Form No. 30043 1 Ordinance No. 19 -07 Passed 20 AN ORDINANCE AUTHORIZING THE ACQUISITION OF A COMBINED 2.221 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, A COMBINED 0.668 ACRE, MORE OR LESS, PERMANENT EASEMENT, AND A COMBINED 0.025 ACRE, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM SHAMROCK CROSSING, LLC., LOCATED NORTH OF WEST DUBLIN - GRANVILLE ROAD, IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, FOR THE SHAMROCK CROSSING BOULEVARD EXTENSION PROJECT, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to extend Shamrock Boulevard and realign Village Parkway to improve related traffic circulation; and WHEREAS, said improvement required the City of Dublin to obtain a fee simple interest, permanent easements and temporary construction easements in and to the premises described in the attached Exhibits "A" through "L" located in the City of Dublin, Franklin County, Ohio; and WHEREAS, the City desires to enter into an agreement to acquire a combined 2.221 acre, more or less, fee simple interest, a combined 0.668 acres, more or less, permanent easement and a combined 0.025 acre, more or less, temporary construction easement, for the extension of Shamrock Boulevard and realignment of Village Parkway for Four Hundred Twenty -Two Thousand One Hundred Dollars and No Cents ($422,100); and WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a purchase a combined 2.221 acre, more or less, fee simple interest, a combined 0.668 acres, more or less, permanent easement and a combined 0.025 acre, more or less, temporary construction easement, located north of West Dublin- Granville Road, in the City of Dublin, Franklin County, Ohio, as described in the attached Exhibits "A" through "L "; and WHEREAS, it is necessary to amend the annual appropriations ordinance to provide funding authorization for the acquisition of the property. NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, and , of the elected members concurring that: Section 1 . The City Manager is hereby authorized to execute a Real Estate Purchase Contract and any necessary closing documents related to the acquisition of purchase of a combined 2.221 acre, more or less, fee simple interest, a combined 0.668 acres, more or less, permanent easement and a combined 0.025 acre, more or less, temporary construction easement, and paying any related costs. Section 2. There be appropriated from the unappropriated balance in the Shamrock Boulevard TIF Fund Four Hundred Twenty -Five Thousand Dollars and No Cents ($425,000) to account 444 - 0314 - 780 -2551, for the purpose of acquiring the purchase a combined 2.221 acre, more or less, fee simple interest, a combined 0.668 acres, more or less, permanent easement and a combined 0.025 acre, more or less, temporary construction easement, and paying any related costs. SUMMARY: Since the March 19, 2007 City Council Meeting, the exhibits to the Ordinance have been updated to reflect the current owner of the property, Shamrock Crossing, LLC, and the minor acreage adjustments as mentioned in the March 12, 2007 staff memo have been made. The Shamrock Boulevard extension project went out to bid on April 3, 2007 and we are planning to schedule the bid award for the April 23, 2007 City Council meeting. RECOMMENDATION: Staff recommends that Ordinance No. 19 -07 be passed as an emergency at the second reading /public hearing on April 9.
