' J VILLAGE OF DUBLIN, OHIO ORDINANCE NO. 45 77 AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE IM- PROVEMENT OF CERTAIN STREETS IN RIVER FOREST SUBDIVISION BY THE CONSTRUCTION OF WATERLINES AND APPURTENANCES IN THE VILLAGE OF DUBLIN, OHIO. ~ Be it Ordained by the council of the village of Dublin, State of Ohio: Section 1. That the revised assessment of the cost and,expense of improving certain streets in River Forest Subdivision in the Village of l Dublin, Ohio, by constructing waterlines, services, fire hydrants, and appurtenances in certain streets as follows: Construct a 12 inch waterline on Dublin-Bellpoint Road (SR 745) from the intersection of Ashford Road North to a point 142 feet south of the intersection of River Forest Road; Construct an 8 inch waterline on Ashford Road from the intersection of Dublin-Bellpoint Road (SR 745) west and north to the intersection of Indian Hill Road; Construct an 8 inch waterline on River Forest Road from the intersection of Dublin-Bellpoint Road (SR 745) west and north to the intersection of Indian Hill Road; Construct an 8 inch waterline on Indian Hill Road from the intersection of River Forest Road north and west to a point 447 feet west of the intersection of Ashford road; Construct a 6 inch waterline on Bennett Court from the intersection of Indian Hill Road west a distance of U 380 feet, thence continuing on with a 3 inch waterline for a distance of 120 feet to the end of Bennett Court; amounting in the aggregate to $242,011.07, as reported to this council on the 11th day of July 1977 by the e t.~ of this village and now on file in the office of the clerk of this council, be and the same is hereby adopted and confirmed and that there be and are hereby levied and assessed upon the lots and lands bounding and abutting upon said improvement the several amounts reported as aforesaid, which assessments are in proportion to the special benefits and are not in excess of any statutory limitation. Section 2. That this council hereby finds and determines that the revised assessments as now on file in the office of said clerk are in the same proportion to the estimated assessments as originally filed as the actual cost of the above described improvement is to the estimated cost of the improvement as originally filed. Section 3. That the assessment against each lot or parcel of land shall be payable in cash within thirty (30) days after the passage of this ordinance or at the option of the owner in 20 annual installments with interest at the same rate as shall be borne by the bonds to be issued in anticipation of the collection of the same. All cash payments shall be made to the treasurer of this village. All assessments and installments thereof remaining unpaid at the expiration of said thirty (30) days shall be certified by the clerk of this council to the county auditor as provided by law to be placed by him on the tax duplicate and collected as other taxes are collected. Section 4. That the clerk of this council shall cause a notice of the passage of this ordinance to be published once in a newspaper of general 0 circulation in this village and to continue on file in his office said revised assessments. Section 5. The clerk of this council is hereby directed to deliver a certified copy of this ordinance to the county auditor within twenty (20) days after its passage. I r f ~ l 1 . . ,. ~ . This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety, and for the further reason that the prompt issuance of the bonds is necessary to preserve the credit of the village by retiring the outstanding note issued in anticipation thereof and therefore the levy of assessments provided for herein and the commencement of the cash payment period should be effective at once; wherefore, this ordinance shall be in full force and effect immediately after its passage. FINAL COST CERTIFICATE To the Council of the village of Dublin, Ohio: I hereby certify that based upon actual construction costs U for constructing River Forest waterlines in accordance with your Resolution No. 35-76 adopted July 6, 1976, the aggregate final cost of said improvement including the costs specified in RC ~727.08 and all other necessary expenditures will be in the maxi- mum amount of $242,011.07. The portion of such cost representing not less than one- fiftieth thereof together with the cost of intersections, and the cost of oversizing above eight (8) inches in diameter, allocated to the Village and to be paid from Village funds, and the remainder to be assessed in accordance with said resolution will be as shown on the Assessment Rolls; a copy of which is attached hereto. The estimated assessments filed pursuant to said resolution as equalized have been revised in the same proportion as the aggre- e gate final cost above has decreased from the estimated cost of the ~- ., , improvement as filed prior to the adoption of said resolution and accordingly the revised assessments for this improvement are in the aggregate amount of $223,482.36.
