A RESOLUTION AUTHORIZING THE PETITION FOR
ANNEXATION OF 2.754 ACRES, MORE OR LESS, LOCATED ON
HYLAND-CROY ROAD, BETWEEN BROCK AND MCKITRICK
ROADS, WHICH WAS FORMERLY OWNED BY TODD AND APRIL
KING AND PURCHASED BY THE CITY, LOCATED IN JEROME
TOWNSHIP, UNION COUNTY, TO THE CITY OF DUBLIN.
WHEREAS, the City of Dublin has determined that there is the necessity to annex the parcel
of land located on Hyland-Croy Road, between Brock and McKitrick Roads, consisting of
2.754 acres, more or less, into the City; and
WHEREAS, the subject property, as depicted in Exhibit "A" and described in Exhibit "B", is
comprised of a parcel of land which was formerly owned by Todd and April King, and was
purchased and is now owned by the City; and
WHEREAS, the subject property is the site where the proposed Tartan West water tower will
be located; and
WHEREAS, the annexation of the subject property must be initiated by petition to the Union
County Board of Commissioners pursuant to Ohio Revised Code Chapter 709; and
WHEREAS, the City will follow the method of annexation for "municipally-owned territory,"
pursuant to O.R.e. 9709.16, which provides the most accelerated process to gain acceptance of
an annexation petition when the municipality owns the land; and
WHEREAS, Ohio law mandates that the landowner of the subject property must sign the
annexation petition, thereby requiring an authorized City official to sign the petition; and
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of
Ohio, -"'-- ofthe elected members concurring that:
Section 1. Council considers it necessary to annex the subject property to the City of
Dublin in order to construct a water tower on the land which will service the City residents.
Section 2. Council authorizes the City Manager to sign, and the City Law Director to file, a
petition on behalf of the City for the annexation of 2.754 acres, more or less, located on
Hyland-Croy Road, between Brock and McKitrick Roads, pursuant to O.R.C. 9709.16.
Section 3. This Resolution shall take effect and be in force from and after the earliest
date permitted by law.

RE: Resolution 14-05 (Authorizing Annexation of Hyland-Croy parcel)
SUMMARY:
The City of Dublin purchased a 2.754 acre, more or less, parcel ("subject parcel") from Todd and
April King on March 3, 2005. The subject parcel is located on Hyland-Croy Road, Jerome
Township, Union County, and is listed as Parcel J.D. No. 17-0014031.000 on the Union County
Auditor's web site. Dublin purchased the subject parcel with the intention of annexing the land
into the City. The subject parcel will be the site of the Tartan West water tower.
The attached resolution will authorize the City Manager to sign the annexation petition and the
Law Department to file the annexation petition with the Union County Commissioners. The City
Manager has instructed the Law Department to follow the method of annexation for
"municipally-owned territory," pursuant to a.R.c. 9709.16. The annexation will take effect
within thirty days after the petition is filed with the Union County Commissioners. Under the
"municipally-owned territory" method, the subject parcel will not come into Washington
Township.
RECOMMENDATION:

1. The Annexation of Lands in Jerome Township to the City of Dublin
2. The Situate
Being 2.7 Acres, (Parcel Number 17-0014031.000; Map Number
126-00-00-068.000), part of Virginia Military Survey # 2991,
and part of the 2.754 Acres conveyed to the City of Dublin, Ohio of
record in Official Record 597, Page 445, Recorder's Office, Union
County, Ohio, in Jerome Township, Union County, Ohio.
3. The Description
A. The Perimeter Legal Description
Commencing at the centerline intersection of Brock Road and Hyland - Croy Road;
Thence, southerly, along the centerline of Hyland - Croy Road, 1754.15 feet to the
northwest comer of a 2.754 Acre tract owned by The City of Dublin (#17-0014031.000)
and the southwest comer of a 1.262 Acre tract owned by Edward R. II and Tara M.
Kunzelman;
Thence, easterly, along the north line of said 2.754 Acre tract and the south line of said
1.262 Acre tract, approximately 25 feet to the True Point of Beginning of the parcel
herein intended to be described;
Thence, easterly, along the north line of said 2.754 Acre tract and the south line of said
1.262 Acre tract, approximately 475 feet to the southeast comer of said 1.262 Acre tract;
Thence, northerly, along a west line of said 2.754 Acre tract and the east line of said
1.262 Acre tract, approximately 110 feet to the northeast comer of said 1.262 Acre tract
and in the south line of the 5.445 Acre tract owned by Ian Mooney Paul, Mami Spears
and Shannon Spears Della Port;
Thence, easterly, along the north line of said 2.754 Acre tract and the south line of said
5.445 Acre tract, approximately 354 feet to the northeast comer of said 2.754 Acre tract,
the southeast comer of said 5.445 Acre tract and in the west line of the 33.281 Acre tract
owned by Robert E. and Shirley Lee Gates and in the existing City of Dublin Corporation
Line annexed by Ordinance Number 71-02;
Thence, southerly, along the east line of said 2.754 Acre tract and the west line of said
33.281 Acre tract and along said Corporation Line, approximately 278 feet to the
southeast comer of said 2.754 Acre tract, the southwest comer of said 33.281 Acre tract
and in the north line of a 27.216 Acre tract owned by Anna James;
Thence, westerly, along the south line of said 2.754 Acre tract and the north line of said
27.216 Acre tract and continuing along said Corporation Line, approximately 355 feet to
the southeast comer of the 1.435 Acre tract owned by Alan E. and Eileen T. Traux;
Thence, northerly, along a west line of said 2.754 Acre tract and the east line of said
1.435 Acre tract, approximately 125 feet to the northeast comer of said 1.435 Acre tract;
Thence, westerly, along the south line of said 2.754 Acre tract and the north line of said
