A RESOLUTION TO SET FORTH A STATEMENT OF
SERVICES TO BE PROVIDED TO THE AREA IN A
PROPOSED ANNEXATION OF 8.0+/- ACRES FROM
WASHINGTON TOWNSHIP, FRANKLIN COUNTY TO THE
CITY OF DUBLIN, OHIO AS REQUIRED BY SECTION
709.023 OF THE OHIO REVISED CODE.
WHEREAS, a petition for the annexation of 8.0+/- acres from Washington Township,
Franklin County was filed in the 0 ffices 0 f the Franklin County Commissioners 0 n
February 2, 2004 by Paul V. Pavlic, Agent for Petitioners Anthony Gioffre and John
Gioffre, 6262 Eiterman Road, Dublin, Ohio 43016; and
WHEREAS, a public hearing has been scheduled before the Franklin County
Commissioners on Wednesday, April 7, 2004 at 10:00 a.m.; and
WHEREAS, Section 709.023 ofthe Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating
what services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and
sewer service extension area, as provided under the agreements with the City of
Columbus; and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, T~FORE BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the
8.0+/- acres in Washington Township, Franklin County upon the annexation ofthe area to
the City of Dublin, Ohio:
Police. The City provides Police and Communications service on a twenty-four hour
basis and also has mutual aid agreements with other municipalities. The annexation area
lies approximately three miles southwest of Dublin's Police Division Headquarters.
Dublin operates with a minimum of four cruisers on duty. A response time of
approximately six minutes for an emergency situation should be expected for this area.
Fire. Fire and emergency medical services protection is currently provided by a well-
staffed department in Washington township. They, too, have mutual aid agreements with
other municipalities and townships. This annexation would not change fire department
jurisdictional boundaries, and therefore response times for fire and emergency medical
services will not be affected. The Washington Township Fire Station #91 is located
approximately 1-1/2 miles east of the annexation area, and normal response time should
be approximately three minutes.
Sanitation. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge.
Street Maintenance. The City's Streets and Utilities Division provides excellent service
in the area of street and road maintenance.
Section 2. The City has sewer and water service area contracts with the City of
Columbus, and the subj ect property is within the service areas. Conditioned on the ability

of the City of Columbus to provide water, and to provide sufficient sewerage disposal
capacity, the City of Dublin will have the ability to service the area.
Section 3. This resolution shall be effective immediately upon its passage as provided
under Section 4.04(a) of the Revised Charter.

The undersigned, petitioners in the premises, and being a MAJORITY OF
OWNERS OF REAL ESTATE in the territory described, consisting of R*
acres, more or less, in the Township of WM c:; n i n gt-cm , which area is contiguous
and adjacent to the City of DublJ.n , do hereby pray that said territory be
annexed to the City of Dublin , according to the statutes of the
State of Ohio.
A full and accurate description and a plat of said territory so prayed to be annexed
are attached hereto and made part hereof.
In support of said Petition, your petitioners state that there are within the territory
so prayed to be annexed 2 OWNER (S) OF REAL EST ATE.
Paul v. Pavlic , is hereby appointed Agent for
the undersigned Petitioners, as required by Section 709.02 of the Revised Code of Ohio.
Said Agent is hereby authorized to make any amendment and/or deletion which in his
absolute and complete discretion is necessary or proper under the circumstances then
existing, and in particular to make such amendment in order to correct any discrepancy or
mistake noted by the Franklin County Engineer in his examination of an amended plat
and description to the Board of Commissioners on. before. or after the date set for
hearing on this Petition.

Realty LLC in Instrument No. 200104260089666, and that part of the existing
westerly right of way of Eiterman Road not heretofore acquired over a 63.120 acre
tract conveyed to Bates Property Management, L TD of record in Instrument No.
200002010022500, and that part of the existing westerly right of way of Eiterman
Road not heretofore acquired over a 13.541 acre tract conveyed to Bates Property
Management, L TD of record in Instrument No. 199909270242858 (all references
refer to the Recorder's Office, Franklin County, Ohio), said 12.3 acres of land
being approximately described as follows:
Beginning at the northeast corner of the Anthony and John Gioffre 0.997 acre
tract, being in the south line of a 19.548 acre tract conveyed to Steve and Sally
Young in Deed Book 3326, Page 115, the northwest corner of a 59 acre tract
conveyed to Robert Rings in Instrument No. 200203070059855, and being in a
southerly corporation line of the City of Dublin as established in City of Dublin
Ordinance No. 64-96, recorded in Official Record 33196 1-20;
Thence southerly along the east lines of the Gioffre 0.997 and 4.070 acre tracts,
the west line of said 59 acre Rings tract, about 489 feet to the southeast corner of
the 4.070 acre Gioffre tract, being the northeast corner of a 4.640 acre tract
conveyed to Eiterman/Post LLC of record in Instrument No. 199802230039207;
Thence westerly along the southerly line of the 4.070 acre Gioffre tract, the
northerly line of the 4.640 acre Eiterman/Post LLC tract, about 725 feet to the
northeast corner of the 0.368 acre City of Dublin tract;
Thence southerly along the east line of the 0,368 acre City of Dublin tract, being
parallel to and 45 easterly from the centerline of Eiterman Road, about 354 feet to
a point in the south line of the 4,640 acre Eiterman/Post LLC tract, being the
southeast corner of said 0.368 acre City of Dublin tract;
Thence southwesterly along the south line of said 0.368 acre City of Dublin tract,
about 47 feet to a point in the centerline of Eiterman Road, being in the east line
the aforementioned 1.177 acre tract conveyed to the City of Dublin;
Thence westerly, crossing said 1.177 acre tract, about 55 feet to a point in the
west line of said 1 .177 acres;
Thence northerly, along the westerly line of said 1.177 acre City of Dublin tract,
about 110 feet to the northwesterly corner of said 1.177 acre tract;
Thence easterly, along the north line of said 1.177 acre tract, about 30 feet to a
point in the existing westerly right of way of Eiterman Road;
Thence northerly, along the existing westerly right of way of Eiterman Road, being
parallel and 25 feet west of the centerline of Eiterman Road, crossing part of the
63.120 acre Bates Property Management tract, about 1482 feet to a point in the
north line of said tract, being in the south line of the aforementioned 13.541 acre
Bates Property Management L TD tract;
Thence northerly, continuing with the existing westerly right of way of Eiterman
Road, being parallel to and 25 feet westerly of the centerline of Eiterman Road,
and crossing part of said 13.541 acre Bates Management tract, about 414 feet to a
point in the southerly line of the aforementioned 0.292 acre City of Dublin tract;
Thence westerly along the south line of said 0.292 acre tract, about 20 feet to the
southwest corner thereof;
Thence northerly, along the westerly line of said 0.292 acre tract, being parallel to

northwest corner of said 0.292 acre City of Dublin tract, being in the north line of
the 13.541 acre Bates tract, and being in a southerly line of the aforementioned

the westerly line of the aforementioned highway easement parcel recorded in

Thence northerly, continuing with said highway easement, about 137 feet to a
point in the north line of said highway easement, being in an existing southern
corporation line of the City of Dublin established in Ordinance 65-91, of record in

Thence easterly along the north line of the First Apostolic Church tract, and with
said Dublin Corporation line, about 117 feet to a point in the westerly limited
access of U.S. 33;
Thence southeasterly, leaving said Corporation line, along the westerly limited
access of U.S. 33, about 58 feet to the northwest corner of the aforementioned
9.162 acre tract conveyed to Sutphen Realty LLC, being the northwesterly corner
of a highway easement known as Parcel 94 as shown on page 28 of 29 of the right
of way survey of U.S. 33 (FRA-33-0.00);
Thence southeasterly, continuing along the westerly limited access of U.S. 33,
about 114 feet to the northeast corner of said highway easement;
Thence southwesterly, into said 9.162 acre tract, with an east line of said highway
easement, about 43 feet to a point;
Thence southerly, with an east line of said highway easement, about 30 feet to a
point in the existing easterly right of way of Eiterman Road;
Thence southerly, along said easterly right of way, being parallel to and 25 feet
easterly of the centerline of Eiterman Road, about 156 feet to a point in the
southerly line of the 9,162 acre Sutphen Realty LLC tract, being in the north line
the aforementioned 1,165 acre City of Dublin tract, and being a corner of the City
of Dublin Corporation Line established in Ordinance 64-96;
Thence southerly with said Corporation line, through the 1.165 acre tract, being
parallel to and 25 feet easterly of the centerline of Eiterman Road, about 1127 feet
to an angle point in the Corporation line, being in the southerly line of said 1.165
acre tract;
Thence easterly, with said Corporation line, along the southerly line the 1.165 acre
tract, 20 feet to the northwest corner of the 3.077 acre Gioffre tract;
Thence easterly, with said Corporation line, along the northerly line of the 3.077
acre and 0.997 acre Gioffre tracts, along the southerly line the 19.548 acre Young
tract, about 727 feet to the point of beginning.
