MORE OR LESS, FEE SIMPLE INTEREST, AND 0.132 ACRE,
MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT,
FROM A.E. WALLACE MAURER, LOCATED WEST OF DUBLIN
ROAD AND NORTH OF BRAND ROAD, CITY OF DUBLIN,
COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to construct a roundabout at the intersection of
Dublin Road and Brand Road; and
WHEREAS, said improvement will require the City of Dublin to obtain a fee simple
interest and temporary construction easement in and to the premises described in the
attached Exhibits "A" and "B" located in the City of Dublin, Franklin County, Ohio, i

NOW, THEREFORE, BE IT RESOLVED by the Council, ofthe City of Dublin, State of I
Ohio, '[ of the elected members concurring that: I

Section 1. Council considers it necessary and declares its intention to appropriate, for the
purpose of constructing a roundabout at the intersection of Dublin Road and Brand Road, a
fee simple interest and temporary construction easement in and to the premises located in
the City of Dublin, Ohio, and more fully described in the legal descriptions attached hereto
as Exhibits "A" and "B".
Section 2. The City Manager is hereby authorized to cause written notice ofthe passage
of this Resolution to be served upon the owners and persons in possession or having an
interest of record in the above-described property. This notice shall be served according to
law.
Section 3. This Resolution shall take effect and be in force from and after the earliest
date permitted by law.

Resolutions Nos. 15-05 through 21-05
SUMMARY:
This project requires appropriation of right-of-way and/or temporary construction easements
from seven (7) property owners for the construction of a roundabout at the intersection of Dublin
Road and Brand Road. A drawing of the proposed right-of-way and temporary construction
easements is attached for your review. Resolutions Nos. 15-05 through 21-05 have been
submitted to Council for approval of Dublin's intent to appropriate the necessary right-of-way
and temporary construction easements.
RECOMMENDA TION:
Legal Staff recommends approval of Resolutions Nos. 15-05 through 21-05.

Description of Right-of-Way Take for
Dublin-Bellepoint Road on the West
Side of Dublin-Bellepoint Road and
North of Brand Road
Situated in the State of Ohio, County of Franklin, City of Dublin, being part of Virginia
Military Survey Number 2543, and being out of a 4.154 acre tract conveyed to A.E.
Wallace Maurer of record in Official Record 25071, Page 108 (all references to the
records of the Recorder's Office, Franklin County, Ohio unless otherwise specified) and
being more particularly described as follows:
Beginning at the southeasterly comer of said Maurer property and in the centerline of
Dublin-Bellepoint Road;
Thence along the southerly line of said Maurer property, North 88008' 43" West a
distance of 65.06 feet (passing an iron found at 41.97 feet in the existing westerly right
of way of Dublin-Bellepoint Road and the northeasterly comer of a 0.9189 acre tract
conveyed to City of Dublin of record in Instrument Number 200407150164764) to an
iron pipe set;
Thence crossing through said Maurer property, North 10018'33" West a distance of
335.32 feet to an iron pipe set in the existing westerly right of way of Dublin-Bellepoint
Road;
Thence crossing through said Maurer property along the existing westerly right of way of
Dublin-Bellepoint Road, North 15047'07" West a distance of 106.42 feet to an iron pin
set in the northerly line of said Maurer property;
Thence along the northerly line of said Maurer property, South 88012'43" East a distance
of 31.47 feet to the northeasterly corner of said Maurer property and the existing
centerline of Dublin-Bellepoint Road;
Thence along the existing centerline of Dublin-Bellepoint Road and the easterly line of
said Maurer property, South 15047'07" East a distance of 450.42 feet to the Point of
Beginning and containing 0.437 acres, more or less.
Of the above described area 0.437 acres is contained within Franklin County Auditor's
Parcel 273-000615.
All iron pipes set are % inches inside diameter by 30 inches with a cap stamped "DLZ
OHIO" and will be set after construction is completed.
The bearings are based on the Ohio State Plane Coordinate System, South Zone, North
American Datum of 1983 from GPS field measurements made from Franklin County
Monuments "McNeal", "Frank 72", and "Frank 73".
The above description was prepared in February 2005 by Robert A. Bosworth,
Professional Surveyor 7750 and is based on a field survey made in September 2003 by
DLZ Ohio, Inc., Columbus, Ohio under the direction of said surveyor.
A drawing of the above description known as Exhibit "B" is attached hereto and made
part thereof.

Beginning for reference at the southeasterly corner of said Maurer property and in the

Thence along the southerly line of said Maurer property, North 88008'43" West a
