TO LEVY SPECIAL ASSESSMENTS FOR THE CONSTRUCTION OF
A STORM SEWER AND DRAINAGE DITCH IN MONTEREY DRIVE
AND DECLARING AN EMERGENCY
BE IT ORDAINED by the Council of the Village of Dublin, in the County of
Franklin, State of Ohio:
Section 1. That the revised assessment of the cost and expenses of the
construction of a storm sewer and drainage ditch in Monterey Drive, amounting
in the aggregate to $3,215.22 as reported to this Council on the It day
of :.~: ., ~:i r~, , 196 S , by the Consulting Engineer and now on file in
the office of the Clerk, be and the same is hereby adopted and confirmed and
that there be and are hereby levied and assessed upon Lots 3, 4, and 6 to 13,
inclusive, of Dublin Heights Subdivision in the Village of Dublin, the several
amounts reported as aforesaid, which assessments are by the front foot and are
not in excess of any statutory limitation.
Section 2. That this Council hereby finds and determines that the re-
vised assessments as now on file in the office of said Clerk are in the same
proportion to the estimated assessments as originally filed as the actual cost
of the above described improvement is to the estimated cost of the improvement
as originally filed.
Section 3. That the assessment against each lot or parcel of land shall
be payable in cash within thirty (30) days after the passage of this ordinance
or at the option of the owner in five (5) annual installments with interest
at the same rate as shall be borne by the notes issued in anticipation of the
collection of same. All cash payments shall be made to the Treasurer of this
Village. All assessments and installments thereof remaining unpaid at the ex-
piration of said thirty (30) days shall be certified by the Clerk to the
County Auditor as provided by law to be placed by him on the tax duplicate
and collected as other taxes are collected.
Section 4. That the Clerk shall cause a notice of the passage of this
ordinance to be published once in a newspaper of general circulation in this
Village and to continue on file in his office said revised assessments.
Section 5. The Clerk is hereby directed to deliver a certified copy
of this ordinance to the County Auditor within twenty (20) days after its
passage.
Section 6. This ordinance is hereby declared to be an emergency measure
the immediate passage of which is necessary to protect the public health,
welfare and safety and for the reason that assessments must be certified for
collection at the earliest date to provide funds for debt service on notes
when due. This ordinance, therefore, shall go into immediate effect upon
its passage and approval by the Mayor.
