A RESOLUTION OF INTENT TO APPROPRIATE A 0.024
ACRE, MORE OR LESS, FEE SIMPLE INTEREST, FROM
PATRICIA S. BARRY, LOCATED EAST OF DUBLIN ROAD,
CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to construct a roundabout at the
intersection of Dublin Road and Brand Road; and
WHEREAS, said improvement will require the City of Dublin to obtain a fee simple
interest in and to the premises described in the attached Exhibit "A" located in the
City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin,
State of Ohio, '7 of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to appropriate,
for the purpose of constructing a roundabout at the intersection of Dublin Road and
Brand Road, a fee simple interest in and to the premises located in the City of
Dublin, Ohio, and more fully described in the legal description attached hereto as
Exhibit "A".
Section 2. The City Manager is hereby authorized to cause written notice of the
passage of this Resolution to be served upon the owners and persons in possession or
having an interest of record in the above-described property. This notice shall be
served according to law.
Section 3. This Resolution shall take effect and be in force from and after the
earliest date permitted by Jaw. A

Description of Right-of-Way Take
for Dublin-Bellepoint Road on the
East side of Dublin-Bellepoint Road
at Brand Road
Situated in the State of Ohio, County of Franklin, City of Dublin, being part of Virginia
Military Survey Number 2543, and being out of Lot 13 of Lancashire Subdivision as
recorded in Plat Book 36, Page 112 as conveyed to Patricia S. Barry of record in
Instrument Number 200112110288684 (all references refer to the records of the
Recorder's Office, Franklin County, Ohio unless otherwise specified) and being more
particularly described as follows:
Beginning at an iron pin found at the southwesterly comer of said Barry property, the
westerly comer of Lot 12 of said Lancashire Subdivision as conveyed to R. Steven and
Joy L. Johnston of record in Official Record 20609, Page C12, and in the existing
easterly right of way of Dublin-Bellepoint Road;
Thence along the existing easterly right of way of Dublin-Bellepoint Road, North
15046'31" West a distance of93.09 feet to an iron pipe set;
Thence crossing through said Barry property, South 33036' 15" East a distance of 59.25
feet to an iron pipe set;
Thence crossing through said Barry property, South 15047'07" East a distance of 24.51
feet to an iron pipe set in the southerly line of said Barry property and the northerly line
of said Johnston property;
Thence along the southerly line of said Barry property and the northerly line of said
Johnston property, South 40021 '08" West a distance of21.85 feet to the Point of
Beginning and containing 0.024 acres, more or less.
Of the above described area 0.024 acres is contained within Franklin County Auditor's
Parcel 273-000607.
All iron pipes set are % inches inside diameter by 30 inches with a cap stamped "DLZ
OHIO" and will be set after construction is completed.
The bearings are based on the Ohio State Plane Coordinate System, South Zone, North
American Datum of 1983 from GPS field measurements made from Franklin County
Monuments "McNeal", "Frank 72", and "Frank 73".
The above description was prepared in February 2005 by Robert A. Bosworth,
Professional Surveyor 7750 and is based on a field survey made in September 2003 by
DLZ Ohio, Inc., Columbus, Ohio under the direction of said surveyor.
A drawing of the above description known as Exhibit "B" is attached hereto and made
part thereof.
Grantor claims title by Instrument of record in Instrument Number 200112110288684 of
the Recorder's Office, Franklin County, Ohio.

Resolutions Nos. 15-05 through 21-05
SUMMARY:
This project requires appropriation of right-of-way and/or temporary construction easements
from seven (7) property owners for the construction of a roundabout at the intersection of Dublin
Road and Brand Road. A drawing of the proposed right-of-way and temporary construction
easements is attached for your review. Resolutions Nos. 15-05 through 21-05 have been
submitted to Council for approval of Dublin's intent to appropriate the necessary right-of-way
and temporary construction easements.
RECOMMENDATION:
Legal Staff recommends approval of Resolutions Nos. 15-05 through 21-05.
