A RESOLUTION TO APPROPRIATE A 0.070 ACRE FEE SIMPLE
INTEREST AND A 0.114 ACRE TEMPORARY CONSTRUCTION
EASEMENT IN PROPERTY OWNED BY JOHN D. VINCENT,
LOCATED ON THE SOUTH SIDE OF SHIER-RINGS ROAD, IN
THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF
OHIO.
WHEREAS, the City of Dublin is preparing to improve the Shier-
Rings Road and Avery Road intersection; and
WHEREAS, said improvement will require the City of Dublin to
obtain a fee simple interest and a temporary construction
easement, in and to the premises described in the attached
Exhibits "A" and "B" located in the City of Dublin, Franklin
County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of
Dublin, State of Ohio, ~ of the elected members
concurring that:
Section 1. Council considers it necessary and declares its
intention to appropriate, for the purpose of improving the
Shier-Rings Road and Avery Road intersection, a fee simple
interest and a temporary construction easement in and to the
premises located in the City of Dublin, Franklin County, Ohio,
and more fully described in the legal descriptions attached
hereto as Exhibits "A" and "B".
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons in possession or having an
interest of record in the above-described property. This
notice shall be served according to law.
Section 3. This Resolution shall take effect and be in
force from and after the earliest date permitted by law.

Description of Additional Right of Way for Shier-Rings Road
Situated in the State of Ohio. County of Franklin. City of Dublin and part of Virginia Military
Survey 3004 and being 0.070 acre out of a 2.374 acres parcel conveyed to John D. Vincent, as
recorded in Deed Book 3751 Page 533 and Deed Book 3581 Page 881 in the Franklin County
Recorder's Office. said tract being more particularly described as follows:
Commencing at a centerline monument marking the intersection of the old A very Road centerline
\\.ith the centerline of Shier-Rings Road. said point being 2.13 feet right of Station 20+00.28 in the
centerline of survey of an improvement to said A very Road as delineated on the Centerline Plat for
said improvement. on record in Franklin County:
thence leaving said point, South 83 degrees 40 minutes 38 seconds West. a distance of 2.14 feet to
the point at which the new centerline of A very Road intersects the centerline of Shier- Rings road;
thence South 85 degrees 31 minutes 51 seconds West. leaving said point with the centerline of
Shier-Rings Road, a distance of 390.03 feet to a point being the northwesterly comer of a 1.708 acre
tract conveyed to A very Lake Investments and described in OR 00 115J08 of the records of Franklin
County;
thence South 04 degrees 25 minutes 12 seconds East, \\.ith the vv'esterly line of said tract, a distance
of 30.01 feet to the TRUE POINT OF BEGINNING at the northeasterly comer of the Grantor and
also being the northeasterly comer of the tract described herein;
thence. South 04 degrees 25 minutes 12 seconds East. continuing along said line, being the
Grantor's easterly line, a distance of 4.99 feet to an iron pin set in the new southerly Right of Way
line of Shier-Rings Road:
thence South 85 degrees 31 minutes 51 seconds West. with the southerly Right of Way line. a
distance of 608.71 feet to an iron pin set in the Grantor's westerly property line;
thence North 06 degrees 03 minutes 28 seconds West. \vith said property line. a distance of 5.00
feet to a point at the Grantor's northwesterly comer in the old southerly right of way line of
Shier-Rings Road;
thence North 85 degrees 31 minutes 51 seconds East. with the Grantor's northerly line. a distance of
608.86 feet to the TRUE POINT OF BEGINNING of the said described tract, containing 0.070
acre. more or less.
The above described acreage consists of 0.048 acres out of Auditor's Parcel 274-000006 and 0.022
acres out of Auditor's Parcel 274-000008.
Stations and offsets used in this description are referenced to the proposed centerline of
Shier-Rings Road as appears on the Centerline Plat For the improvement of Avery and Shier-Rings
Roads prepared by URSGreiner, and of record in Franklin County.
Bearings used in this description are based on an actual field survey utilizing Franklin County
Monuments Nos. FCGS 5536 and FCGS 7752 by URSGreiner in June 1996.
This description was prepared for URSGreiner by Roger M. Smith, P.S. 6899 from existing records
and actual field survey.

Description of Temporary Easement for Grading and Construction ofa Drive
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.114 acre out ofa 2.374 acres parcel conveyed to John D. Vincent, as
recorded in Deed Book 3751, Page 533 and Deed Book 3581, Page 881 in the Franklin
County Recorder's Office, and being more particularly described as follows:
Commencing at the Grantor's northeasterly corner, said point being an iron pin set in the southerly
right of way line of Shier-Rings Road, being 35,00 feet right of Station 116+09,94 in the
centerline of survey of Shier-Rings Road as appears on the Centerline Plat for an improvement to
Avery Road and Shier-Rings Road of record in Franklin County, and being the TRUE POINT
OF BEGINNING of the easement for construction and grading purposes being described;
thence continuing with said line, South 04 degrees 25 minutes 12 seconds East a distance of 7.00
feet to a point at the southeasterly corner of the tract described herein;
thence with the southerly line of said tract, the following eight (8) courses and distances:
South 85 degrees 31 minutes 51 seconds West, a distance of 29,94 feet to a point;
South 22 degrees 05 minutes 45 seconds West, a distance of 11.18 feet to a point;
South 85 degrees 31 minutes 51 seconds West, a distance of 35,00 feet to a point;
North 63 degrees 30 minutes 20 seconds West, a distance of 11.66 feet to a point;
