A RESOLUTION OF INTENT TO APPROPRIATE A 0.10
ACRE, MORE OR LESS, FEE SIMPLE INTEREST,
FROM CONTINENT AL SAWMILL LIMITED
PARTNERSHIP, LOCATED WEST OF VILLAGE
P ARKW A Y AND SOUTH OF TULLER ROAD, CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, as a condition of zoning, an access drive open to the public is required off
of Village Parkway into Greystone Mews development; and
WHEREAS, said improvement will require the City of Dublin to obtain a fee simple
interest in and to the premises described in the attached Exhibit "A" located in the City of
Dublin, Franklin County, Ohio;
NOW, TH0FORE, BE IT RESOLVED by the Council ofthe City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to appropriate, for
the purpose of constructing an access drive off of Village Parkway into Greystone Mews
development, a fee simple interest in and to the premises located in the City of Dublin,
Ohio, and more fully described in the legal description attached hereto as Exhibit "A".
Section 2. The City Manager is hereby authorized to cause written notice of the
passage ofthis Resolution to be served upon the owners and persons in possession of or
having an interest ofrecord in the above-described property. This notice shall be served
according to law.
Section 3. This Resolution shall take effect and be in force from and after the earliest
date permitted by law.

Resolution No. 56-05
SUMMARY:
This project requires appropriation of right-of-way from Continental Sawmill Limited
Partnership for the construction of a public access drive off of Village Parkway into Greystone
Mews development. A drawing of the proposed right-of-way is attached for your review.
Negotiations with the property owner have stalled and this roadway connection must be
completed in a timely manner. Resolution No. 56-05 has been submitted to Council for approval
of Dublin's intent to appropriate the necessary right-of-way.
RECOMMENDATION:
Legal Staff recommends approval of Resolution No. 56-05.

Beginning at a 3/4-inch (I.D.) iron pipe at a point of
curvature in II westerly right-or-way line of Federated Boulovard
(no.., known as Village parkway Py motion unanimously passed by
the City council, City of Dubl!.:l, Ohio, on August 1, 1999), as
said Federated Boulevard is designated and delineated upon the
recorded plat Dublin Village Center (Dedication of Federated I
Boulevard, Dublin Center Drive, Tullor Road and Easements), of
record in Plat Book 65, Pages 27 and 28, said beginning point "
being in the easterly line of that 10.000 acre tcact of land
described in the deed to Byers Realty, Inc., of record in

prepared from, information obtained from various field surveys
conducted by Bauer, Davidson' Herchant, Inc. beginning in
August of 19.95 and extending to November of 1989.
All of the iron pipe survey markere noted in the foregoing
description were in place in November of 1989.
The bearings given in the foregoing description correspond
to the bearings given for the centerline of survey made by the
Ohio Department of Highways for Interstate Route I-270
