A RESOLUTION OF INTENT TO APPROPRIATE A 0.059
ACRE, MORE OR LESS, TEMPORARY CONSTRUCTION
EASEMENT, FROM MALCOLM D. THORBURN AND
SALLY THORBURN, LOCATED WEST OF DUBLIN ROAD
AND SOUTH OF BRAND ROAD, CITY OF DUBLIN,
COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to construct a roundabout at the intersection of
Dublin Road and Brand Road; and
WHEREAS, said improvement will require the City of Dublin to obtain a temporary
construction easement in and to the premises described in the attached Exhibit "A" located
in the City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, ofthe City of Dublin, State of
Ohio, '7 of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to appropriate, for the
purpose of constructing a roundabout at the intersection of Dublin Road and Brand Road, a
temporary construction easement in and to the premises located in the City of Dublin, Ohio,
and more fully described in the legal description attached hereto as Exhibit "A".
Section 2. The City Manager is hereby authorized to cause written notice ofthe passage
of this Resolution to be served upon the owners and persons in possession or having an
interest of record in the above-described property. This notice shall be served according to
law.
Section 3. This Resolution shall take effect and be in force from and after the earliest
date permitted by law. 4

Situated in the State of Ohio, County of Franklin, City of Dublin, being part of Virginia
Military Survey Number 2543, and being within Lot 66 of Coventry Woods, Section 2 as
recorded in Plat Book 73, Page 16 as conveyed to Malcolm D. and Sally Thorburn of
record in Instrwnent Number 199904020082720 (all references to the records ofthe
Recorder's Office, Franklin County, Ohio unless otherwise specified) and being more
particularly described as follows:
Beginning at an iron pin found at the northwesterly corner of said Thorburn property, at
the northeasterly corner of Lot 65 of said Coventry Woods, Section 2 as conveyed to
Keith E. and Amy L Nichols of record in Official Record 17051, Page J11, and in the
existing southerly right of way of Brand Road;
Thence along the existing southerly right of way of Brand Road, North 88025'02" East a
distance of 170,08 feet to the northeasterly corner of said Thorburn property and the
westerly line of a 2,70 acre tract conveyed to The City of Dublin of record in Official
Record 13602, Page E16;
Thence along the easterly line of said Thorburn property and the westerly line of said
City of Dublin property, South 01034'55" East a distance of 15,00 feet to a point;
Thence crossing through said Thorburn property and along a 15 foot utility easement of
record on Plat Book 73, Page 16, South 88025'02" West a distance of 170,07 feet to the
westerly line of said Thorburn property and the easterly line of said Nichols property;
Thence along the westerly line of said Thorburn property and the easterly line of said
Nichols property, North 01036'19" West a distance of 15,00 feet to the Point of
Beginning and containing 0,059 acres, more or less,
Of the above described area 0,059 acres is contained within Franklin County Auditor's
Parcel 273-005483.
The bearings are based on the Ohio State Plane Coordinate System, South Zone, North
American Datum of 1983 from GPS field measurements made from Franklin County
Monuments "McNeal", "Frank 72", and "Frank 73".
The above description was prepared in February 2005 by Robert A, Bosworth,
Professional Surveyor 7750 and is based on a field survey made in September 2003 by
DLZ Ohio, Inc" Colwnbus, Ohio under the direction of said surveyor.
A drawing of the above description known as Exhibit "B" is attached hereto and made
part thereof.

SUMMARY:
This project requires appropriation of right-of-way and/or temporary construction easements
from seven (7) property owners for the construction of a roundabout at the intersection of Dublin
Road and Brand Road. A drawing of the proposed right-of-way and temporary construction
easements is attached for your review, Resolutions Nos. 15-05 through 21-05 have been
submitted to Council for approval of Dublin's intent to appropriate the necessary right-of-way
and temporary construction easements,
RECOMMENDA TION:
