WHEREAS, as a condition of zoning, an access drive open to the public is required off of Village Parkway into Greystone Mews development; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest in and to the premises described in the attached Exhibit "A" located in the City of Dublin, Franklin County, Ohio; NOW, TH0FORE, BE IT RESOLVED by the Council ofthe City of Dublin, State of Ohio, of the elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of constructing an access drive off of Village Parkway into Greystone Mews development, a fee simple interest in and to the premises located in the City of Dublin, Ohio, and more fully described in the legal description attached hereto as Exhibit "A". Section 2. The City Manager is hereby authorized to cause written notice of the passage ofthis Resolution to be served upon the owners and persons in possession of or having an interest ofrecord in the above-described property. This notice shall be served according to law. Section 3. This Resolution shall take effect and be in force from and after the earliest date permitted by law. Banchefsky, Assistant Law Director DATE: July 26, 2005 RE: Village Parkway Access Drive Resolution No. 56-05 SUMMARY: This project requires appropriation of right-of-way from Continental Sawmill Limited Partnership for the construction of a public access drive off of Village Parkway into Greystone Mews development. A drawing of the proposed right-of-way is attached for your review. Negotiations with the property owner have stalled and this roadway connection must be completed in a timely manner. Resolution No. 56-05 has been submitted to Council for approval of Dublin's intent to appropriate the necessary right-of-way. RECOMMENDATION: Legal Staff recommends approval of Resolution No. 56-05.
