WHEREAS, the City of Dublin is preparing to construct a roundabout at the intersection of Dublin Road and Brand Road; and WHEREAS, said improvement will require the City of Dublin to obtain a temporary construction easement in and to the premises described in the attached Exhibit "A" located in the City of Dublin, Franklin County, Ohio. NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of constructing a roundabout at the intersection of Dublin Road and Brand Road, a temporary construction easement in and to the premises located in the City of Dublin, Ohio, and more fully described in the legal description attached hereto as Exhibit "A". Section 2. The City Manager is hereby authorized to cause written notice of the passage of this Resolution to be served upon the owners and persons in possession or having an interest of record in the above-described property. This notice shall be served according to law. Section 3. This Resolution shall take effect and be in force from and after the earliest date permitted by law. kr Passed this IG day of ,2005. Exhibit" A" Parcel 24- T City of Dublin, Ohio From: Ruth Ann Thomas Description of Temporary Easement on the North side of Brand Road and West of Dublin-BelIepoint Road Situated in the State of Ohio, County of Franklin, City of Dublin, being part of Virginia Military Survey Number 2543, and being within a 0.9187 acre tract conveyed to Ruth Ann Thomas of record in Deed Book 3755, Page 53 (all references to the records of the Recorder's Office, Franklin County, Ohio unless otherwise specified) and being more particularly described as follows: Beginning at an iron pin found at the southwesterly corner of said Thomas property, the southeasterly corner of 0.9184 acre tract conveyed to Annemarie Sommer, M.D. of record in Deed Book 3609, Page 553, and in the existing northerly right of way of Brand Road; Thence along the westerly line of said Thomas property and the easterly line of said Sommer property, North 11 014'55" West a distance of 13.19 feet to a point; Thence crossing through said Thomas property, North 66044'37" East a distance of98.57 feet to a point; Thence crossing through said Thomas property, North 22023 '07" West a distance of 36.73 feet to a point; Thence crossing through said Thomas property, North 88030' 1 0" East a distance of38.58 feet to a point; Thence crossing through said Thomas property, South 41020'09" East a distance of 45.40 feet to the easterly line of said Thomas property and the westerly line of a 0.9189 acre tract conveyed to City of Dublin of record in Instrument Number 200407150164764; Thence along the easterly line of said Thomas property and the westerly line of said City of Dublin property, South 08038'29" East a distance of 49.22 feet to the southeasterly corner of said Thomas property, the southwesterly corner of said City of Dublin property, and the existing northerly right of way of Brand Road; Thence along the existing northerly right of way of Brand Road, South 88026'31" West a distance of 150.00 feet to the Point of Beginning and containing 0,167 acres, more or less, Of the above described area 0,167 acres is contained within Franklin County Auditor's Parcel 273-000881. The bearings are based on the Ohio State Plane Coordinate System, South Zone, North American Datum of 1983 from GPS field measurements made from Franklin County Monuments "McNeal", "Frank 72", and "Frank 73", The above description was prepared in February 2005 by Robert A. Bosworth, Professional Surveyor 7750 and is based on a field survey made in September 2003 by DLZ Ohio, Inc" Columbus, Ohio under the direction of said surveyor. Roundabout Resolutions Nos. 15-05 through 21-05 SUMMARY: This project requires appropriation of right-of-way and/or temporary construction easements from seven (7) property owners for the construction of a roundabout at the intersection of Dublin Road and Brand Road. A drawing of the proposed right-of-way and temporary construction easements is attached for your review. Resolutions Nos. 15-05 through 21-05 have been submitted to Council for approval of Dublin's intent to appropriate the necessary right-of-way and temporary construction easements.
