38-01 Resolution RECORD OF RESOLUTIONS Day tan legal Blank Co., Form No. 30045 11 ~ Resolution No. ..... 38-01 Passed .. ...... ....., YEAR -..---- -_.._-,~- I, A RESOLUTION ADOPTING A POLICY FOR THE FUTURE I' DEVELOPMENT OF POST ROAD, DUBLIN, OHIO WHEREAS, the City of Dublin is a thriving community that seeks continued growth; and WHEREAS, to grow in an orderly manner, the City must carefully plan the manner in which it shall acquire properties for future development; and WHEREAS, Post Road contains properties that may present opportunities for future acquisitions by the City; and WHEREAS, in order to ensure that the development of Post Road is accomplished in an orderly manner, the adoption of a City policy is necessary; NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Dublin, State of Ohio, ~_ of the elected members concurring, that: Section 1. Explanation of Development Policy. The stated policy of the City of Dublin is to acquire certain residential properties along the north side of Post Road on the open market, from willing buyers (without eminent domain), at reasonable acquisition prices. This policy should not be interpreted to mean that it is the objective of the City to ensure that the properties are acquired at a reasonable price, and that strategies to effect that reasonable prices will be paid will be used. Rather, the policy means that if properties become freely available and the price is reasonable, acquisition will be pursued. Should it be the case that land or property values rise to a point that acquisition by the City is not a good investment, then it may be the case that the properties are not acquired by the City at all. Specifically, the City will not take actions to discourage improvements to existing homes or structures or limit their value. Building permits will be available according to Code standards applying to the City as a whole. An example might be, if a variance was requested to allow expansion of a home, the City would not oppose the variance on the ground that it would increase the value of the property and thus the price the City might eventually have to pay. This does not mean that the City, acting through its staff, might recommend against the request for other valid reasons. Similarly, City staff will not privately discourage improvement of Post Road properties with the goal of holding down properties' values. The policy is also not intended to favor Post Road properties, as opposed to other properties in the City. Requests for discretionary actions such as rezonings or variances will be viewed the same as any other area of the City, with property owners having the same rights, and taking the same chances, as other citizens. Section 2. Explanation of Policy Toward Post Road Neighborhood Although the City is desirous of acquiring certain properties along the north side of Post Road, it is recognized that that goal may take a number of years, and may in fact not ever be fully realized.
