A RESOLUTION OF INTENT TO APPROPRIATE A 0.024
ACRE, MORE OR LESS, FEE SIMPLE INTEREST, AND A
0.040 ACRE, MORE OR LESS, TEMPORARY

CONSTRUCTION EASEMENT, FROM SAL TERGATE N-W
INVESTMENT CO., LTD., LOCATED EAST OF SAWMILL
ROAD AND NORTH OF SALTERGATE DRIVE, CITY OF
COLUMBUS, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to construct Phase SA of Emerald Parkway
extending from Sawmill Road to Saltergate Drive to Hard Road. This project will include
replacement of the traffic signal and curb ramps at the intersection of Sawmill Road and
Saltergate Drive and repaving of the intersection; and
WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest
and temporary construction easement in and to the premises described in the attached
Exhibits "A" and "B" located in the City of Columbus, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, ofthe City of Dublin, State of
Ohio, ~ of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to appropriate, for the
purpose of constructing Phase SA of Emerald Parkway extending from Sawmill Road to
Saltergate Drive to Hard Road, a fee simple interest and temporary construction easement in
and to the premises located in the City of Columbus, Ohio, and more fully described in the
legal descriptions attached hereto as Exhibits "A" and "B".
Section 2. The City Manager is hereby authorized to cause written notice ofthe passage
of this Resolution to be served upon the owners and persons in possession or having an
interest of record in the above-described property. This notice shall be served according to
law.
Section 3. This Resolution shall take effect and be in force from and after the earliest
date permitted by law.

The following Real Estate situated in Section 1, Township 2, Range 19 of the United States Military
Lands, in the City of Columbus, Franklin County, Ohio, and being part of a 3.004 acre tract conveyed to
Saltergate N-W Investment Company, Limited, as recorded in Instruments 200010100205319 and
200010100205320 of the Franklin County Recorder's Office, and being more particularly described as
follows;
Beginning, for reference, at a point in Sawmill Road at Franklin County Engineer's monument FeGS
7769, at the intersection of the centerline of Saltergate Drive, said Saltergate Drive being shown on the plat
ofOlde Sawmill Phase One, recorded in Plat Book 48, Page 14;
Thence S 87-16-11 E, 85.06 feet along the said center line of Salter gate Drive to a point;
Thence N 02-43-49 E, 30.00 feet to an iron pin set in the north line of Saltergate Drive and the grantor's
south line, and also being the most easterly comer and PRINCIPAL PLACE OF BEGINNING of the
0.024 acre parcel described herein;
Thence N 87-16-11 W, 27.32 feet along the said north line of Salter gate Drive and the grantor's south line
to a point of curvature;
Thence with a curve to the right having a radius of 20.00 feet, an arc length of 31.42 feet, a delta angle of
90-00-00, and a chord bearing N 42-16-11 W, 28.28 feet, to a point oftangency in the east line of Sawmill
Road as shown on the Plat of Olde Sawmill Phase One;
Thence N 02-43-49 E, 27.32 feet along the east line of Sawmill Road and the grantor's west line to a PK
nail set in concrete sidewalk at the most northerly comer of the 0,024 acre parcel herein described;
Thence S 42-16-11 E, 66.93 feet across the grantor's land to the PRINCIPAL PLACE OF
BEGINNING containing 1,034 sq. ft" or 0.024 acres, more or less, subject to all legal rights-of-way,
easements and restrictions of record,
Iron pins indicated set are 5/8" x 30" rebars with a plastic I.D. cap stamped "Dodson 6446",

based upon an actual survey of the premises in May 2004, and upon available public records, Bearings

RE: Emerald Parkway - Phase SA
SUMMARY:
This project requires appropriation of right-of-way from two (2) property owners for the
construction of a new phase of Emerald Parkway extending from Sawmill Road to Saltergate
Drive to Hard Road, This project will include replacement of the traffic signal and curb ramps at
the intersection of Sawmill Road and Saltergate Drive and repaving of the intersection.
Resolution No, 28-04 has been submitted to Council for approval of Dublin's (in cooperation
with the City of Columbus) intent to appropriate the necessary right-of-way, This property is
located on the east side of Sawmill Road and north of Saltergate Drive, The remaining property
owner has agreed to donate the necessary right-of-way and temporary construction easement.
RECOMMENDATION:
Legal Staff recommends approval of this Resolution.
