526 acre tract, and 0.350 acre is within the Shawnee Hills Land Company 30.761 acre tract,
and of which 3.079 acres are subject to the road right-{)f-way, subject to all previous easements and rights-{)f-way of record. All iron pipes

Notice is given that there was filed with the Board of County Commissioners of Union,
County, Ohio, (the "Board"), on September 29, 1997, a petition (the "Petition") signed by a
majority of the owners of real estate in the territory hereinafter described praying for the
annexation of certain territory located in Jerome Township, Union County to the City of Dublin,
Ohio in the manner provided by law. The substance of that petition reads as follows:

in Exhibit A attached to this Petition (the "Territory") to the City of Dublin, Ohio (the
"City"). The Territory consists of 92.888 acres, more or less, located contiguous and

the northeasterly corner of said Starkey 20.526 acre tract;
thence the following three (3) consecutive courses along the southerly marginal line of

crossing said Starkey 20.526 acre tract and with a northerly corporation line for
the city of Dublin, to a point of curvature;
2) 615.00 feet on a curve to the right, having a radius of 2316.8737 feet, the chord
of which bears North 74 degrees 36 minutes 19 seconds West, 613.20 feet
passing the line common to a westerly corporation line for said city of Dublin,
the westerly line of said Starkey 20.526 acre tract and the easterly line of said
Smith 29.229 acre tract at 46.49 feet on said curve;
3) North 67 degrees 00 minutes 03 seconds West, 34.23 feet to a point common to
the southerly line of said Board of Education of the Dublin City School District
25.469 acre tract and the northerly line of said Smith 29.229 acre tract;
thence North 75 degrees 54 minutes 35 seconds West, 53.53 feet with the line common
to the southerly line of said 25.469 acre tract and the northerly line of said Smith 29.229
acre tract to an iron pipe set on the southwesterly corner of said 25.469 acre tract;
thence North 02 degrees 10 minutes 04 seconds West, 9.16 feet with the line common
to the westerly line of said Board of Education of the Dublin City School District 25.469
acre tract and the easterly line of said Bishop 11.333 acre tract, to a point on the
southerly marginal line of said County Highway 9-E;

curvature;
2) 176.62 feet on a curve to the left, having a radius of 3794.83 feet, the chord of

curvature;
4) 119.12 feet on a curve to the right, having a radius of 1743.9330 feet, the chord
of which bears North 67 degrees 42 minutes 39 seconds West, 119.10 feet to the
point of beginning.
Bearing (North 84 degrees 35 minutes 01 seconds East) assumed from a previous survey
recorded in Survey Record 10, page 126.
The tract as described from an actual field survey performed on or about March 26,
1997, by James A. Page (S-6034), of Page Engineering, Inc., Marysville, Ohio, contains
92.888 acres, more or less, of which 0.698 acre is within Virginia Military Survey
Number 5162, 67.194 acres are within Virginia Military Survey 3452, 24.996 acres are
within Virginia Military Survey Number 2925 and of which 24.996 acres are within said
Board of Education 25.614 acre tract, 40.575 acres are within said Board of Education
41.167 acre tract, 25.469 acres are all of said Board of Education 25.469 acre tract,
0.808 acre is within said Bishop 11.333 acre tract, 0.341 acre is within said Smith
29.229 acre tract 0.349 acre is within said Starkey 20.526 acre tract, and 0.350 acre is
within the Shawnee Hills Land Company 30.761 acre tract, and of which 3.079 acres are
subject to the road right-of-way, subject to all previous easements and rights-of-way of
record. All iron pipes set are 3/4 x 30" galvanized pipe with yellow survey caps
stamped S-6034. The survey is recorded in Survey Record 15 in the office of the Union
County Engineer.
Stephen J. Smith is named in the Petition as the agent of the petitioners in accordance
with law. The Petition is signed by Christopher Mohr, Treasurer and Director of Business
Affairs, Dublin City Schools; Sandra Wilson Smith; and R.L. Richards, Secretary/Treasurer of
The Shawnee Hills Land Company.
The Public Hearing on the petition will be held in the office of the Board of Union
County Commissioners, located at 233 West Sixth Street, Marysville, Ohio on Monday,
December 8, 1997, at 2:00 p.m.
