AN ORDINANCE AMENDING ORDINANCE NO. 21-70 (AS AMENDED) BY AMENDING SECTIONS 450.04, 450,062, 450,081, 450,082, 450,083, 450,085, Be it ORDAINED by the Council of the Village of Dubl in, Ohio GP of the elected members concurring, that: SECTION 1, Ordinance No. 21-70 (As Amended) be, and it is, hereby, amended so that Sections 450,062, 450,081, 450,082, 450,083, and 450.085 read as follows: "Section 450,04 GENERAL PROCEDURES, Procedures and conditions set forth for determination of Planned Unit Development Districts and development therein shall be strictly followed except when the Commission and Council have approved a written State- ment by the applicant clearly showing that such pro- cedures or conditions do not apply in the specific case, accompanies the appl ication, [The last sentence is omitted] ,II "Section 450,081, The concept plan together with an appl ication shall be filed with the Village Administra- tor. [Omit sentence 2.] Within three (3) days after the submittal, the Concept Plan and application shall be forwarded to individual members of the Commission, members of the Council who do not also serve on the Commission, the Village Clerk, Village Solicitor, Vil- lage Engineer, and the Consulting Planner for a report on whether or not the submittal contains the items re- quired by Section 450.061.11 IISection 450,082, Following the submittal of the Con- cept Plan and appl ication, the Commission shall have not less than thirty (30) days nor more than 90 days in which to submit its report of recommendations to the Council, Said recommendation may be for approval, denial, or approval with suggested modifications. Within sixty (60) days of the receipt of the report or recommendations from the Commission or as soon there- after as practicable, the Council shall approve, deny or approve with modifications, the Concept Plan, Ap- proval of the Concept Plan shall be authorization to prepare and submit a Preliminary Development Plan. The approval or approval with modifications, either by the Commission or the Council, shall be of no binding effect and shall in no wise vest any rights in the ap- pI icant or effect a zoning of the land.11 IISection 450,083, Within one hundred and eighty (180) days of notice of approval of the Concept Plan, the appl icant may submit a Prel iminary Development Plan for approval, Failure to submit a Prel iminary Development Plan within one hundred and eighty (180) days shall in- validate any prior approval or fee payments.
