A RESOLUTION AUTHORIZING THE
CITY MANAGER TO EXECUTE AN
EASEMENT WITH AMERICAN ELECTRIC
POWER (AEP) FOR THE DEVELOPMENT
OF THE DUBLIN COMMUNITY POOL SOUTH
WHEREAS, the City of Dublin has received a request from American Electric Power
(AEP) for an easement; and
WHEREAS, the easement is for electrical service infrastructure and is necessary to
support the construction of the Dublin Community Pool South; and
WHEREAS, the location is on the south side of Woerner Temple Road, west of
A very Road; and
WHEREAS, the Parcels numbered 274-000033,274-000041,274-000042,274-
000315,274-000314, and 274-000313, where the easement will be located, are City-
owned property.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, & of the elected members concurring:
Section 1. The City Manager is hereby authorized to execute an agreement with
American Electric Power (AEP) for an easement. The easement is located on the south
side of Woerner Temple Road, west of Avery Road,
Section 2. This resolution shall take effect and be in force from and after the
earliest date permitted by law,

Re: Resolution 13-04 Authorizing the City Manager to Execute an Easement with
American Electric Power (AEP) for the Development of Dublin Community Pool
South.
Summary:
In May 2003, construction of the Dublin Community Pool South commenced along the south side of
Woerner Temple Road and includes the construction of the public pool and the associated buildings,
installation of a groundwater well for irrigation and lighting for the parking lots, These amenities
require the extension of electrical service to this location, American Electric Power (AEP) provides
electric service in this area and will install the needed infrastructure, However, AEP has requested a
lO-foot easement over the alignment ofthe electric service as it extends across the City-owned
property for the pool.
Please find attached a copy of the written request for the easement from AEP as well as the easement
documentation, The documentation has been reviewed by staff and is consistent with past easements
typically granted to AEP upon City-owned property,
Recommendation:
Staff recommends approval of Resolution 13-04 authorizing the City Manager to execute an easement
with AEP for the development of the Dublin Community Pool South,

City of Dublin, an Ohio municipal corporation, grantor(s), in consideration of $1.00, the easement terms, and other good and valuable
consideration tl'om Columbus Southern Power Company, an Ohio corporation, 700 Morrison Dr., Ga1lanna, OR 43230-6605, "Grantee", the receipt
and sutTiciency of which is acknowledged, grants and conveys with general warranty covenants to Grantee, a right of way and "Easement", for
electric, other energy or communication purposes for current/future uses, overhead and underground, in, on, over, through and across the following
described lands situated in, Township of Washington, Franklin County, Ohio, Section _, Township_, Range _, Being Virginia Military
Survey 3004, being 12.5133 acres as recorded in the following multiple Instruments as recorded in, Franklin County Recorders Office.
Parcel No. 274-000033 containing 1.609 acres and recorded in Instrument No. 200110300250317.
Parcel No. 274-000041 and 274-000042 both containing 2.705 acres and recorded in Instrument No. 200107030149975.
Parcel No. 274-00315 (formerly 273-010336) containing 2.707 acres and recorded in Instrument No. 200103010041719.
Parcel No. 274-00314 (formerly 272-0(0224) containing 2.710 acres and recorded in Instrument No. 200109120210893.
Parcel No. 274-00313 (formerly 272-(00223) containing 2,712 acres and recorded in Instrument No. 200109120210905.

Said lines shall be constructed within the limits of a ten (10) foot wide strip of land. The centerline being the underground cable as installed.
The approximate location of which is shown on the attached drawing marked Exhibit "A" and made a part hereof.
This Easement conveys all necessaIY and convenient rights for the Easement's use, including, without limitation, the rights to: construct, operate,
maintain, inspect, protect, replace, enlaI'ge, upgrade, relocate within the easement, extend or remove utility facilities, with poles, anchors, guys,
supporting structures, conductors, conduits, service pedestals, grounding systems, foundations, manholes, devices and associated equipment, as it
may deem appropriate, adding thereto from time to time; perform grading or filling for such facilities. Said easement includes the right to cut, trim,
remove and/or othelwise control, at Grantee's option, without any liability to Grantor, any trees, overhanging limbs or branches, brush, shrubs,
undergrowth, of whatever size, (including those that are dead, diseased, weak, or leaning), buildings, structures, or other obstructions that in
GraIltee's reasonable judgment endangers or will endanger the safety of, interfere with or encroach upon the use of its facilities, both within and
adjoining the Easement. Within the easement, Grantor shall not: place any buildings, structures, pile or debris, interfere with lateral support,
construct any swimming pool, change the level of the ground by excavation or mounding without Grantee's written consent, allow any construction
that would be inconsistent with the National Electric Safety Code or Grantee's design staIldards and for underground lines, pennit or cause any
excavation, except for other utilities, provided such utilities rights do not conflict with this Easement. This Easement also conveys the right of
ingress and egress in and over aIlY reasonable routes at all times. If any governmental authority requires Grantee to relocate the facilities
contemplated by this grant, this Easement conveys the right to relocate such facilities to a compaI'able location subject to approval of grantor which
shall not be ull1'easonably withheld,
Grantor may use its propel1y for all purposes not inconsistent with the full enjoyment of the Easement, but GraIltor acknowledges high voltage
electric lines will be constructed within the Easement and Grantor shall conduct construction/maintenance activities on its propel1y consistent with
all applicable safety rules and regulations for working near electric lines, Safety/required clearance issues may be refen'ed to Grantee's Engineering
(iroup and if Grantor initiates any construction or building activities on its property, always call the applicable utility protection service before the
activity begins. Grantee shall restore the premises or pay reasonable damages done to fences, drains, seeded lawns (not landscaping), gates, ditches
and crops caused by Grantee's use of the Easement. Grantor has authority to grant this Easement. No delay or omission by Grantee in exercising
any right hereunder shall operate as a waiver or forfeiture of such right. This Easement grant is effective and binding upon the parties, their
respective successors, assigns, lessees, licensees, heirs and legal representatives, and if any term hereunder is held invalid, the remainder shall not be
affected thereby. Easement attachments, if any, are incorporated herein by this reference,
