Ii WHEREAS, the City of Dublin is preparing to install storm sewer improvements
!i along Riverside Drive in Dublin, Ohio; and
II WHEREAS, said improvement will require the City of Dublin to obtain a storm sewer
II easement and a temporary construction easement in and to the premises described in
Ii the attached Exhibits "A and B" located in the City of Dublin, Franklin County, Ohio.

Iii NOW THERE~RE, BE IT RESOLVED by the Council, of the City of Dublin,
II State of Ohio, of the elected members concurring that:

I Section 1. Council considers it necessary and declares its intention to appropriate,
I for the purpose of installing storm sewer improvements along Riverside Drive in
II Dublin, Ohio, a storm sewer easement and a temporary construction easement in and
I to the premises located in the City of Dublin, Ohio, and more fully described in the
II legal descriptions attached hereto as Exhibits "A and B ".

II Section 2. The City Manager is hereby authorized to cause written notice of the
:1 passage of this Resolution to be served upon the owners and persons in possession or
II having an interest of record in the above-described property. This notice shall be
II served according to law.

II Section 3. This Resolution shall take effect and be in force from and after the
Ii earliest date permitted by law.

Situated in the State of Ohio, County of Franklin, City of Dublin, Section 11, Quarter Township
2, Township 2, Range 19, United States Military Lands, and being a 20.00 foot strip ofland out of that
parcel ofland as conveyed to Wendy's International of record in Deed Book 3484, Page 718, (all deed
references refer to records of the Recorder's Office, Franklin County, Ohio) and described as follows:
Beginning, for reference, at the southeasterly comer of Grantor's tract;
thence North 860 54' 50" West, with the southerly line of Grantor's tract, a distance of 7.41 feet
to the True Point of Beginning for this description;
thence North 860 54' 50" West, continuing with said southerly line, a distance of 20.00 feet to a
point;
thence North 030 06' 07" East, across Grantor's tract, a distance of 91.35 feet to a point;
thence North 710 48' 55" East, continuing across Grantor's tract, a distance of 29.42 feet to a
point on the easterly line of Grantor's tract;
thence South 030 06' 07" West, with said easterly line, a distance of21.46 feet to a point;
thence across Grantor's tract the following courses:
South 710 48' 55" West, a distance of7.95 feet to a point; and
South 030 06' 07" West, a distance of 77.68 feet to the True Point of Beginning, and containing
0.047 feet ofland, more or less.
