HomeMy WebLinkAbout35-04 Resolution RECORD OF RESOLUTIONS [)aX!:::~!:_~51_a~_~I_~~~,_ ~~~.~_~?~_~~_~ ~g94~ 35-04 Passed .20~ A RESOLUTION LOWERING THE SPEED LIMIT FROM 55 MPH TO 45 MPH ON HYLAND-CROY ROAD WITHIN THE CITY OF DUBLIN CORPORATION LIMITS WHEREAS, a request has been received that the statutory vehicular speed limit established by Section 4511.21 of the Ohio Revised Code is greater than a considered reasonable and safe speed for Hyland-Croy Road, from the southern City of Dublin corporation limit, 0.26 mile south of Brand Road/Mitchell-Dewitt Road, to the northern City of Dublin corporation limit, 0.11 mile south of Brand Road/Mitchell- Dewitt Road, and that the speed limit on that section of road be lowered; and WHEREAS, the Union County Engineer has conducted an engineering and traffic investigation upon said section of road and confirmed that the statutory speed limit of 55 mph is not a reasonable and safe speed for said section of highway; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, F of the elected members concurring that: Section 1. In accordance with the provisions of Section 4511.21 of the Ohio Revised Code, the Director of Highways is hereby requested to review the Union County engineering and traffic investigation to determine and declare the reasonable and safe prima facie speed limit on Hyland-Croy Road (Union County Road 2) from the southern City of Dublin corporation limit, 0.26 mile south of Brand Road/Mitchell-Dewitt Road, to the northern City of Dublin corporation limit, 0.11 mile south of Brand Road/Mitchell-Dewitt Road in Union County, Ohioo Section 2. Upon notification that the Director of Highways has determined and declared a speed of 45 mph to be a reasonable and safe speed limit on the section of road described in Section 1 hereof, standard signs, properly posted and giving notice thereof, shall be erected. Section 3. This resolution shall take effect and be in force from and after the earliest date permitted by law. Resolution 35-04 Summary: Due to the opening of Dublin Jerome High School and the increased development activity along Hyland-Croy Road, several residents have raised concerns about the speed limit on Hyland-Croy Road, which is located entirely in Union County. Union County has all of the right-of-way in their jurisdiction except a small piece, 0.15 mile long that is located in the City of Dublin. The southern City of Dublin Corporation Limit is 0026 mile south of Brand Road/Mitchell-Dewitt Road and the northern City of Dublin Corporation limit is 0.11 mile south of Brand Road/Mitchell-Dewitt Road. Again, the remainder of the right-of-way is located in Union County's jurisdiction. The Division of Engineering has been working with The Ohio Department of Transportation (ODOT) and the Union County Engineer's Office to determine and declare a reasonable and safe prima facie speed limit on Hyland-Croy Road from Weldon Road (Township Road 4) and McKitrick Road (County Road 10)0 On August 12,2004, Union County submitted a speed reduction study to ODOT for their consideration and reviewo By way of a letter dated August 26, 2004, ODOT District 6 agreed with the recommended statutory speed limit reduction from 55 mph to 45 mph, from Weldon Road to McKitrick Road. Staffhas identified two main reasons to lower the speed limit on Hyland-Croy Road within City of Dublin Corporation Limits, to provide the safest possible roadway and remain consistent with surrounding jurisdiction's speed limit. The letter to ODOT submitting the speed study, the completed "Warrants for Speed Zone" worksheet that calculated the warranted speed at 45 mph, the Union County Commissioners Resolution 381-04, requesting the speed limit reduction and agreeing to post appropriate signage, ODOT's agreement letter dated August 26, 2004, and the "Speed Limit Revision" worksheet that completes the journalization process have all been attached for your reviewo Recommendation: Staff recommends Council adopt Resolution 35-04 to lower the speed limit on Hyland-Croy Road within the City of Dublin Corporation Limits from 55 mph to 45 mph. f' pS;~~!m c~~~~;;,:. By virtue of the provisions of Sec.4511.21, Revised Code of Ohio the Director of Highways is hereby requested to review the engineering and traffic investigation and to detennine and declare a reasonable and safe prima facie speed limit on Hvland-Croy See C & 0 (CR 2) between Weldon Rd (TR 4) and McKitrick Rd (CR 10) in Union County, Ohio. Section 2. That when this Board is advised that the Director of Highways has determined and declared a reasonable and safe speed limit on the section of road described in Section 1 hereof, standard signs, property posted and giving notice thereof will be erected. Grigsby, Deputy City Manager/Director of Finance\ ~~ Re: Resolution No. 36-04, Resolution Accepting The Amounts and Rates and Authorizing Tax Levies SUMMARY: Each year, the Franklin County Budget Commission determines the amount of property taxes to be received based on the City's millage rates, both inside and outside the "10 mill limit". The inside millage rate was established many years ago by the State and the outside millage is based on the rate needed to retire the two debt issues supported by property taxes and the 1976 levy for police operations. The property tax revenue generated from the inside millage will be credited to the Parkland Acquisition Fund and utilized to acquire recreational facility sites, open space and parkland. The distribution of the inside millage is evaluated annually as part of the tax budget process. The adoption of this Resolution is required by Section 5705.34 ofthe Ohio Revised Code. As stated in the attached correspondence from the Franklin County Budget Commission, the adopted Resolution is to be filed with the Budget Commission on or before October 10 RECOMMENDATION: Staff is recommending the adoption of Resolution No. 36-04 at the September 20, 2004 City Council meeting.
