ORDINANCE NO. D '3 -~ 7 VILLA GE OF DUBLIN, OHIO
AN ORDINANCE PROHIBITING ABANDONMENT OF
VEHICLES; RESTRICTING DISPOSITION OR KEEP-
ING OF WRECKED, NON-OPERATING OR DISCARD-
ED VEffiCLES ON STREETS OR PRIVATE PROPERTY

WHEREA S, in the Village of Dublin vehicles are or may in the
future be abandoned in the streets or other places within the Village; and
WHEREAS, there are or may in the future be dismantled,
partially dismantled, wrecked, junked, non-operating or discarded
vehicles left about the Village other than in junk yards or other appro-
priate places; and
WHEREAS, such condit ions tend to impede traffic in the streets
or interfere with the enjoyment of or reduce the value of private property;
invite plundering; create fire hazards and other safety and health hazards I
to children as well as adults; interfere with the comfort and well- being of
the public; and create, extend, and aggravate blighted conditions; and

WHEREAS, adequate protection of the public health, safety and
welfare requires that such conditions be regulated, abated or prohibited;
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF

THE VILLAGE OF DUBLIN, STATE OF OHIO, of the

r SECTION 1. That it is here by declared to be and is
, a nuis ance for any person within the meaning of this
Ordinance to harbor and keep outside of a building or
buildings, a motor vehicle or vehicles in a dilapidated
condition as hereinafter defined which encourages and
creates hazardous conditions.
SECTION 2. The following definitions shall apply
in the interpretation and enforcement of this ordinance:
1. "Person" shall mean any person, firm,
partnership, association, corporation, com-
pany' or organization of any kind.
2. "Ve hic Ie" shall mean a machine propelled
by power other than human power designed to
travel along the ground by use of wheels or
I~ treads, and transport persons or property or

pull machinery and s hall include, without limi-
~I tation, automobiles, trucks, trailers, buses,
motorcycles, and tractors.
3. "Street or highway" shall mean tl'E entire width
between the boundary lines of every way publicly
maintained when any part thereof is open to the use
of the public for purposes of vehicular travel.

4.. "Property" shall me an any real property
within the Village which is not a street or
highway.
SECTION 3. No person shall leave any partially dis-
( ... mantled, non-operating, wrecked, or junked vehicle on
I any street, or highway within the Village without first
t..:' obtaining the consent of the owner of said property, or
the person in charge or control of said property.
SECTION 4. No person in charge or control of any
property within the Village of Dublin, whether as owner,
tenant, occupant, lessee, or otherw ise, s hall allow any
partially dismantled, non-operating, wrecked, junked,
or abandoned vehicle to remain on such property longer
than twenty-one (21) days after the receipt of written notice
from the Chief of Police, or any member of his department
designated by him, to remove said vehicle from such pro-
perty; except that this section shall not apply with regard to a
vehicle in an enclosed building.:.
SECTION 5. The Chief of Police or any member of his
department designated by him is hereby authorized to
remove or have removed any vehicle left at any place
within the Village which is in violation of this Ordinance.
Such vehicle shall be impounded until lawfully claimed or
disposed of in accordance with Chapter 737 of the Revised
~ Code of Ohio.
. SE CTION 6. Whoever violates the provis ions of this
r Ordinance shall be fined not more than Fifty ($50.00)
Dollars, and shall pay the cost of the prosecution. Each
day such violation is committed or permitted to continue
shall constitute a separate offense and shall be punishable
under this Ordinance.
SECTION 7. That this Ordinance be and the same hereby
is declared to be an emergency measure necessary for the
immediate preservation of the public safety, peace and general
welfare because the conditions with which this ordinance deals
presently exist within the Village and pose an immediate
threat of fire and of injury to children, and that this Ordinance
shall take effect immediately upon its passage.
