SECTION I . That the petition of Eleanor and Robert Kel ley, et al
for the annexation to the Vi Ilage of Dublin of the fol lowing
described territory in the County of Franklin and adjacent to
the Vi I lage of Dubl in, to-\"it:
Situated in the State of Ohic, County of Franklin,Township of
I Washington and being more fully described as follows:

Beginning at a point in the existing Corporation line of the
Vi I lage of Dubl in as shown of record in Miscel lanious Records,
Volume 142, Page 54, Ordinance Number 20-66, Frank Ii n County
Recorders Office, said point also being in the right-of-way of
U.S. Route 33 and State Route 161 .

Thence along and with said existing Dubl in Corporation Line, the
fol lowing courses and distances;

Westerly approximately 1501 feet to a point in the Dublin Corpor-

The Commissioners of Franklin County, State of Ohio,
proceeding this day to hear and consider the petition of Eleanor
P. Kelley, et al., filed August 30, 1976, and having in open
hearing heard all of the persons desiring to be heard for
or against the granting of said petition, and having considered
all the facts with reference thereto, and being fully advised,
FIND, that said petition contains all of the matters
required by law; that the territory sought to be annexed is
adjacent and contiguous to the said Village of Dublin, Ohio;
that the petition contains a full and complete description
of said territory sought to be annexed; that the map for said
territory is accurate; that the petition for said territory
is signed by a majority of the owners of real estate within
the territory sought to be annexed; that the required legal
notice has been published; that the territory sought to be
annexed is not unreasonably large; and that the general good
of the territory sought to be annexed will be served if this
annexation is granted, all in accordance with the provisions
of the Ohio Revised Code 709.033; therefore,
I IT IS HEREBY ORDERED: On motion of Mr. Cooper, seconded
by Mr. Dorrian, that the prayer of said petition be granted
. ',! and that the territory described in said petition be annexed
to the Village of Dublin, Ohio, in accordance with the law;
that the orders and proceedings of this Board relating to
said petition and map attached thereto, and all papers on
file relating to said matter be deposited at once with the
Clerk of Dublin, Ohio.

Gentlemen:
In regard to the proposed annexation of 40.85 acres from
Washington Township to the Vi I lage of Dubl in, to come before
the Commissioners on November 3, 1976, we offer the following
comments regarding the avai labi I ity of services to the area:
SEVIER SERV ICE:
As you are probably aware, Dub I in is currently constructing
Phase I of its Sanitary Sewer System. \'-Ie are now in the
process of preparing the engineering for Phase II of our San-
I itary Sewer System. The Sewer Service area contract with .
the City of Columbus includes this area proposed for annex-
at i on, therefore, it is assured that the area can, and wi II
be, served by Dubl ins Sanitary Sewer System, if the annex-
ation is approved.
WATER SERVICE:
The same statements regarding Sanitary Sewers can be appl ied
to Water Service, except, of course, to Water Service con-
tracts with the City of Columbus would apply.
PO 1I CE PROTECT I ON:
The Vi I lage currently has seven (7) ful I-time pol ice officers
and approximately twelve (12) reserve officers. Communications
are handled thru a contract with Perry Township and IS very
effective and efficient. The Vii lage also has mutual aid
agreements with other Frankl in County political subdivisions.
Vie fee I that we could very effectively provide this service
to this area.
MA I NTENANCE AND I "lPROVE ~IE NTS:
Dubl in has, and wi I I continue to invest monies in equipment
I in" order to prov i de very effect i ve street and road ma i nten-
ance and improvements. It IS our intention to maintain equip-
ment and manpower sufficient to keep these services at a very
effective leve I.

Enclosed is a copy of the resolution adopted on September 8,
1916, by the Board of County Commissioners setting the time
I and place of public hearing for the annexation petition which
you, as agent, filed with this office on August 30, 1976.
Under the provisions of Section 709.03 of the Ohio Revised
Code, you, as agent are responsible for the following:
(1) Notification of the date of filling of your petition
with the Board of County Commissioners to be delivered
to the Clerk of the municipality to which annexation
is proposed and the clerk of each township which
is included in the annexation. (A map, description
and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once
a week for four consecutive weeks in a newspaper
of general circulation in the County. (The enclosed
resolution will satisfy the statutory requirements
and should be used for the published notice).
(3) Service upon the municipal and township clerk of
a copy of the published notice.
(4) Preparation of an affidavit stating the name of
I the agent, the number of owners of real estate at
the time of the filing of petition and the number
of owners signing the petition.
A letter from the municipality to which an annexation is proposed
stating the availibility of services such as water, sewerage,
and police and fire protection, is also required.

The undersigned, petitioners in the premises, and being a
MAJORITY OF OWNERS OF REAL ESTATE in the territory hereindfter
described, consisting of _ 40.RS acres, more or less, in
the Township of Washinqton , which area is contiguous
and adjacent to the Village of Dublin , do hereby pray that
said territory be annexed to the Village of Dublin , according
to the statutes of the State of Ohio.
A full and accurate description and a plat of said territory
so prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners state that there
are within the territory so prayed to be annexed 3 OWNERS
OF REAL ESTATE.
Harrison W. Smith, Jr. , is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the
Revised Code of Ohio. Said Agent is hereby authorized to make any
amendment and/or deletion which in his absolute and complete discretion
is necessary or proper under the circumstances then existing, and

crepancy or mistake noted by the Franklin County Engineer in his
