AN ORDINANCE AMENDING THE
CODE OF ORDINANCES OF THE
VILLAGE OF DUBLIN
Be it ORDAINED by the Council of the Village of Dublin, Ohio
to of the elected members concurring, that:
SECTION 1. The Code of Ordinances of the Village of Dublin, Ohio be,
and it is hereby, amended by adding Section 73.19 as follows:
"73.19 - ABANDONED MOTOR VEHICLES
(A) No person, except as exempted in Division (B), shall
purposely leave an abandoned junk motor vehicle as defined
in Division (B), on private property for more than seventy-
0 two hours, or on a public street or other property open to
the public for purposes of vehicular travel or parking or
upon or within the right of way of any road or highway, for
forty-eight hours or longer.
(B) Any motor vehicle abandoned in the manner provided herein
is hereby declared to be a public nuisance by reason of its
abandonment causing a deteriorating and blighting influence
on nearby properties and by reason of its depreciating the
enjoyment and use of the properties in the immediate vicinity
to such an extent that it is harmful to the public health,
welfare and safety of the conmruni ty in which such abandoned
motor vehicle is located, and shall be abated.
An abandoned motor vehicle is defined as any motor vehicle
meeting all of the following requirements:
(1) Left on private property for more than seventy-two
hours other than in an enclosed garage, on a public street
or other property open to the public for the purpose of
vehicular travel or parking, or upon or within the right
of way of any road or highway, for forty-eight hours or
longer;
(2) Three years old or older;
r (3) Extensively damaged, such damage including but not
limited to any of the following: a broken window or
J windshield, missing wheels, tires, motors, or transmission;
(4) Apparently inoperable;
(5) Having a fair market value of one hundred dollars or
less. ,
A wrecked vehicle being held for repair at an automobile
service garage or body shop shall be exempt from the pro-
vision of this section.

(C) Whenever the Chief of Police or his authorized repre-
sentative finds, upon investigation, that a motor vehicle
has been abandoned as defined herein, he shall cause written I
notice by certified mail to be served upon the owner, or the .
lessee, agent, or tenant, having the right to possession of
such real property on which the abandoned vehicle is located 1
that the abandoned motor vehicle must be removed within seventy-
two hours after the service of such notice. If such owner
or other person having the right to possession of such real ii
property is a non-resident whose address is knO\vn, such service !I
shall be sent to his address by certified mail. I,

(D) Upon failure of any owner, lessee, agent, or tenant having ;~
0 charge of the lots and lands referred to in Division (C) to ~
comply with the notice of removal within the period of time
stip~lated, the Chief of Police shall cause such abandoned I
vehicle to be removed by the direct employment of labor or
authorize some person to remove the abandoned vehicle on behalf
of the Village.

The Chief of Police shall order any abandoned jlIDk motor vehicle to
be photographed by a law enforcement officer in the place where
abandoned. The officer shall record the make of motor vehicle,
the serial number when available, arid shall also detail the
damage or missing equipment to substantiate the value of one I

hlIDdred dollars or less. The Chief of Police shall thereupon
innnediately dispose of the abandoned jlIDk motor vehicle to a jlIDk
yard or scrap metal processing facility as defined in Section
4737.05 of the Ohio Revised Code, or to any other facility owned
by or lIDder contract with the Village for the disposal of such :
motor vehicles. The records and photograph relating to the aban- ~
doned jlIDk motor vehicle shall be retained by the Chief of Police i
after the disposition of such vehicle for a period of at least \
two years. Such officer shall execute, in quadruplicate, an ~

affidavit as prescribed by the registrar of motor vehicles, des- ..
cribing the motor vehicle and the manner in which it was disposed I
of, and that all requirements of this section have been complied
n with, and he shall sign and file the same with the Clerk of Courts
of Franklin COlIDty. Any monies arising from the disposal of an
\.J abandoned jlIDk motor vehicle shall be deposited in the general flIDd
of the Village of Dublin.
(E) Whoever violated Division (A) of this section is guilty of ~
abandoning motor vehicles, a minor misdemeanor, and in addition to
any other penalty, shall be assessed any costs incurred by the
Village of Dublin in disposing of such abandoned jlIDk motor vehicle,'

the earliest period allowed by law.
