OF 41+/ ACRES FROM WASHINGTON TOWNSHIP, FRANKLIN
COUNTY TO THE CITY OF DUBLIN, OHIO AS REQUIRED BY
SECTION 709.031 OF THE OHIO REVISED CODE.
WHEREAS, a petition for the annexation of 41 +/- acres from Washington Township was
duly filed on October 25, 2001 by Robert E. Albright, 600 South High Street, Columbus,
OH 43215, Agent for Cosgray Road, LLC; Sheila G. Lemaster, Samuel J. Lemaster and
Sharon L. Ferrell; and
WHEREAS, a public hearing has been scheduled before the Franklin County
Commissioners onWednesday, January 16 at 10 a.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and
sewer service extension area, as provided under the agreements with the City of Columbus;
and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, .::J-- of the members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the 41 + /-
acres in Washington Township, Franklin County upon the annexation of the area to the
City of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other jurisdictions. The
annexation area lies approximately 3 miles southwest of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately 3 minutes for an emergency situation should be
expected for this area.
Fire. Fire and emergency medical services protection is currently provided by a
well-staffed department in Washington township. They, too, have mutual aid
agreements with other jurisdictions. This annexation would not change fire
department jurisdictional boundaries, and therefore response times for fire and
emergency medical services will not be affected. Station 91 is located
approximately 2.5 miles from the annexation area, and normal response time would
be approximately 3 minutes
Sanitation. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge.

Street Maintenance. The City has a Streets and Utilities Division which
provides excellent service in the area of street and road maintenance.
Section 2. The City has SEWER and WATER service area contracts with the City
of Columbus, and the subject property is within the service areas. Conditioned on
the ability of the City of Columbus to provide WATER, and to provide sufficient
SEWERAGE disposal capacity, the City of Dublin will have the ability to service
the area.
Section 3. This resolution shall be in force and effect immediately upon its passage
as provided under Section 4.04(a) of the Revised Charter.

PETITION FOR ANNEXATION
TO THE CITY OF DUBLIN. OHIO OF 41 ACRES.
MORE OR LESS. IN WASHINGTON TOWNSHIP.
FRANKLIN COUNTY. OHIO
Now comes the undersigned, petitioners in these pre~ises and being the owners
of a certain area as hereinafter described, consisting of '41 acres, more or less, in
Washington Township, Franklin County, Ohio, which is contiguous and adjacent to the
City of Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated
in the Township of Washington, County of Franklin and State of Ohio, and an accurate
description of said territory is attached hereto and made a part hereof as Exhibit "A".
A plat of the above-described territory in Washington Township, Franklin County,
Ohio, is attached hereto and made a part hereof as Exhibit "B".
The number of owners in the territory sought to be annexed is four (4), and four
(4) owners signed the annexation petition.
Robert E. Albright, of 600 South High Street, Columbus, OH 43215, is hereby
appointed agent for the undersigned petitioners, as required by Section 709.02, Ohio
Revised Code; and said agent is hereby authorized to make any amendments by way of
additions or deletions which in his absolute and complete discretion are proper under
the circumstances then existing, and in particular to make such deletion(s) or
amendment(s) in order to correct any discrepancy or mistake noted by the Franklin
County Engineer in his examination of the petition and plat. Said amendment(s) shall
be made by the presentation of an amended plat and description to the Board of County
Commissioners of Franklin County, Ohio, on, before, or after the date set for hearing
on this petition.

Survey Nos. 6953 and 3453 and being more particularly described as follows:
Beginning at the intersection of the south right of way line of Rings Road (60 feet
wide) with the east line of said V.M.S. line 6953, also being on an existing City of Dublin
Corporation Line, as established by Ordinance No. 89-90 and shown ofrecord in Official
Record Volume 16039 A18, Franklin County Recorder's Office, also being on an east
line of a 6 Acres tract conveyed to Sheila G. Lemaster, Samuel 1. Lemaster and Sharon
L. Ferrell as shown of record on ORV 32466 1-09;
Thence, southerly, along said Existing Corporation line, and also part of the east

You are hereby notified that in accordance with the provisions of
~709.031(B) of the Ohio Revised Code as amended September 26, 1984, upon
receipt of the notice of publication of an annexation, the municipal
authority is required to pass, either by ordinance or resolution, a statement
indicating what services, if any, the municipal authority will provide to the
area to be annexed upon annexation. That resolution or ordinance must be
passed prior to January 16, 2002, the date of the hearing before the Board
of County Commissioners of Franklin County, Ohio, on the above-captioned
annexation. Said notice of publication was served upon you on immediately
prior to our serving the within Notice upon you. Section 709.031(B) of the
Ohio Revised Code provides as follows:
n(B) Upon receiving this notice, the municipal legislative
authority shall, by ordinance or resolution, adopt a statement
indicating what services, if any, the municipal corporation
will provide to the territory proposed for annexation upon
annexation.n
The failure of the municipal authority to timely pass such an ordinance or
resolution is grounds for the County Commissioners to disapprove the
annexation.

copy of the resolution or ordinance, upon the municipal authority's passing

Wednesday, January 16, 2002; and establishing the place for the hearing as
the Franklin County Commissioners' Hearing Room on the 26th Floor of the

"BE IT RESOLVED, by the Board of County Commissioners of Franklin
County, Ohio, that a hearing upon said petition shall be held in the County
Commissioners' Hearing Room, 26th Floor of the Franklin County
