AN ORDINANCE DETERMINING TO PROCEED
'vII T H THE IMPROVING OF CERTAIN STREETS
IN RIVER FOREST SUBDIVISION BY THE
~ CONSTRUCTION OF WATERLINES AND APP-
URTENANCES, AND DECLARING AN EMERGENCY.
BE IT ORDAINED by the Council of the Vi I lage of Dubl i~, Franklin
and Delaware Counties, State of Ohio:
SECTION I . That it is hereby determined to proceed with the Imp-
roving of certain streets in the River Forest Subdivision by the
construction of water I ines and appurtenances in the publ ic
streets and right of ways and easements as fully described In
Resolution #35-76, passed on Ju I y 6, 1976 declaring the necessity
of constructing said system.
SECTION 2. That said improvement shal I be made in accordance with
the provisions of said Resolution #35-76 and with the plans, spe-
cifications, estimates and profi les heretofore approved and now
on fi Ie in the office of the Vi Ilage Clerk.
SECTION 3. That a I I claims for damages resulting therefrom that
have been legally fi led, sha II be inquired after completion of the
~ proposed improvement, and the Sol icitor is hereby authorized and
directed to i nst itute legal proceedings in a court of competent
jurisdiction to InquIre into claims that have been so filed.
SECTION 4. That portion of the cost provided in the above-men-
~ tioned resolution of necessity to be assessed shal I be assessed In
the manner and the number of installments provided In said reso~
lution and on the lots and lands described therein.
f . SECTION 5. That the estimated assessments heretofore prepared
and fi led in the office of the Vii lage Clerk and as equalized by
, the board heretofore appointed for such purpose by Resolution
#48-76 adopted on September 20, 1976, the report of which board
, was approved by Resolution # ~-7~ adopted October 4, 1976, be
, and the same hereby are adopted.

~ SECTION 6. The Vi I lage Clerk is hereby directed to del iver a
~ certified copy of this Ordinance to the County Auditor within
i fifteen days after its passage.
SECTION 7. Subject to the provisions of RC 727.24, the V i II age
Asm i n i strator is hereby authorized and directed as soon as the
n funds therefore are avai lable to make and execute a contract for
said improvement with the lowest and best bidder after advertising
W according to law and the improvement shal I be financed as provided
in the resolution of necessity.
SECTION 8. This Ordinance is hereby declared to be an emergency
measure necessary for the immediate preservation of the publ ic
peace, health and safety of said Vii lage and for the further rea-
son that the immediate construction of said improvement IS nec-
essary to provide a potable water source and protect the health
