AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR
TO ADVERTISE FOR BIDS FOR GARBAGE AND RUBBISH COLLECTING AND
HAULING SERVICE TO THE VILLAGE: AND DECLARING AN EMERGENCY.
WHEREAS, the present contract for garbage and rubbish collecting and
hauling for the Village expires February 28, 1976; and
WHEREAS, there is need for a contract for said services subsequent to
said date:
NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Dublin,
State of Ohio, ~ of the elected members concurring:
SECTION 1. That the Village Administrator be, and he hereby is,
authorized and directed to advertise for bids for garbage and rubbish col-
lecting and haul ing service to the Village of Dublin, Ohio, nr the period
commencing February 29, 1976 and ending June 30, 1978, according to the
following contract specifications:
Garbage and rubbish to be collected froma 1 residences in
the Village of Dubl in, Ohio, on the same specified day of each week. If
a legal holiday falls on said specified day, then the garbage and rubbish
collection may be made on the next day of that week. The term rubbish shall
include all household trash, refuse and other waste matter such as bottles,
tin cans, food, food containers, ashes, cinders, tree and hedge cl ippings,
grass trimmings, leaves and other waste material accumulating about resi-
dential property. The term rubbish does not include waste material accu-
mulated in the construction, remodel ing or repair of buildings. The Con-
tractor shall bid both to remove said garbage and rubbish from where Con-
tractor can back truck to within five (5) feet of the containers, and an
alternate bid for collection of said garbage and rubbish by the Contractor
assuming said garbage and rubbish is placed within ten (10) feet of a
publ ic - , -E street by the householder. The householders garbage and
trash containers shall be twenty (20) or th i rty (30) gallons, and shall not
exceed one hundred twenty (120) gallons per residence per week. Cans must
have tight fitting 1 ids and handles. Plastic bags must be tied. Con-
tractor is to replace lids on containers. Business trash is not to be
included in normal household trash, Any tree or hedge cl ippings shall be tied
in bundles not over four feet (41) long by property owner or placed in plastic
bags. Contractor is not required to pick up more than two (2) th i rty (30)
gallon plastic bags of trimmings or two bundles of such trimmings per home
per week. Contractor shall remove weekly all refuse and trash in Village
owned trash cans, not to exceed twelve (12) in number. Contractor must
have closed packer type truck to pick up rubbish and garbage.
The relationship between the Village of Dublin and the contracting
party shall be solely contractual and the contractor shall furnish all
equipment and labor for all services to be performed. Contractor shall
carry industrial compensation insurance of the State of Ohio and pay all
lawful payroll deduction and unemployment compensation payments due any
governmental agency.
Contractor shall be responsible for any negligence of the contrac-
tor or any of contractor1s agents, officers or employees. All equipment,
including trucks and automobiles, but not limited thereto, used in said
garbage and trash collection shall be protected by publ ic 1 iabil ity and
property damage insurance in the amount of at least $250,000.00 to protect
the Village of Dubl in, Ohio, and its inhabitants, and to save the same
harmless from and against any and all negligent acts of contractor, his
agents or employees.

Bids shall specify a lump sum price for each month during the continua ce
of the contract for garbage and rubbish collecting and haul ing service for
all of the existing residences in the Village of Dublin at this time, and
bids shall also specify an additional price for each additional residence
built and occupied or annexed to the ViI lage afte~ the awarding of this con
tract and said Bid shall be on a monthly basis for each such additional
residence. The contract price may be modified according to law during the
term of this contract to compensate for increased cost of disposal. The
contractor shall be paid on or before the 10th day of each month. 53 i d
contract to be cancellable by the Village of Dubl in, without 1 iabil ity,
upon thirty days written notice of cancellation to the contractor.
All Bids shall be sealed and shall be filed with the Village Admin-
istrator of the Village of Dubl in, Ohio, before 12:00 Noon February~h,
1976, at which time said Bids shall be opened. All Bids shall be accom-
panied by a bond or certified check in the amount of $100.00. The Counc i 1
of the Village of Dubl in reserves the right to reject any and all Bids.
SECTION 2. That this Ordinance be, and the same hereby is, declared
to be an emergency measure necessary for the immediate preservation of the
public health and safety for the reason that garbage and rubbishrollection
is presently needed to protect the health and safety of the residents of
the Village, and that this Ordinance shall take effect and be in force
immediately upon its passage.
