ORT:G~N1\~~lt1!!I:Y-!>'B-B...- . >. v.z~a=~CJ;IAN~r.E*FB;:~A~iIL , , I "" - OEe 4 1978 ORDINANCE NO. 81-78 TO AMEND THE ZONING ORDINANCE, ORDINANCE NUMBER 21-70, TO PROVIDE FOR ADDITIONAL SPECIAL ZONING DISTRICT OF SAWMILL-16l QUADRANT. ,fl WHEREAS, the Council of the Village of Dublin has t_~ determined that it is necessary to provide for a specific zoning district and specific zoning regulations for that portion of the Village of Dublin, Ohio, bounded by 1-270 on the north, Sawmill Road on the east, Martin Road on the south, and the Scioto River on the west, and hereafter designated as the Corridor Development District, and WHEREAS, the said Council of the Village of Dublin has determined that it is in the best interests of the public health, safety and welfare of the inhabitants of the said Village of Dublin that further development in the Corridor Development District proceed in an orderly fashion, NQW, n THEREFORE, ~ I \ I BE IT ORDAINED BY THE ~OUNCIL OF THE VILLAGE OF DUBLIN, OHIO: SECTION 1. That the Official Zoning Map. as contained in Ordinance No. 21-70, the Zoning Ordinance, is amended to illustrate the area bounded by 1-270 on the north, Sawmill Road on the east, Martin Road on the south, and the Scioto River on the west, as an overlay zoning district hereafter designated as CDD. SECTION 2. That Ordinance No. 21-70, Article II, Section 201.01 is amended to read as follows under the title, Sp'e'ci'al Districts: (". That Ordinance No. 21-70, Article VI is amended to include new Section 650, Corridor Development District (CDD) to read as follows: '1 \J SECTION 650 CORRIDOR DEVELOPMENT DISTRICT (CDD) 650.02 PURPOSE. The purpose of ,the Corridor Development is to provide overlay requirements to ensure that existing and anticipated corridor land uses and traffic improvements within the district will be developed in a manner that protects the health and safety of residents of Dublin and maintains the image of Dublin as a quality community.. The importance of maintaining traffic flow and accessibility so as to encourage compatible I , land uses and to protect property values requires that special I emphasis on traffic planni~g and frontage treatment through the use of a', special district be achieved. 650.03 JURISDICTIONAL BOUNDARIES. The Corridor Development I} District (CDD) shall be bounded by Sawmill Road on the east, \.; Martin Road on the south, the Scioto River on the west and 1-270 on the north. 650.04 PERMITTED AND CONDiTIONAL USES. Permitted and conditional uses shall be consistent with the provisions of the Dublin Zoning Ordinance No. 21-70 and the use districts as determined by the official zoning map and are not materially affected by section 650 provided that any non-residential use within the Corridor Development District shall conform to Section 650. 650.041 Exception. Residential uses are exempted from con- formance with this section of the zoning ,code. () 650.05 DEVELOPMENT STANDARDS. Page Three 650.051 Lot Requirements. (1) Minimum yard requirements: As otherwise listed in Ordinance 21-70 except that in all cases, buildi~gs shall {1 be a minimum of twenty (20) feet from all side and rear property '....J lines. All pavement areas shall be a minimum of fifteen (15) feet from all side and rear property lines. (2) Maximum lot coverage: Structures, pedestrian areas, I parki~g areas and other hard-surfaced or paved areas shall not I cover more than 85% of the lot. 650.052 Site Requirements. The application and development' plan shall show the following: I ! (1) Structures: All proposed structures shall be i located, showing square footages, tenant types, and expected entrance, service and pedestrian-areas for the first phase of the development plan. Structures planned for subsequent phases n shall be schematically indicated. I I (2) Traffic concept: ,All points of ingress 'and egress I '-J . . I onto public roadways and the overall traffic distribution scheme shall be shown, indicating traffic flow patterns and traffic control points. The criteria that must be followed includes: (a) combined curbcuts, especially for any uses tha I are incorporated in a commercial center, I (b) minimization of conflict points between auto traffic and pedestrian traffic to include adequate design and demarcation of pedestrian walkways from parki~g or driveway areas (c) service traffic separation ,from customer or commuter traffic, f't, (d) frontage service drives or other such improve- 'i~ ments may be required by the Planning and Zoning Commission if . '-'" (3) The proposed use of all parts of the lot and structures, including accessways, walks, off-street parking and loading spaces, lighting and signage location(s), screening, landscaping treatment and other such information required to demonstrate the development standards. (4) All reserve parcels and anticipated development phases. (5) The use of land and location of structures on adjacent property. 650.064 Planning & Zoning Commission Review. The Planning & Zoning Commission shall review the plan as to whether the n following three conditions are met: I I (1) The proposed use(s) , are permitted use(s) .., as so specified by the zoning in force for the subject land. , (2) The proposed development is in accord with the I Sawmill 161 Quadrant Plan and other appropriate plans for the i area. j I (3) The proposed development will be in keeping with the existing and/or proposed land use character and the physical development potential of the area. 650.065 Planning and Zoning Commission Action. The Planning and Zoning Commission shall make recommendations, within thirty I (30) days, approving, disapproving, or approving with modifica- tion(s), the plan and accompanying documents. Such modification () may be a limitation on the extent or intensity of development, I '-J a requirement for additional screening by fence or landscaping, a change in the method or plan for lighting, control of access I or other conditions of development as may be required. Each applicant shall be notified of the reason for disapproval or modification along with the decision of Planning and Zoning notifying them of such action. I I 650.067 If the application is approved, or approved with modifications, and the recoi:nrn:ended modifications are completed within fourteen (14) days, ~certificate of zoning compliance shall be issued. I 650.07 Appeal. I I 650.071 Any applicant whose application herein is not approved I (matters delete~ or any applicant whose application herein is approved subject to modifications in accordance with Section I I ;; , 650.065 herein, may appeal to the denial of the certificate of I ~ zoning compliance to the Board of Zoning Appeals of this ; Village, in accordance with the provisions of Article VIII, Section 805 of this Ordinance.
