Fan, No. 3 45 Resolution No. 36 -11 20 Passed A RESOLUTION ACCEPTING THE LOWEST AND BEST BID FOR THE COMPRESSED NATURAL GAS STATION EQUIPMENT PROJECT WHEREAS, the City of Dublin is modifying its existing fueling facility to compress and dispense natural gas as a vehicle fuel; and WHEREAS, the City has been awarded a grant from the Department of Energy and Clean Fuels Ohio to partially fund this project; and WHEREAS, per the grant requirements, the City must purchase equipment to compress and dispense natural gas as a vehicle fuel as part of the larger project to develop a Natural Gas Station and convert certain City vehicles to operate on Compressed Natural Gas; and WHEREAS, the City has administered a public bid process in accordance with the City's bidding rules and regulations and complied with the Department of Energy's bidding regulations; and WHEREAS, ANGI Energy System's (ANGI) bid to build and deliver the specified equipment for $789,399.25 has been determined to be the lowest and best bid. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, of its elected members concurring, that: Section 1. ANGI Energy System is hereby declared to be the lowest and best bidder for the Compressed Natural Gas Station Equipment Project. Section 2. The City Manager is hereby authorized to execute an agreement with ANGI Energy Systems for $789,399.25 to build and deliver the equipment necessary to compress and dispense natural gas as a vehicle fuel. Section 3 . It is found and determined that all formal actions of the Council of the City of Dublin concerning and relating to the passage of this Resolution were adopted in an open forum of this Council and of any of its subcommittees in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 4. This Resolution shall be effective upon passage in accordance with Section 4.04(a) of the Revised Charter. Passed this ) day of 2011. Burns, Director of Streets and Utilities Memo Re: Resolution 36 -11 - Accepting the Lowest and Best Bid for the Compressed Natural Gas Equipment Project Summary Resolution 36 -11 authorizes acceptance of the lowest and best bid for the equipment necessary to compress and dispense natural gas as a vehicle fuel. The equipment consists of three fuel dispensers (gas pumps), a two -stage natural gas compressor, a natural gas dryer and other related components of the system. Staff conducted a bid process in compliance with the Department of Energy grant requirements. Two bids were received and opened on June 15, 2011. The estimated cost of this equipment was $975,000. The bid results were as follows: Vendor Bid Amount ANGI Energy Systems $789,399.25 IMW $931,900.00 ANGI Energy Systems is a reputable company with extensive experience building and delivering this type of equipment. Staff checked ANGI's references and found favorable results. The City's consultant, Rob Adams of Marathon Technical Services conducted an analysis of the technical components of ANGI's bid, and found those components to be responsive and satisfactory. Legal staff completed an analysis of both bids and found IMW's bid to be missing several required bid forms. IMW's responsiveness issues notwithstanding, at more than $140,000 higher than the ANGI bid, the IMW bid is not competitive. Recommendation Based upon the careful review of the ANGI bid conducted by staff, the design expert and counsel, staff recommends that Council determine ANGI to be the lowest and best bidder for the project and award the contract to ANGI. Staff therefore recommends City Council adoption of Resolution 36 -11, authorizing the City Manager to enter into an agreement with ANGI Energy Systems to supply the equipment described above.
