HomeMy WebLinkAbout11-72 Ordinance , . . , ~~, - ORDINANCE NO. 1/-7 A, VILLAGE OF DUBLIN, OHIO AN ORDINANCE ACCEPTING LOWEST AND BEST BID FOR GARBAGE AND RUBBISH COLLECTING AND HA ULING SERVICE TO THE VILLAGE; AUTHORIZING THE MA YOR AND CLERK TO EXECUTE CONTRACT; AND DECLARING AN EMERGENCY ~ '~ J WHEREA SI pursuant to Ordinance /0-1L I bids have been \ ( \ ~ received for garbage and rubbish collecting and hauling service to the \ ., :Village; and - WHEREAS, Council has determined that the bid of Headlee Refusel Inc. is the lowest and best bid; NOW, THEREFORE I BE IT ORDAINED by the Council of the Village of Dublinl State of Ohio S- of the elected members concurring: SECTION 1. That the bid of Headlee Refusel Inc. for garbage and rubbish collecting and hauling service to the Village bel and it hereby iSI accepted. SECTION 2. That the Mayor and Clerk bel and they hereby arel authorized and directed to execute a contract in the name of the Village I with the said Headlee Refuse, Inc. for said service according to the specifications contained in Ordinance 10-7=0 . SECTION 3. Contractor shall collect the garbage and rubbish from all residences in the Village of Dublin, Ohio, on the same ! specified day of each week. If a legal holiday falls on said I specified day, then the garbage and rubbish collection may I 1 ! be made on the next day of that week. 2. The term rubbish shall include all household trash, refuse I and other waste matter such as bottles, tin cans, food, food containers, ashes, cinders, tree and hedge clippings, grass trimmings, leaves and other waste material accumulating about residential property. The term rubbish does not include \, , I waste material accumulated in the construction, remodeling \...' '- or repair of buildings. 3. Said garbage and rubbish to be removed by contractor must be where contractor can back truck to within 5 feet of containers. 4. The householders r garbage and trash containers shall be ,. Plastic bags must ~ be tied; Contractor is to replace lids on containers. Busines trash is not to be included in normal household trash, . 5. Any tree or hedge clippings shall be tied in bundles not , '\::. over four feet (4') long by property owner or placed in plastic , I "\ - - bags. Contractor is not required to pick up more than two ~" (2) thirty (30) gallon plastic bags of trimmings or two .' bundles of such trimmings per home per week. \, 6. Contractor shall remove weekly all refuse and trash in \ ~ Village owned trash cans, not to exceed eight (8) in number. ~ Contractor must use closed packer type truck to pick up rubbish and garbage. 8. The relationship between the Village of Dublin and the ~ contractor shall be solely contractual and the- contractor , ~ shall furnish all equipment and labor for all services to be I "\ ' \: performed. Contractor shall carry industrial compensation \ I ~ ~ insurance of the State of Ohio and pay all lawful payroll deductions and unemployment compensation payments due any ~ governmental agency. Contractor shall be responsible for \, any negligence of contractor or any of contractor's agents, officers or employees. All equipment, including trucks, \, and automobiles, but not limited thereto, used in said garbage ~ and trash ollection shall be protected by public liability and property damage insurance in the ~mount of at least $50,000.00 to protect the Village of Dublin, Ohio, and its i inhabitants against any and all negligent acts of contractor, i - -., , ~ ',- his agents or employees. The Village agrees to pay to Contractor the sum of Six Hundred Five Dollars ($605.00) per month for the services set forth above, for all the existing residences in the Village of Dublin, Ohio, and to pay in addition thereto the sum of Two and 75/100 Dollars ($2.75) for each additional residence- - 2 - ,.. The contract price may be modified according to law during the term. of this contract to compensate for the increased cost of disposal. 11.
