AN ORDINANCE DETERMINING TO PROCEED WITH THE CONSTRUCTION OF A WATERLINE IN S.R. 161 FROM SAWMILL ROAD TO POST ROAD, IN POST ROAD FROM S.R. 161 TO COFFMAN ROAD, AND IN COFFMAN ROAD NORTH TO THE HIGH SCHOOL, AND IN MONTEREY DRIVE FROM S.R. 161 SOUTH TO THE DEAD END, IN THE VILLAGE OF DUBLIN, OHIO: AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF DUBLIN, STATE OF OHIO,~ OF THE ELECTED MEMBERS THERETO CONCURRING: SECTION I. That it is hereby determined to proceed with the construction in the Vi I lage of Dublin, of the aforesaid water- lines and appurtenances in the publ ic streets and rights-of-way and easements as fully described in Resolution 24-75 passed on May 2, 1975, declaring the necessity of constructing said system. SECTION 2. That said improvement shall be made in accordance with the provisions of said Resolution No: 24-75, and with the plans, specifications, estimates and profi les heretofore approved and now on fi Ie in the office of the Vii lage Clerk. SECTION 3. That al I claims for damages resulting therefrom that have been legally filed shall be inquired after completion of the proposed improvement, and the Sol icitor is hereby authorized and directed to institute legal proceedings in a court of comp- etent jurisdiction to inquire into claims that have been so fi led. SECTION 4. That portion of the cost provided in the above-mentioned Resolution of necessity to be assessed, shall be assessed in the manner and the number of installments provided in said Resolution and on the lots and lands described herein. SECTION 5. That the estimated assessments heretofore prepared and fi led in the office of the Vii lage Clerk and as equalized by the board heretofore appointed for such purpose by Resolution 6-76 adopted on February 2, 1976, the report of which board was app- roved by Resolution No: 1S,7( adopted ,H.<l/f'(1! / , 1976, be and the same are hereby adopted. SECTION 6. The Village Clerk is hereby directed to deliver a certified copy of this Ordinance to the County Auditor within fifteen days after its passage. SECTION 7. Subject to the provisions of O.R.C. 727.24, the Vii lage Administrator is hereby authorized and directed, as soon as the funds therefore are avai lab Ie, to make and execute a con- tract for said improvement with the lowest and best bidder after advertising according to law and the improvement shal I be financed as provided in the Resolution of necessity. SECTION 8.
