j! the City of Dublin is preparing to improve the Shier-
I' WHEREAS,
Rings Road and Avery Road intersection; and
ii

i; WHEREAS, said improvement will require the City of Dublin to
obtain a temporary construction easement, in and to the
premises described in the attached Exhibit "All located in the
City of Dublin, Franklin County, Ohio.
i NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of
I Dublin, State of Ohio, r-; of the elected members
concurring that:
Section 1. Council considers it necessary and declares its
intention to appropriate, for the purpose of improving the
Shier-Rings Road and Avery Road intersection, a temporary
construction easement in and to the premises located in the
City of Dublin, Franklin County, Ohio, and more fully
described in the legal description attached hereto as Exhibit
"All.
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons in possession or having an
interest of record in the above-described property. This
notice shall be served according to law.
Section 3. This Resolution shall take effect and be in
force from and after the earliest date permitted by law.

Description of Temporary Easement for Grading Purposes
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.029 acre out of Lot 6 of Shamrock Industrial Park of record in Plat
Book 51 Page 12 and as conveyed to Farm and Power Equipment Retailers of Ohio, as recorded
in Deed Book 3707, Page 487 in the Franklin County Recorder's Office, and being more
particularly described as follows:
Commencing at the Grantor's northwesterly property comer in the easterly right of way line of
A very Road, said point being 50.54 feet right of and radially from Station 13+62,54 in the
centerline of survey of A verv Road in an improvement to said A very Road, as delineated on the
Centerline Plat for said improvement, of record in Franklin County;
thence leaving said point, with the Grantor's westerly line, South 04 degrees 08 minutes 41
seconds East, a distance of25.18 feet to TRUE POINT OF BEGINNING, a point in the
southerly line of a 50 foot easement for storm water drainage as shown on the above-referenced
plat;
thence with said easement line, North 79 degrees 01 minute 22 seconds East, a distance of29.68
feet to a point in the easterly line of the tract described herein;
thence with said easterly line, South 13 degrees 5 I minutes 34 seconds West, a distance of 95,36
feet to a point in the Grantor's westerly line;
thence with said line North 04 degrees 08 minutes 41 seconds West, a distance of 87.16 feet to
the TRUE POINT OF BEGINNING, said described tract containing 0.029 acre, more or less.
The above described acreage is contained in Auditor's Parcel 274-000104.
Stations and offsets used in this description are referenced to the proposed centerline of A very
Road as appears on the Centerline Plat For the improvement of A very and Shier-Rings Roads
prepared by URSGreiner, and of record in Franklin County.
Bearings used in this description are based on an actual field survey utilizing Franklin County
Monuments Nos. FCGS 5536 and FCGS 7752 by URSGreiner in June 1996.
This description was prepared for URSGreiner by Roger M. Smith, P.S. 6899 from existing
records and actual field survey,
