HomeMy WebLinkAboutOrdinance 33-11RECORD OF ORDINANCES Ordinance No. 33 -11 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY CONVEYANCE DOCUMENTATION FOR THE ACQUISITION OF A COMBINED 2.294 ACRES, MORE OR LESS, FEE SIMPLE INTEREST FROM MICHAEL HARBER AND HEATHER HARBER. WHEREAS, the City of Dublin ( "City ") is preparing to construct the Emerald Parkway Phase 8 roadway construction project; and WHEREAS, Michael E. Harber and Heather S. Harber ( "Harber") own two parcels that the City must acquire property interests from in order to construct the Emerald Parkway Phase 8 project; and WHEREAS, the City and Harber participated in discussions for the acquisition of these property interests from Harber; and WHEREAS, the City and Harber have come to mutually agreeable terms for the acquisition of these property interests; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between Harber and the City. NOW, THEREF,QRE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, �J of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire a combined 2.294 acres, more or less, fee simple interest from Harber. Section 2. Harber shall be compensated for the aforementioned property interests in the amount of Two Hundred Seventy -Five Thousand Dollars ($275,000.00). Section 3 . This ordinance shall take effect on the earliest date permitted by law. Passed this day of 2011. Harber for Emerald Parkway Phase 8. Attached is a revised exhibit depicting the property to be purchased for a total amount of $275,000. There are no changes to the Ordinance as previously submitted. Recommendation Staff recommends approval of Ordinance 33 -11 at the June 27, 2011 Council meeting. Huber & Heather S. Huber PROJECT BACKGROUND: The City of Dublin ('City ") is preparing to construct the Emerald Parkway Phase 8 roadway construction project. The City must acquire property interests from various landowners located within the City in order to construct ttris roadway project. A representative of the City has contacted the landowners in order to gauge their respective interests in selling the needed property interests to the City. ACQUISITION INTRODUCTION: The City has successfully negotiated a land sale transaction with Michael E. Huber and Heather S. Huber (collectively the "Harbers "). The City will be acquiring two parcels from the Harbers. The map attached to this memorandum depicts those property interests needed for the Emerald Parkway Phase 8 construction project. The remainder of the parcels being acquired from the Harbers will eventually be sold by the City. The City is allowing the Harbers to reside on the property via lease arrangement for one (1) year after closing. In total, the acquisition consists of the following property interests: PROPERTY INTEREST ACQUIRING ACRES COST 1. Fee Simple Parcel No. 273- 008679 1.760 $ 211,750 2. Fee Simple Parcel No. 273 - 008413 0.534 $ 63,250 TOTAL COMPENSATION $ 275,000 ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance No. 33 -11 would allow the City Manager to execute all necessary conveyance documentation to formally acquire the aforementioned property interests. RECOMMENDATION: Staff recommends approval of Ordinance No. 33 -11 at the second reading/public hearing on June 27, 2011 as the acquisition of these property interests is necessary for the furtherance of the Emerald Parkway Phase 8 construction project. 2
