CONSTRUCTION EASEMENT, AND A 0.047 ACRE STORM SEWER
EASEMENT IN PROPERTY OWNED BY AVERY LAKE
INVESTMENTS, LOCATED ON THE WEST SIDE OF AVERY
ROAD, AND ON THE SOUTH SIDE OF SHIER-RINGS ROAD, IN
THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF
OHIO.
WHEREAS, the City of Dublin is preparing to improve the Shier-
Rings Road and Avery Road intersection; and
WHEREAS, said improvement will require the City of Dublin to
obtain a fee simple interest, a storm sewer easement, and
temporary construction easements, in and to the premises
described in the attached Exhibits "A", "B", "C", "D", "E" and
"F" located in the City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of
Dublin, State of Ohio, I of the elected members
concurring that:
Section 1. Council considers it necessary and declares its
intention to appropriate, for the purpose of improving the
Shier-Rings Road and Avery Road intersection, a fee simple
interest, a storm sewer easement, and temporary construction
easements in and to the premises located in the City of
Dublin, Franklin County, Ohio, and more fully described in the
legal descriptions attached hereto as Exhibits "A", "B", "eff,
"D" , "E" and "F" .
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons in possession or having an
interest of record in the above-described property. This
notice shall be served according to law.
Section 3. This Resolution shall take effect and be in
force from and after the earliest date permitted by law.

Description of Additional Right of Way for Shier-Rings Road
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.023 acre out ofa 1.576 acres parcel conveyed to Avery Lake
Investments as recorded in Official Record 00115 J08 in the Franklin County Recorder's Office,
said tract being more particularly described as follows:
Commencing at a centerline monument marking the intersection of the old Avery Road centerline
with the centerline of Shier-Rings Road, said point being 2.13 feet right of Station 20+00.28 in
the centerline of survey of an improvement to said Avery Road as delineated on the Centerline
Plat for said improvement, on record in Franklin County;
thence South 83 degrees 40 minutes 38 seconds West, leaving said point, a distance of2,14 feet
to the point at which the new centerline of Avery Road intersects the centerline of Shier-Rings
road;
thence South 85 degrees 31 minutes 51 seconds West, leaving said point with the centerline of
Shier-Rings Road, a distance of 198,03 feet to a point in the Grantor's former northerly property
line, said point being the northwesterly comer of an 0,819 acre tract conveyed to the State of
Ohio by deed of record in Deed Book 2797, Page 641 in the records of Franklin County;
thence South 04 degrees 28 minutes 09 seconds East, with the Grantor's former easterly line, a
distance of30.00 feet to a point in the southerly right of way line of Shier-Rings Road, and the
TRUE POINT OF BEGINNING of the parcel described herein;
thence South 79 degrees 31 minutes 03 seconds East, with said southerly right of way line, a
distance of 19,38 feet to an iron pin set at the point at which said line intersects the new southerly
Right of Way line of Shier-Rings Road;
thence South 85 degrees 31 minutes 51 seconds West, with said new Right of Way line, a
distance of210,75 feet to an iron pin set in the Grantor's westerly property line;
thence North 04 degrees 25 minutes 12 seconds West, with said westerly line, a distance of 4.99
feet to a point at the Grantor's northwesterly comer in the southerly right of way line of
Shier-Rings road;
thence North 85 degrees 31 minutes 51 seconds East, the grantor's northerly line, and the said
southerly right of way line, a distance of 192,02 feet to the TRUE POINT OF BEGINNING of

Investments, as recorded in OR 00115 J08 in the Franklin County Recorder's Office, and being
more particularly described as follows:
Beginning at a point in the Grantor's easterly line in the westerly right of way line of Avery
Road, said point being 80.44 feet left of and radially from Station 17+75 in the centerline of
A very Road as delineated on the Centerline Plat for the improvement of said A very Road of
record in Franklin County, being the TRUE POINT OF BEGINNING of the easement being
described;
thence leaving said property line with the westerly line ,of the tract described herein, North 41
degrees 53 minutes 04 seconds West, a distance of 6.82 feet to a point;
thence continuing with said line, North 10 degrees 56 minutes 54 seconds West, a distance of

Description of an Easement for Construction and Maintenance of a Storm Sewer
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.047 acre out ofa 1.576 acres parcel conveyed to Avery Lake
Investments, as recorded in OR 00115 J08 in the Franklin County Recorder's Office, and being
more particularly described as follows:
Beginning at the Grantor's northeasterly corner in the southerly right of way line of Shier-Rings
Road and being 52.42 feet right of Station 118+85.94 in the centerline of survey of Shier-Rings
Road as delineated on the Centerline Plat for an improvement to A very Road and Shier-Rings
Road, of record in Franklin County, said point being the TRUE POINT OF BEGINNING of the
easement being described;
thence leaving said point with the southeasterly line of the easement described herein, South 47
degrees 21 minutes 05 seconds West, a distance of 109,33 feet to a point being the southeasterly
corner of this easement:
thence North 36 degrees 28 minutes 29 seconds West, a distance of 18,87 feet to the
southwesterly corner of the tract herein;
thence with the westerly line of this easement, North 45 degrees 38 minutes 35 seconds East, a
distance of 91.23 feet to a point in the Grantors northerly property line in the southerly right of
way line of Shier-Rings Road;
thence with said property line and right of way line, South 79 degrees 31 minutes 03 seconds
East, a distance of 26.85 feet to the TRUE POINT OF BEGINNING, said described tract
containing 0.047 acre, more or less.
The above described acreage is contained in Auditor's Parcel 274-000009.
Stations and offsets used in this description are referenced to the proposed centerline of Shier-
Rings Road as appears on the Centerline Plat For the improvement of Avery and Shier-Rings
Roads prepared by URSGreiner, and ofrecord in Franklin County.
Bearings used in this description are based on an actual field survey utilizing Franklin County
Monuments Nos. FCGS 5536 and FCGS 7752 by URSGreiner in June 1996.
