The following described real estate (see attached map marked Exhibit "A ") situated in the City of Dublin, State of Ohio, is hereby rezoned HB, Historic Business District, and shall be subject to regulations and procedures contained in Ordinance No. 21 -70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. (Darby Street Municipal Lot - 35 and 37 Darby Street - Case No. 07- 036Z /CU). Summary Rezoning application 07- 036Z /CU for the Darby Street Municipal Parking Lot, consisting of one acre located at the northwest intersection of Darby Street and Wing Hill Road is being forwarded to City Council. The site is bordered to the north and east by Dublin City Schools Indian Run Elementary and to the south by Jason's Restaurant. This application requests a change in zoning from R -2, Limited Suburban Residential District and CB, Central Business District to HB, Historic Business District. The proposed HB zoning allows for the development of a proposed 103 -space public parking lot. The Planning and Zoning Commission recommended approval of this rezoning on June 7, 2007. Additionally, the Commission approved a Conditional Use for parking as a stand alone use not in conjunction with other permitted and /or conditional Historic Business District uses, with two conditions which can be found in the attached Record of Action. Planning will ensure that these conditions will be fulfilled entirely through the building permitting stage. The Conditional Use approval is subject to rezoning approval by City Council. Recommendation Staff recommends approval of this rezoning at the second reading /public hearing on July 2, 2007. (A) Preliminary development plan. In the review of proposed planned developments, the Planning and Zoning Commission and City Council shall determine whether or not the preliminary development plan complies with the following criteria. In the event the Planning and Zoning Commission determines that the proposed preliminary development plan does not comply with a preponderance of these criteria, the Planning and Zoning Commission shall disapprove the application: (1) The proposed development is consistent with the purpose, intent and applicable standards of the Zoning Code; (2) The proposed development is in conformity with Community Plan, Thoroughfare Plan, Bikeway Plan, and other adopted plans or portions thereof as they may apply and will not unreasonably burden the existing street network; (3) The proposed development advances the general welfare of the city and immediate vicinity and will not impede the normal and orderly development and improvement of the surrounding areas; (4) The proposed uses are appropriately located in the city so that the use and value of property within and adjacent to the area will be safeguarded; (5) Proposed residential development will have sufficient open space areas that meet the objectives of the Community Plan; (6) The proposed development respects the unique characteristic of the natural features and protects the natural resources of the site; (n Adequate utilities, access roads, drainage, retention and /or necessary facilities have been or are being provided; (8) Adequate measures have been or will be taken to provide ingress and egress designed to minimize traffic congestion on the sur- rounding public streets and to maximize public safety and to accommodate adequate pedestrian and bike circulation systems so that the proposed development provides for a safe, convenient and non- conflicting circulation system for motorists, bicyclists and pedes- trians; (9) The relationship of buildings and structures to each other and to such other facilities provides for the coordination and integration of this development within the PD and the larger community and maintains the image of Dublin as a quality community; (10) The density, building gross floor area, building heights, setbacks, distances between buildings and structures, yard space, design and layout of open space systems and parking areas, traffic accessibility and other elements having a bearing on the overall accept- , ability of the development plans contribute to the orderly development of land within the city; (11) Adequate provision is made for storm drainage within and through the site so as to maintain, as far as practicable, usual and normal swales, water courses and drainage areas; (12) The design, site arrangement, and anticipated benefits of the proposed development justify any deviation from the standard devel- opment regulations included in the Zoning Code or Subdivision Regulation, and that any such deviations are consistent with the intent of the Planned Development District regulations; (13) The proposed building design meets or exceeds the quality of the building designs in the surrounding area and all applicable appearance standards of the city; (14) The proposed phasing of development is appropriate for the existing and proposed infrastructure and is sufficiently coordinated among the various phases to ultimately yield the intended overall development; (15) The proposed development can be adequately serviced by existing or planned public improvements and not impair the existing public service system for the area; (16) The applicant's contributions to the public infrastructure are consistent with the Thoroughfare Plan and are sufficient to service the new development. Site Character The land is relatively flat and partially paved as parking_ Two structures exist on the site - the former Krema Products building is located in the southeast portion of the site and to the northeast is the Dublin Banquet Hall_ Surrounding Zoning and Uses The site is zoned CB, Central Business District and R -2, Limited Suburban Residential District. The Indian Run Elementary School to the west is zoned HR, Historic Residential District, and the Dublin branch of the Columbus Metropolitan Library is located to the north and is zoned SO, Planning and Zoning Commission June 7, 2007 Planning Report Case No_ 07-036Z/CU Page 2 of 6 Suburban Office and Institutional District. There are several businesses to the east zoned CB Central Business District, and Jason's Restaurant to the south is zoned HB, Historic Business District. Plan Description Overview This proposal is for the rezoning of the parcels comprising this site to HB, Historic Business District, for the purposed of developing a municipal parking lot containing 103 spaces at the northwest corner of Darby Street and Wing Hill Street as a stand alone parking lota conditional use with the Historic Business District. Existing Structures The two existing principal structures on the site will be demolished in order to fully develop the site as a municipal parking lot. The Dublin Banquet Hall at the north end of the site was constructed in 1957, and the former Krema Products building in 1970. Both are constructed with concrete masonry units as the primary building material, and possess no historic architectural significance to the District. A small barn of indefinite history is attached to the west end of the former Krema Products building. The City's historic preservation consultant has investigated this structure and determined it to be of no historic significance due to the number of significant architectural modifications it has undergone (see attached letter). Vehicular Access The plans indicate two driveways for this lot. One curb cut is at the southeast portion of the site to Darby Street, the other on the north side of the lot across from the Dublin Branch of the Columbus Metropolitan Library. Pedestrian and Bicycle Access Code requires that a five foot sidewalk be installed with developments having frontage along a public thoroughfare. The plan indicates a six -foot concrete paver sidewalk on the west side of Darby Street. Additionally, the plans indicate a sidewalk connection in the northwest portion of the site providing a connection to an existing sidewalk and ADA accessible ramp from the Indian Run Elementary parking lot to the north. The plans do not indicate a location for bike racks in the proposed parking lot. Lighting The parking lot lighting will be reviewed against the Dublin Exterior Lighting Guidelines. The proposed parking lot lights are decorative, cut -off fixtures, which are compatible with existing lighting in the Historic District. The lighting plan notes should be revised to accurately reflect the lighting details shown on the plan. Landscaping The Code requires interior landscaping and vehicular use area screening. A 3'/2 -foot tall evergreen hedge will surround the parking lot, and a combination of deciduous shade trees will Planning and Zoning Commission June 7. 2007 Planning Report Case No_ 07 -036Z/CU Page 3 of 6 be used in the interior landscape islands and at 40 -foot intervals around the perimeter of the parking lot, meeting the Code requirements. Proposed Signs At this time no sign details have been provided other than required ADA parking signs. The City intends to implement directional signs on the site to assist visitors in finding the lot. Stormwater Expected Stormwater runoff will be managed by several proposed Stormwater structures and storm sewer line. The Stormwater Management and Stream Corridor Protection Code exempt sites within the Architectural Review District from stormwater quality requirements. The Code also exempts this site from providing Stormwater quality control based on the amount of disturbed area. SECTION It - REVIEW STANDARDS Rezoning (Zoning District Map Amendment) Council may change or amend the text of the zoning ordinance, or the zoning district map. Proposed changes or amendments may be initiated by one or more owners or lessees of land within the area that is proposed to be changed by amendment of the zoning district map or by the City on its own action. Evaluation and Recommendation based on Rezoning Criteria Following is an evaluation by Planning based on three general rezoning review criteria. Consistency. The rezoning will provide for uses which are generally consistent with the policies and goals of the Community Plan and Zoning Code, will advance the public interest and is reasonably necessary in promotion of the public health, safety or welfare. Criterion is met. The provision of additional public parking and pedestrian connectivity in the Historic District is consistent with the policies and objectives outlined in the Community Plan and the draft Historic Dublin Revitalization Plan. Compatibility. The uses permitted with the rezoning are compatible, harmonious and suitable with the surrounding land uses_ Criterion is met. The surrounding commercial uses will directly benefit from the construction of this municipal parking lot by providing immediate access for patrons to the Historic District businesses_ Capability_ The size and configuration accommodating the uses proposed. The principles are arranged in the following categories and may be in a different order than listed in the Code: Quality and Character (Principle 1, 6, 7, and 9) High quality design for all uses, recognizing density has important economic implications, but is essentially an outcome not a determinant of creating a quality place, preserving the rural character of certain areas of the community, including the appearance of roads, as well as the landscape; developing streets that create an attractive public realm and make exceptional places for people, and creating streets that contribute to the character of the community and move a more reasonable level of traffic. Criteria may be met throup_h condition. This proposal ' will improve the aesthetic quality of the Darby Street streetscape through the addition of street trees and landscaping. It will also provide a safe pedestrian connection between the proposed parking lot and library and to the existing and future commercial uses to the south and east. When the City of Dublin opts to install directional signs, it is the opinion of Planning that they should be similar to existing signs in the District, subject to Planning approval (Condition 91). Connectivity (Principle 2, 8 and 10) Creating places to live that have a stronger pedestrian environment, connections to convenient services, and are conducive to multi- generational living and social interaction; creating better connected places, in part, to improve the function of the street network and also to better serve neighborhoods, and providing opportunities to walk and bike throughout the community. Criteria may be met through condition. The development will provide a sidewalk along Darby Street, improving pedestrian movement and providing a better connection to the rest of the Historic District. It is the opinion of Planning that the incorporation of a bike rack within the parking lot would encourage bicycle use, and provide for the orderly storage of bicycles (Condition 92). Integration (Principle 3, 4, and 5) Creating places with integrated uses that are distinctive, sustainable and contribute to increasing the City's overall vitality, providing some retail services in closer proximity to residential areas as an important amenity to residents, and creating a wider range of housing choice in the community, as well as in new neighborhoods. Criteria met. Integrating additional parking in the Historic District will better serve existing and future commercial uses. Conditional Use Conditional - uses, while often desirable, may more intensely affect the surrounding area in which they are located than permitted uses. The intent of the conditional use process is to set forth development standards and criteria for locating and developing a conditional use in accordance Planning and Zoning Commission June 7, 2007 Planning Report Case No_ 07-036Z/CU Page 5 of 6 with the nature of the surrounding area, conditions of the development, and with regard to appropriate plans. The Planning and Zoning Commission is the final stage in approving/disapproving a conditional use. The conditional use request includes all of the details of the proposed use, and the Commission may approve, disapprove, or approve with modifications. Upon a favorable finding, the Commission shall approve a conditional use application within 30 days following the public hearing. Appeal of any action taken by the Commission shall be to the Court of Common Pleas in the appropriate jurisdiction. Following approval by the Commission, the applicant may proceed with the building permit process. A Certificate of Zoning Plan Approval for a conditional use must be issued within one year of Planning and Zoning Commission approval or the approval expires. Evaluation and Recommendation based on Conditional Use Criteria In accordance with Section 153.236(C), as amended by City Council on January 20, 2004, [Ordinance 117- 03(Amended)] the Code sets out criteria of approval for a conditional use. Following is an evaluation by Planning based on those criteria. The criteria are arranged in the following categories and may be in a different order than listed in the Code: Policies of the Community (Criteria I & 2). The proposed use will be harmonious with and in accordance with the specific objectives of the Zoning Code, Community Plan and draft Historic Dublin Revitalization Plan and will comply with all applicable development standards_ Criteria met. The proposed parking lot is consistent with the objectives of the Code, Community Plan and draft Historic Dublin Revitalization Plan. Impact to the Surrounding Community (Criteria 3., 4, 6, 9, & 10)_ The proposed use will be harmonious with the existing or intended character of the general vicinity, will not be hazardous to or have a negative impact on surrounding uses, will not be a detriment to the economic welfare of the community or property values in the immediate vicinity, and will not impede the orderly development of the surrounding properties_ Criteria met. The proposed parking lot is harmonious with the land uses in the surrounding vicinity and will have a positive effect on existing and future land uses by providing convenient parking for patrons. Necessary Infrastructure (Criteria 5, 7 & 8)_ The area and proposed use(s) will be adequately served by essential public facilities and services and will have vehicular approaches that are appropriately designed to not create interference with traffic on surrounding public or private road systems. Criteria met. The utility infrastructure associated with the proposed parking lot will adequately manage stormwater runoff. Driveways have been appropriately located to accommodate traffic on the adjacent road system. This responsibility is limited to relocation of modboxes to a temporary location that wit allow the completion of the work and shod also include the restoration of modboxes to their originol location or approved new location. Any relocation of mol7box services must be frsl coordinated with the US Postal Service and the homeowner. 2 Before relocating any modboxes, the Contractor shall contact the LIS Postal Service and relocate modboxes according to the requirements of the Postal Service.
