HomeMy WebLinkAbout41-02 Resolution RECORD OF RESOLUTIONS Dayton legal Blank Ca., Farm No. 30045 Resolution NO.uu41.,,02u Passed uuuuuuuuu ............ uuuuu, yE....R A RESOLUTION CONCERNING THE PLACEMENT OF ELECTRIC TRANSMISSION LINES IN THE CITY OF DUBLIN WHEREAS, American Electric Power has expressed the need to reinforce the electrical transmission system in the Dublin area due to past and anticipated growth and development; and WHEREAS, American Electric Power is proposing to build the Davidson-Dublin 138KV Transmission Line Project to resolve the current and future electrical needs of Dublin; and WHEREAS, AEP believes that the Davidson-Dublin Transmission 138KV Transmission Line Project is needed to maintain reliable electric service to Dublin area residents and American Electric Power's customers; and WHEREAS, the City of Dublin takes great pride and expends great resources and effort to maintain a high quality of life for its residents with consideration to safety, aesthetics, property values and land use resources; and WHEREAS, the placement of new overhead electric transmission lines in the City of Dublin may negatively affect the quality oflife of City of Dublin residents if such lines are placed within or along properties used for residential purposes and may negatively affect the economic development of land within the city if placed along highly visible commercial corridors; and WHEREAS, the City of Dublin believes that the appropriate location for electric transmission lines is underground for reasons of safety, aesthetics, property values and land use resources; and I I WHEREAS, the City of Dublin has worked cooperatively with American Electric Power, residents and various property owners to identify the appropriate route, design and costs for the Davidson-Dublin 138KV Transmission Line Project; and WHEREAS, the City of Dublin desires to state its desired route/design, intent and needed action regarding this project. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, !:1- of the elected members concurring, that: Section 1. The City of Dublin recognizes and supports American Electric Power's need to better meet current and future demands for electricity in the City of Dublin. Section 2. The City of Dublin opposes the placement of the new Davidson-Dublin 138KV overhead electric transmission line along routes within or adjacent to residential neighborhoods and highly visible commercial areas within the City of Dublin when other feasible alternatives are availatle. Section 3. The City of Dublin desires the placement of the new Davidson-Dublin 138KV electric transmission line as an underground transmission line along Hirth Road, east on Tuttle Crossing to either Emerald Parkway or the Dublin portion of 1-270 to the Dublin Substation, whichever is most cost effective. Section 4. The City of Dublin recognizes there are additional costs associated with the desired route/design as stated in number three (3) above. Therefore, the City of Dublin hereby states its intent to fund fifty percent ofthe additional cost to construct the proposed project based on current estimates, excluding easement costs to be donated by Duke Realty. Section 5. The City Manager is hereby directed to seek funding using existing TIF Agreement( s) and bring forth the necessary legislation to Council at the earliest opportunity. The City Manager is hereby directed to draft, in cooperation with all appropriate parties, the necessary Letter(s) af Intent and/or Agreement(s), stating financial commitment based on more refined estimates, and outlining necessary processes in pursuit of the desired route/design option(s), as stated in number three (3) above, and to seek Council approval to execute these Letter(s) af Intent and/or Agreement(s) via City Ordinance. Section 7. The City Manager is hereby directed to prepare and ultimately present the City of Dublin's preferred route/design option(s), financial commitment, Letter(s) afIntent and/or Agreement(s), legal position and any other necessary information to the Ohio Power Siting Board. Section 8. The City Manager is hereby directed to strictly monitor and report filings, actions, inquiries and other information relative to the Ohio Power Siting Board's processes, procedures and/or actions relative to this project to Council as needed, and to file the necessary "interventions" or other legal filings to insure the City's participation at the Ohio Power Siting Board. Section 9. The City Manager is hereby directed to continue refining legal remedies/ strategies should they become necessary. Section 10. The City of Dublin requests that American Electric Power refrain from filing the Davidson-Dublin 138KV Project with the Ohio Power Siting Board until such time that a mutually agreed upon route/design is finalized and Letter(5) af Intent and/or Agreement(s) are executed as necessary. Section 11. The City of Dublin expresses its thanks and gratitude to American Electric Power and its representatives for their professionalism, responsiveness, candor and "can do" attitude throughout the process of identifying various options and for their cooperation and expressed participation in the desired route/ design solution described in number three (3) above. Section 12. The City of Dublin expresses its thanks and gratitude to Duke Realty who has expressed its intent to donate the necessary easement(s) to accommodate the desired route/design option described in number three (3) above. Section 13. The City of Dublin is especially thankful to its residents for their involvement, concern and patience thus far in this process. Section 14. This resolution shall be in force and effect immediately upon its passage as provided under Section 4.04(a) of the Revised Charter. McDaniel, Assistant City Manager/Director of Service RE: Davidson-Dublin 138KV Transmission Line SUMMARY Staff has continued to work with AEP, residents, Duke Realty, ODOT, and the City's Consultant to ascertain various options regarding AEP's proposed 138KV transmission line. The attached presentation to be given at Council's November 18th meeting provides background and options regarding this proposed transmission line project. Given Council's objectives and implied direction to shift the proposed construction of the 138KV transmission line from the neighborhood, several options were identified. The associated costs of these options have been estimated. Based on these estimates, Staff, AEP and Duke Realty, where applicable, have expressed intent to move forward with certain route/design options. Resolution 41-02 is a means for City Council to express: its support of certain route/design option(s); state its intent regarding financial commitment; and provide direction to the City Manager regarding certain actions going forward. RECOMMENDATION Of the options available and with consideration to the implied direction to locate new transmission lines out of neighborhoods, staff recommends that: . Council reviews the options regarding the placement of the 138KV transmission line (attached presentation). . Council direct staff to continue working with AEP and Duke Realty to pursue the most cost effective option between Option 3 (Bury transmission along Hirth Road, Tuttle Crossing, and 1-270 to the Dublin Substation) and Option 4 (bury transmission along Hirth Road and Emerald Parkway to the Dublin Substation). . Council authorizes the intent to fund 50% of the "shortfall" cost of either of these options based upon current estimates. . Council pass Resolution 41-02 as a means to: express its desire to not locate new overhead transmission lines in neighborhoods or highly visible commercial areas; express its support of the desired route/design option(s); state its intent regarding financial commitment based upon refined estimates; provide direction to the City Manager regarding Letter(s) of Intent and/or Agreement(s), the OPSB, and legal remedies/strategies; thank participants. More details between the parties will need to be worked out. Letter(s) of Intent and/or Agreements will best serve to define details and further refine costs. The parties could then present such documents to the OPSB as a demonstration of joint commitment/approval of the route/design. This will better enhance the chances for approval ofthe desired outcome by the OPSB.
