Rings Road and Avery Road intersection; and " " WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest in and to the premises described in the attached Exhibit "Aft located in the City of Dublin, Franklin County, Ohio. NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of improving the Shier-Rings Road and Avery Road intersection, a fee simple interest in and to the premises located in the City of Dublin, Franklin County, Ohio, and more fully described in the legal description attached hereto as Exhibit "Aft . Section 2. The City Manager is hereby authorized to cause written notice of the passage of this Resolution to be served upon the owners and persons in possession or having an interest of record in the above-described property. Presiding Officer ATTEST: ~CL,~ Clerk of Council I hereby ':crtify that copies of this QFd:1l8IlCe/Resolufion were posted in the City of Dublin in accordance wjt~ Section 731.25 of the l)hjo Revised Code. ~t(IP.~~' Ohio Exhibit A-Parcel 18WD City of Dublin-Avery/Shier-Rings Road Improvement 33/Dublin Industrial Park OR 12844111 Description of Additional Right of Way for Shier-Rings Road Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military Survey 3452 and being 0.115 acres out ofa 7.000 acres parcel conveyed to 33/Dublin Industrial Park as recorded in Official Record 12844111 in the Franklin County Recorder's Office, said tract being more particularly described as follows: Commencing at a centerline monument marking the intersection of the centerline of Avery Road and the centerline of Shier-Rings Road, said point being 2.13 feet right of Station 20+00.28 in the centerline of survey of the Improvement of A very Road as delineated on the Centerline Plat for said improvement, of record in Franklin County; thence leaving said point, South 83 degrees 40 minutes 39 seconds West, a distance of2.14 feet to the point at which the new centerline of Avery Road intersects the centerline of Shier-Rings Road; thence with the centerline of Shier-Rings Road, South 85 degrees 31 minutes 51 seconds West a distance of 1207.06 feet to a point being the TRUE POINT OF BEGINNING, and the Grantor's southeasterly comer said point also being the southeasterly comer of the tract described herein; thence leaving said point of beginning with the Grantor's southerly line in the centerline of Shier- Rings Road, South 85 degrees 31 minutes 51 seconds West, a distance of 142.93 feet to a point; thence leaving said point with the new Right of Way line of Shier-Rings Road, North 04 degrees 28 minutes 09 seconds West, a distance of 3 5.00 feet to an iron pin set in the new northerly Right of Way line of Shier-Rings Road; thence with said Right of Way line, North 85 degrees 31 minutes 51 seconds East, a distance of 143.63 feet to a iron pin set in the Grantor's easterly line; thence with said easterly line and the westerly line of a 1. 00 acre tract conveyed to Norman L.
