AN ORDINANCE AOOPTING A FIRE PREVENI'ION CODE

I WHEREAS, the,Village of Dublin, Ohio lies within the territorial limits of

! Townships of Washington, Perry, Concord" in Counties of Franklin" Delaware,

State of Ohio, and, I
WHEREAS, fire protection for the Vill,age of Dublin and the residents and

inhabitants thereof is provided by the Washington-Perry T~wnships Fire Depart-
ment, there being no Municipal Fire Department in the Village, and I

l~ffiREAS, it is desirable to enact a Fire Prevention Code and other codes,

for the purpose of' ref erence, and, to members of the Washington-Perry Townships
Fire Department insofar as may ~e possible, and

l~REAS, it is the intent and purpose 'of this ordinance to adopt measures
necessary for ,the preservation of theh~alth, safety, arn:l: welfare of,the

as the Fire Prevention Code recommended by the American Insurance
Association, being particularly those editions in effect on date
of the adoption of this ordinance, and that certain codes known
as Ohio Fire Code, Ohio Building, R~f: Ohio Revised Code, being U
particularly the current edition,' and the who.le thereof, save 'and
except such portions as are hereinafter delete4, modified or amended
by ordinance, and the same are hereby adopted and incorporated as
fully as if set out at length herein and from the date on which this
ordinance shall take effect, the provisions thereof shall be controlling
\vithin the limits of the Village of Dublin, Ohio. '
35.23 ENFORCEMENT OF CODE
The Fire'Prevention Code shall be enforced by the Chief of the
Washington-Perry Townships Fire Department or his duly appointed
Fire Marshall and:by the Bureau of Fire Prevention in said Fire
Department if there be such Bureau or the same be herein after
established; the Chief of said Fire Department or the Chief of
said Bureau of said Fire Prevention or the duly appointed Fire
Marshall, if there be such Bureau, shall have and is hereby
granted full authority to perfonn any of the duties or acts
which are required or authorized to be perfonned by said Fire
Department Chief or Chief of the Bureau of Fire Prevention in
the Fire Prevention Code.
35.24 DEFINITIONS
Wherever the word "Municipality" is used in the Fire Prevention U
Code, it sh,all be held ,to mean the Village of Dublin, Ohio. Where-
ever the tenn "Corporation Counsel" is used in the Fire Prevention
Code, it shall be held to mean the Village Solicitor of Lmv of the
Village of Dublin, Ohio.
35.25 MODIFICATION.
The Village Solicitor upon recommendation of the Fire Chief of
Washington-Perry TO\mships, shall have pO\...er to modify any of the
provisions of the Fire Prevention Code upon application in \v.titing
by the owner or lessee, or his duly authorized agent, \...hen there
are practical difficulties in 'the \~y of carrying out tIle strict
letter of, the Code, provided that the spirit of the Code shall be
observed, public safety secured, and substantial justice done,
35.26 APPEALS
Whenever the Chief of, the Fire Department shall disapprove' an
application or refuse to grant' a penni t applied for, or where
it is claimed that the p~ovisions of the Code do not apply or
that the true intent and meaning of the Code have been miscon-
structed or wrongly interpreted or if the o\v.ner, lessee, agent,
operator, or OC.Cllpant is aggrieved by an order of an' officer,
the applicant or recipiant of an order may appeal from the
decision of the Chief of the Fire Department or Officer to the --..
Village Solicitor of the Village of Dublin, Ohio, \vithin two (2) U
days from the date of the decision appealed or the service of
the order, and the Village Solicitor shall at once investigate
said complaint and fix a place and time not less than three (3)
days nor more than five (5) days thereafter for hearing such I
complaint.
The Village Solicitor at said hearing may affinn, modify, revoke,
or vacate said order, and or application and,unless such order or

35.32, SAVING CLAUSE ' . ' . '

The invalidity of any section or provision of the .Fire, ,Prevention
Code shall not be construed to affect or invalidate, any other ; ,
provision thereof, which other provisions would have been adopted IJ
and such invalidity been known at the time of adoption, it being :
the intention of Council that the several provisions and sections '
of the Code shall be' separab~e one from the other.

The fees, as received by the Village Administrator unde~ this Gode,
shall be remitted quarterly to the Fire Prevention Officer. The' ,
Fire Prevention Officer shall use such fees for enforcement of IJ'
this Code, for education and exp 1 ana tion of this Code, and for i
such other purposes as may arise in connection with this C~e. . '
The'Fire Prevention Officer shall report quarterly to the V11lage
Council regarding receipts and expenditures made under this code.

35.34 LIQUEFIED PETROLEUM GASES
The Fire Prevention Code is amended and changed 'in ,the following I
--'. respects Article 21 iSaniended, to read as follows :.
U All L.P.G, installations shall meet the minimum requirements set
forth in the latest current edition N.F.P.A. pamphlet No. 58 and'
other related pamphlets and codes and by local requirements set,
forth by the' CJ:lief of. the, Washi.ngton-Perry !owI~hip Hire Department,.
The following local requirements shall be met and' confonned to:

1. . All L.P.G. tanks shall be approved by either A~S.M.E.' (American
SocietY of Mechanical Engineers), D.O. T. (Department of Transportation),
or B. T .G. (Board of Transit Commissioner for Canada). It will not be
necessary for the Fire Prevention Bureau to witness air tests on
these tanks. " '1 ., , .
2. Tank(s} in' excess of, 500 gallons 'aggregate w/c, ,where, the
L.P.G. is'removed.,as a gas, shall be installed \'lith bvo' (2) ,

3. To aid in preventing L.P~G., leaks; at the tank, piping and

footer 7 inch minimum in circtunference. Posts. to be spaced at a
maximum distance of 60 ,inches apart. Posts are .to be a maximum of

there shall be a letter from the company installing the system, ,'sub-, I
mitted, to the Chief of the Washington-Perry Townships Fire'Department I
certifying as to confonning to the N.F.P.A. pamphlet No. 58 and loc<l:l

35.35 AUTOMATIC SPRINKLER SYSTEMS

for all commercial, institutional, industrial, or public and private
educational facilities, churches, places, of public , assembly, and garages,
hereafter constructed 'vi thin the limits of the Village of Dublin,.Ohio, !
'vhich are over tl.;o (2) stories or thirty (30) fe~t, inc~uding. above. ~nd
below finish grade construction level, ,overall; height.,.>. Said,automat~c

35.36 PENALTIES I

Whoever shall violate any of the provisions of the Code hereby I
adopted or fail to , comply therewith; or shall violate or,'fai1 ,to comply I
\vi th any order made thereunder, or who shall, build ,in violation, of
any detailed- statement of specifications, or- plans submitted and. ' I
approved thereunder, and from which nq appeal has, been taken, or '
\vho shall' fail to comply \vith, such an,order 'as, affinned or modified,
by the Fire Chief, the Village Solici ~r, or other designated ,
official, or byLa court of. competent jurisdiction, within. the, time, "
fixed herein; shall severally, ,for each and every such violation ,and 1
