HomeMy WebLinkAbout04-68 Ordinance 04 - 6 8 ORDINANCE NO C'1,-,-.E AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF MONTEREY DRIVE FROM BRIDGE STREET SOUTH TO THE END OF MONTEREY DRIVE BY CONSTRUCTING A STORM SEWER FROM BRIDGE STREET SOUTH APPROXIMATELY 200 FEET AND A DRAINAGE DITCH j FROM SAID STORM SEWER TO THE END OF MONTEREY DRIVE, AND TO DECLARE AN EMERGENCY WHEREAS, this Council did duly adopt Resolution No. 03-67, on the 20th day of February, 1967, declaring therein the necessity of the proposed improvement hereinafter described; and WHEREAS, objections were filed against the estimated assessments for said improvement and said assessments have been duly considered by the Board appoint- ed to equalize said estimated assessments and the report of said Board has been approved by Resolution No. 0.. - 6 Bof. this Council: NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, County of Franklin, State of Ohio: Section 1. That it is hereby determined to proceed with the improvement of Monterey Drive from Bridge Street south to the end of Monterey Drive by constructing a storm sewer from Bridge Street south approximately 200 feet and a drainage ditch from said storm sewer to the end of Monterey Drive, in accordance with the provisions of said Resolution No. 03-67, and in accordance with the plans, profiles, specifications and estimate of cost for said improvement heretofore approved and filed in the office of the Clerk. Section 2. That the estimated assessments of the cost of said improvement heretofore prepared and filed in the office of said Clerk, and as equalized by the Board heretofore appointed for such purpose, the report of which Board was approved as afore- said, be and the same are hereby adopted. Section 3. That it is further determined that the portion of the cost of said improvement to be assessed against benefitted property shall be assessed in the amount, manner and number of installments as provided for in said resolution de- claring the necessity of said improvement. Section 4. That all claims for damages resulting from said improvement that have been filed in accordance with law shall be inquired into before the commence- ment of said improvement. Section 5. That the Mayor is hereby authorized and directed to advertise for bids for the construction of said improvement in the manner provided by law, and subject to the provisions of RC 727.24 and the availability of funds, to enter into a contract for said improvement with the lowest and best bidder. Section 6. The Clerk of this Council is hereby directed to deliver a certified copy of this Ordinance to the County Auditor within fifteen days after its passage. Section 7. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of said Vlld../:K<:-~ for the reason that said improvement is immediately necessary to provide storm drainage for the benefitted property in the Village of Dublin by constructing a storm sewer and drainage ditch, and therefore this ordinance shall be in full force and effect from and after its passage.
