A RESOLUTION WAIVING COMPETITIVE BIDDING
FOR THE PURPOSE OF REPAIRING PAVEMENT ON S.R. 161
(DALE DRIVE TO SHAMROCK BOULEV ARD)
WHEREAS, Section 8.04 (c) ("WAIVER OF COMPETITIVE BIDDING") of the
"' Revised Dublin Charter authorizes Council, by a vote of no less than five (5)
members, to waive competitive bidding requirements if they determine that such
waiver is in the best interest of the City; and
WHEREAS, Council has determined that there is a legitimate basis on which to
justify such waiver for the procurement of non-professional services related to
repairing the asphalt pavement and curb and gutter along a section of S .R.161
between Dale Drive and Shamrock Boulevard; and
WHEREAS, Council has determined that such waiver of competitive bidding is truly
in the best interest of the City; and
NOW, THERE"RE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, of the elected members concurring, that:
Section 1. Competitive bidding requirements are hereby waived for the
procurement of services related to repairing the asphalt pavement and curb and gutter
ofS.R. 161 between Dale Drive and Shamrock Boulevard.
Section 2. Such waiver of competitive bidding is hereby declared to be in the best
interest of the City.
Section 3. The City Manager is hereby authorized to hire the recommended
contractor for the purpose of repairing pavement and curb and gutter along a section
ofS. R. 161 between Dale Drive and Shamrock Boulevard.
Section 4. This Resolution shall take effect and be in force on the earliest date
permitted by law.

Re: Resolution No. 61-05 Waiving Competitive Bidding Process
Summary:
Attached, please find Resolution No. 61-05 waiving the competitive bidding requirements for the
procurement of services to repair the asphalt pavement and curb and gutter along a section of S.R. 161
between Dale Drive and Shamrock Blvd. The S.R. 161 west-bound traffic lane adjacent to the curb has
settled several inches in different locations from Dale Drive to Shamrock Boulevard. The settling is
along the S.R. 161 frontage of Wendy's International Headquarters. We believe the settling is due to
improper backfill compaction of an abandoned storm sewer trench that occurred during the
reconstruction of S.R. 161 from a 2-lane to 4-lane boulevard five years ago.
The depressions in the pavement have become severe enough this summer to warrant emergency repair.
In mid-August, we met with John Strawser of Strawser Paving Company to discuss repair strategy for
S.R. 161. We also had discussions with Kokosing Construction Company. Based on the workload this
fall for both companies, prior performance, and willingness to perform the work in a timely manner this
fall, staff recommends Strawser Paving Company to perform the work. A cost proposal in the amount
of$99,016.00 has been prepared by Strawser Paving Company. This cost does not include any
contingency money. Final cost of repair work is expected to be between $100,000 and $120,000.
Traffic will be maintained on S.R. 161 at all times during the repair process. Strawser Paving Company
has indicated they can start work mid-October. The repair process will likely take three weeks to
complete.
Pursuant to Section 8.04 (b) of the Revised Dublin Charter and Section 37.03 of the Dublin Codified
Ordinances, the procurement of non-professional services in the amount of $30,000 or greater requires
the City to conduct formal competitive bidding, unless Council waives such competitive bidding
requirements as specified in Section 8.04 (c) of the Charter.
Recommendation
Section 8.04 (c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5)
members, to waive competitive bidding requirements if they determine that such waiver is in the best
interest of the City. Under the circumstances, staff believes it would be in the best interest of the City to
waive competitive bidding requirements and, therefore, recommends that Council adopt Resolution No.
61-05.
