WHEREAS, the City of Dublin is preparing to improve the Shier-
Rings Road and Avery Road intersection; and
WHEREAS, said improvement will require the City of Dublin to
obtain temporary construction easements, in and to the
premises described in the attached Exhibits "A" and "B",
located in the City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVEPjPY the Council, of the City of
Dublin, State of Ohio, of the elected members
concurring that:
Section 1. Coupcil considers it necessary and declares its
intention to appropriate, for the purpose of improving the
Shier-Rings Road and Avery Road intersection, temporary
construction easements in and to the premises located in the
City of Dublin, Franklin County, Ohio, and more fully
described in the legal descriptions attached hereto as
Exhibits "A" and "B".
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons in possession or having an
interest of record in the above-described property. This
notice shall be served according to law.
Section 3. This Resolution shall take effect and be in
force from and after the earliest date permitted by law.

Description of Temporary Easement for Grading
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.014 acre out of the Resubdivision of Lot 8 in Shamrock Industrial Park
as shown in Plat Book 66, Page 46 and as conveyed to Dolan Investments, Inc., by deed of
record in OR 02752 AOl in the Fanklin County Recorder's office, and being more particularly
described as follows:
Beginning at the Grantor's southwesterly corner in the easterly right of way line of A very Road,
said point being 55.09 feet right of and radially from Station 18+ 19.74 in the centerline of survey
of A very Road as appears on the Centerline Plat for an Improvement to A very Road and
Shier-Rings Road, of record in Franklin County, being the TRUE POINT OF BEGINNING of
the tract being described;
thence with the Grantor's westerly line and the easterly right of way line of A very road, North 01
degree 35 minutes 54 seconds East, a distance of 143.77 feet to the Grantor's northwesterly
comer;
thence with the Grantor's northerly line, North 83 degrees 51 minutes 48 seconds East, a distance
of 5.58 feet to the northeasterly corner of the tract described herein;
thence with the easterly line of the herein-described tract, South 02 degrees 17 minutes 33
seconds West, a distance of 104.59 feet to a point;
thence continuing with said line, South 06 degrees 20 minutes 24 seconds West, a distance of
39.94 feet to a point in the Grantor's southerly line;
thence with said southerly line, South 83 degrees 50 minutes 05 seconds West, a distance of 0.96
foot to the TRUE POINT OF BEGINNING of the tract being described, said described tract
containing 0.014 acre, more or less.
The above described acreage is contained in Auditor's Parcel 274-000120.
Stations and offsets used in this description are referenced to the proposed centerline of Avery
Road as appears on the Centerline Plat For the improvement of Avery and Shier-Rings Roads
prepared by URSGreiner, and of record in Franklin County.
Bearings used in this description are based on an actual field survey utilizing Franklin County
Monuments Nos. FCGS 5536 and FCGS 7752 by URSGreiner in June 1996.

Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.001 acre out of a 0.536 acre parcel conveyed to Dolan Investments,
Inc., as recorded in OR 02752 AOl in the Franklin County Recorder's Office, and being more
particularly described as follows:
Beginning at the Grantor's northeasterly corner in the southerly right of way line of Shier-Rings
Road and being 43.37 feet right of Station 122+05.54 in the centerline of survey of Shier-Rings
Road as delineated on the Centerline Plat for the improvement to A very Road and Shier-Rings
Road, of record in Franklin County, the TRUE POINT OF BEGINNING of the tract being
described;
thence with the Grantor's westerly line, South 06 degrees 09 minutes 55 seconds East, a distance
