hereby rezoned R -2, Limited Suburban Residential and R -4, Suburban Residential
Districts and shall be subject to regulations and procedures contained in Ordinance
No. 21 -70 (Chapter 153 of the Codified Ordinances) of the City of Dublin Zoning
Code and amendments thereto.
Section 2. That application, Exhibit "B ", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C ", are all incorporated into and made an official part of this Ordinance and
said real estate shall be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

Summary
Ordinances 26 -07, 27 -07, 28 -07, 29 -07 and 30 -07 are requests for rezonings to R, Rural;
R -1, Restricted Suburban Residential; R -2, Limited Suburban Residential; R -4 Suburban
Residential; RI, Restricted Industrial; LI, Limited Industrial; GI, General Industrial; and
PUD, Planned Unit Development Districts. These area rezonings were introduced at the
May 21, 2007 Council meeting.
Members of City Council requested information regarding specific land uses contained in
Ordinance 27 -07, which proposed a rezoning to the R -4, Suburban Residential District.
In response, Planning has reviewed the area proposed for this residential zoning
classification and determined that the parcels are developed as single - family, residential
houses which are permitted uses in the R -4, Suburban Residential District.
Planning staff will be available to address any additional questions at the second
reading/public hearing on June 4, 2007.
Recommendation
Staff requests approval of Ordinances 26 -07, 27 -07, 28 -07, 29 -07 and 30 -07 at the second
reading/public hearing on June 4, 2007.

Summary:
Area Rezoning Ordinances 26 -07, 27 -07, 28 -07, 29 -07 and 30 -07 are located in two general
areas including the southwest area of Dublin and an area south of the Historic District that
total 1,216 acres. These applications were prompted by the City of Dublin and request
changes in zoning to R, Rural; R -1, Restricted Suburban Residential; R -2 Limited Suburban
Residential; RI, Restricted Industrial; LI, Limited Industrial; GI, General Industrial; and PUD,
Planned Unit Development Districts. The purpose of the project is to establish appropriate
Dublin zoning classifications for all land located within the City limits to effectively administer
development standards and avoid any future Code Enforcement issues.
As part of the area rezoning process, some property owners (who may be represented at
the hearing), objected to the proposed zoning for their particular properties. The Land Use &
Long Range Planning Division recommended that all of the properties included in the
original request be considered in the same manner and no distinction be made among
properties to prevent favored treatment of any individual property.
The recommendation of Planning to deny separate requests by property owners should not
be taken as an indication of any future recommendation for subsequent applications made
by the property owners. Instead, the recommendation was to ensure that all property
owners involved in this process were treated fairly and equally. Approval of the
recommended area rezoning designation does not preclude submission of applications for
individual properties through the normal rezoning process.
However, should the Council elect to treat these properties separately, it will be necessary
to return them to the Planning and Zoning Commission for new hearings. This is because
the requested zoning designations are more intense than those proposed in the Area
Rezonings, and the surrounding property owners must be notified that a less restrictive and
more intense zoning classification is being requested.

Ordinance 30 -07 - SR161 and US33 Corridor (Case #03 -123Z)
This group consists of properties located in the southwest area of Dublin. Planning sent
informational letters to all property owners explaining the rezoning process and hosted
public information sessions for both the residential and commercial properties. These
cases then proceeded to a hearing of the Planning and Zoning Commission on April 12,
2007, where all three received positive recommendations to City Council.

Ordinance 26 -07 — Southwest Quadrant 1 (Case # 01 -110Z)
Ordinance 27 -07 — Inner 1 -270 Residential (Historic District not included) (Case # 03 -0982)
This group includes properties in the southwest area of Dublin and an area south of the
Historic District. Public information meetings were held during the initial phase of rezoning
in 2004. To update property owners about our process, Planning sent an informational
letter explaining the rezoning process. These cases were heard by the Planning and
Zoning Commission on April 12, 2007. Case numbers 01 -110Z and 03 -098Z received
positive recommendations with a modified application that excluded four parcels. These
excluded parcels will be rezoned at a future date.
Additional information regarding these cases is available for public viewing at 5800 Shier -
Rings Road in the offices of Land Use and Long Range Planning.
The public hearing (second reading) on the requested zoning changes will be scheduled
for June 4, 2007.
Recommendation:
Approval of Ordinances 26 -07, 27 -07, 28 -07, 29 -07 and 30 -07 at the June 4, 2007 Council
meeting.

ATTACHMENT A: PRELIMINARY DEVELOPMENT PLAN APPROVAL CRITERIA
§ 153.055 PLAN APPROVAL CRITERIA.
(A) Preliminary development plan. In the review of proposed planned developments, the Planning and Zoning Commission and City
Council shall determine whether or not the preliminary development plan complies with the following criteria. In the event the Planning
and Zoning Commission determines that the proposed preliminary development plan does not comply with a preponderance of these
criteria, the Planning and Zoning Commission shall disapprove the application:
(1) The proposed development is consistent with the purpose, intent and applicable standards of the Zoning Code;
(2) The proposed development is in conformity with Community Plan, Thoroughfare Plan, Bikeway Plan, and other adopted plans or
portions thereof as they may apply and will not unreasonably burden the existing street network;
(3) The proposed development advances the general welfare of the city and immediate vicinity and will not impede the normal and
orderly development and improvement of the surrounding areas;
(4) The proposed uses are appropriately located in the city so that the use and value of property within and adjacent to the area will
be safeguarded;
(5) Proposed residential development will have sufficient open space areas that meet the objectives of the Community Plan;
(6) The proposed development respects the unique characteristic of the natural features and protects the natural resources of the
site;
(7) Adequate utilities, access roads, drainage, retention and /or necessary facilities have been or are being provided;
(8) Adequate measures have been or will be taken to provide ingress and egress designed to minimize traffic congestion on the sur-
rounding public streets and to maximize public safety and to accommodate adequate pedestrian and bike circulation systems so that
the proposed development provides for a safe, convenient and non - conflicting circulation system for motorists, bicyclists and pedes-
trians;
(9) The relationship of buildings and structures to each other and to such other facilities provides for the coordination and integration
of this development within the PD and the larger community and maintains the image of Dublin as a quality community;
(10) The density, building gross floor area, building heights, setbacks, distances between buildings and structures, yard space, design
and layout of open space systems and parking areas, traffic accessibility and other elements having a bearing on the overall accept-
ability of the development plans contribute to the orderly development of land within the city;
(11) Adequate provision is made for storm drainage within and through the site so as to maintain, as far as practicable, usual and
normal swales, water courses and drainage areas;
(12) The design, site arrangement, and anticipated benefits of the proposed development justify any deviation from the standard devel-
opment regulations included in the Zoning Code or Subdivision Regulation, and that any such deviations are consistent with the intent
of the Planned Development District regulations;
(13) The proposed building design meets or exceeds the quality of the building designs In the surrounding area and all applicable
appearance standards of the city;
(14) The proposed phasing of development is appropriate for the existing and proposed infrastructure and is sufficiently coordinated
among the various phases to ultimately yield the intended overall development;
(15) The proposed development can be adequately serviced by existing or planned public improvements and not impair the existing
public service system for the area;
(16) The applicant's contributions to the public infrastructure are consistent with the Thoroughfare Plan and are sufficient to service
the new development.

Ms. Adkins indicated on a map which properties were proposed to be designated R -2, which is
a single - family designation and the three parcels that were proposed to be R -4. She said four
parcels were taken out of R -2 because they were duplexes and did not fit the R -2 classification.
She said those four properties will be dealt with at a later date.
Mr. Gerber abstained from this case because he owned property in this area. Vice Chair
Zimmerman led the meeting for this case and called for any audience participation.
Kenneth Baker, 2730 Spring Lane, asked what the difference was between R -2, Limited
Suburban Residential and R-4, Suburban Residential Districts.
Ms. Adkins explained that the R -2 District is a single - family designation which requires one
house per a minimum square footage of 20,000 square feet. She said the R -4 District allows for
duplexes and up to eight - family dwelling structures with other applicable standards.
Motion and Vote:
Mr. Zimmerman made the motion to approve this Area Rezoning on the basis that this action
provides proper Dublin zoning and the administration of applicable development standards. Mr.
Saneholtz seconded. The vote was as follows: Mr. Walter, yes; Mr. Fishman, yes; Ms.
Amorose Groomes, yes; Mr. Gerber, abstain; Mr. Saneholtz, yes; and Mr. Zimmerman, yes.

BACKGROUND:
On the advice of Dublin's Law Director, Planning has systematically researched Dublin zoning
activity on all parcels annexed into Dublin. Through this investigation, Planning has found
several areas where zoning was not formally established as required by law. Land Use and Long
Range Planning is responsible for compiling and processing "area rezoning" applications to
formally establish Dublin zoning wherever there is gLny question about the zoning history. The
first major area rezoning was undertaken in 2001, and it covered the Northeast Quadrant of
Dublin. Additional rezonings have been introduced since that time, however, in early 2004 this
process was discontinued based on reprioritization of projects and associated staff time.
The sites in this case were annexed between 1881 and 1960; there is no history of a formal
rezoning ordinance for these areas since that time. This rezoning will establish Dublin R -2,
Limited Suburban Residential, or R -4, Suburban Residential zoning. This is a records
maintenance issue with no immediate impact or effect on existing uses. A 1976 ordinance
requires adherence to Dublin standards, wherever they are stricter, following annexation.
Therefore, Dublin's development standards will apply if this rezoning is not adopted. However,
the failure to formally establish Dublin zoning on the property will make administration and
enforcement difficult.
Case Summary:
This is a request for review and approval of a rezoning to Dublin R -2, Limited Suburban
Residential, or R -4, Suburban Residential Districts. All legally non - conforming uses and
structures will be subject to the requirements of Section 153.004(C) of the Dublin Zoning Code.
Planning recommends approval of this rezoning.
Site Description:
The properties listed in this application were annexed from Washington Township and/or
Franklin County between 1881 and 1960. The area is comprised of 111 parcels, totaling
approximately 64.5 acres. The R -2 and R -4 districts have been indicated on zoning maps for the
site since annexation. Most of the parcels are located south of Dublin - Granville Road, west of
the Scioto River, north of Rings Road, and east of Frantz Road. This application includes
residential homes and city parkland. Parcels range in size from approximately one -half to two
acres. The proposed zoning classifications selected are exactly equivalent to the existing zoning
records and zoning maps for the area.
A number of properties along Marion Street, Longview and Grandview Drives are two - family
residences. The R -2 district is a single - family zoning district and does not permit two - family
dwelling structures. Several of these properties were constructed before the Village of Dublin
annexed these properties, and before the Village adopted the 1974 zoning map showing the R -2
district. These dwelling structures are now considered legally - nonconforming, as they do not
comply with the permitted uses within the R -2 zoning district. Legally non - conforming uses or
structures cannot be expanded or rebuilt once destroyed, and they cannot be re- established after

being discontinued for a period of two years. Staff does not believe that the R -4 district that
would permit the two- family structures, as well as, up to eight - family structures is appropriate
for the area.
Proposed Rezoning:
No development is proposed as part of this application, and it has no effect on utilities.
Currently, municipal water and sanitary services are available to some of these properties. The
zoning change does not affect utility status. In addition, new development anywhere in Dublin,
including on these parcels, must comply with adopted stormwater management regulations and
other development standards for the City of Dublin.
Planning mailed an informational letter to the property owners on March 16, 2007 with an update
of the process and proposed zoning change (See attachment). A property owner has expressed
concerns about the proposed non - conforming status created by the R -2 zoning.
After the Planning Commission makes its recommendation, the case will be forwarded to City
Council for a public hearing and final vote. With a positive recommendation from the
Commission, a simple majority vote is required for passage. A negative Commission
recommendation requires five votes for City Council passage. If the ordinance is approved, it
will take effect in 30 days.
SECTION II - REVIEW STANDARDS:
The objective of this rezoning process is to establish Dublin zoning classifications on all
properties that either retain Washington Township zoning classifications, or do not have
sufficient documentation to sufficiently demonstrate Dublin zoning. Planning is supportive of
this process because it provides consistent regulatory standards for all properties within the City
of Dublin. This process also ensures the preservation of private property rights by assigning
equivalent zoning classifications to the existing zoning on each parcel of land.
The Future Land Use map (Map 8) of the Community Plan, amended by City Council in 2005.
The properties included in this application are designated with the existing land use of
"Residential."
SECTION III - RECOMMENDATION:
Planning research indicates these properties were not placed in a Dublin zoning classification by
passage of a formal rezoning ordinance. This rezoning will provide an appropriate Dublin
zoning classification for land within the city limits to provide for the effective administration of
development standards, and avoid any future Code Enforcement issues arising from township or
county classifications and inconsistencies with the Dublin Zoning Map. The rezoning will
maintain the established development pattern that has been in place for many years and reflects
land uses consistent with those listed in the Community Plan. Planning recommends approval of
this rezoning on the basis that this action provides proper Dublin zoning and is primarily a
housekeeping effort.

Rezoning
Anne Wanner said this area rezoning was located on the inside of I -270. She showed slides of
the site. It incorporates several neighborhoods along Marion Street, Dublin Road, Monterey
Drive, and Longview Drive. There are 119 parcels (approximately 69 acres). Classifications
proposed include R -2 and a small area of R -4. These are the zoning districts that have been
reflected on the Dublin zoning maps for approximately 15 years. Ms. Wanner said staff is
recommending approval of this rezoning.
Robert Wood, speaking for 70 and 72 Monterey Drive, said he attended the neighborhood
meeting. He said there are parcels at the northwest corner zoned R -2, a single- family residential
district, but they are twin- singles. He asked if it would not be prudent at this time to keep them
as they are, rather than having to come back later and correct this.
Mr. Gerber asked what would happen if something happened to these twin - singles and they
wanted to get a permit to rebuild them.
Ms. Wanner said these are legally non - conforming because they are two- family dwelling units,
which are not permitted in the R -2 District as shown on the existing zoning map. If they were to
be destroyed by an act of God or fire, etc., they could only be developed as single - family units in
accordance with the R -2 zoning.
Mr. Wood said if there are eight units and one of them should burn down, no one will want to
build a single - family residence among twin singles. It seemed since these were built in the early
1950s,. that they should be zoned as twin singles rather than trying to convert it. Later, the
property owners would have to have them rezoned. He realized the City wanted to correct all the
zoning, but suggested that it should be done now.
Mr. Gerber asked if there was an argument now that this was a non - conforming use. Ms.
Wanner said it was legally non - conforming.
Mr. Gerber asked if they wanted to rebuild, would they have to submit a variance application and
go through the process to rebuild. Mr. Banchefsky said it would have to be over 50 percent of
the fair market value.
Mr. Gerber asked if one side was not habitable as a result of a fire, would the other resident have
to live next door to a vacant unit. Ms. Wanner thought the value of the entire structure before
and after the damage would need to be evaluated by an appraiser.

Mr. Banchefsky said if the units were attached and one is significantly damaged, but it was less
than 50 percent, it could be rebuilt and repaired.
Ms. Boring asked if it would be possible pull these parcels out of this area rezoning so that it
could be studied in more detail. She was not convinced at this time that it is good to put
something that has been there for a long time as a non - conforming use, especially considering
the things she heard might possibly happen. She needed more of a basic understanding to see if
it is a workable situation.
Mr. Gerber asked if the Commission could approve this rezoning and ask City Council to look at
this at the second reading since they have the ultimate decision to make. Ms. Boring thought this
rezoning should be cleaned up as much as possible on the Commission level.
Mr. Wood asked if this rezoning needed to have action taken upon it tonight.
Mr. Gerber said there had been several public meetings held to address issues. The Commission
wanted to move this application forward, but he wanted to take care of Mr. Wood's issues.
Mr. Wood spoke at the last resident meeting and was told he needed to speak to the Commission.
Mr. Gerber said when they say "clean -up" the map, all the City is trying to do is to officially
stamp what has really been known as and what the City has been operating under for years. He
said they are not trying to take anybody's rights. He was concerned that if they begin to rezone
out of a different classification, it would set a very dangerous precedent for other properties in
the future where it may effect certain people's property rights and expectations. Mr. Messineo
agreed that would set a precedent.
Mr. Banchefsky said with these older zonings, that the Village's record keeping was not
comprehensive as it is now with off -site storage and microfiche, etc. He said the City has many
maps that show this property as zoned R -2. Sometimes there is not a supporting ordinance
available or the zoning map is not clear. In terms of alterations, from staff's perspective, nothing
is being changed with this proposal. The City is just cleaning up records so if it is ever involved
in any type of court action, or just from a real estate title standpoint, it is absolutely clear what
these properties are zoned.
Ms. Boring asked if a property owner wanted to remodel or update, can they get financing on
non - conforming uses. Ms. Wanner said usual maintenance work could be done.
Mr. Gerber said the non - conforming use was not necessarily a bad thing.
Mr. Wood asked if sometime ago a building permit was issued that approved the construction of
the twin singles. Mr. Gerber assumed so.
Mr. Banchefsky wanted to verify that these units were built in the Township prior to annexation.
He said the City would assume that they were lawfully built, pre - existing, non - conforming uses
at that time.

Ms. Wanner thought these structures were built in the 1950s. These properties were not annexed
until the 1960s. The first Dublin Zoning Map was not approved until 1973. She said it seemed
that at some point, Village officers probably assigned R -2 zoning for the twin single properties.
She said perhaps that was done purposely, but she could not find any substantiative evidence.
Mr. Wood said it seemed these properties had escaped under the radar for many years, but it did
not seem this was the time to shoot them down.
Mr. Sprague asked if this were to be rezoned according to what existed on the properties to make
them conforming uses, what would the zoning be. Ms. Wanner said R -4.
Mr. Gerber asked if someone bought these R -4 zoned properties five years from now and wanted
to build single- family houses there could it be done. Mr. Sprague said yes, because the density
would drop.
Mr. Wood believed the chance would be better going the other way rather than going back to
single - family since it was so close to SR 161.
Mr. Gerber asked for staff guidance on this matter.
Mr. Banchefsky said Ms. Wanner had thoroughly researched and there is nothing else to find. It
was the Commission's and Council's pleasure in terms of how these are processed.
Mr. Gerber said he felt more comfortable making a recommendation to City Council that the
Commission wanted to approve this, but with respect to these particular twin- singles, they want
City Council to address this issue and come to a final resolution. He said the Commission's job
is housekeeping. He thought the proper body to make these adjustments would be City Council.
Mr. Saneholtz said if these properties have always been R -4, but someone at some point marked
them R -2 on the zoning map, he would vote for what had existed rather than what is perhaps a
mistake or intentional. He did not understand the logic why R -2 should be levied upon a
property that has a history equivalent to R -4.
Ms. Wanner said she does not know that they have a history of R -4. She only knows that there
are two- family dwellings there. She said it could have been that the Village officers at the time
did not want an intense use on the site for Old Dublin, but that was just speculation.
Mr. Saneholtz asked if it was known if the property owner at that time had proper notice and a
chance to rebut or defend their property rights at that time.
Ms. Wanner said the adoption of the zoning ordinance and the zoning map would have been
advertised per the Charter. However, she did not know if they individually received a notice as
is mailed now.
Mr. Banchefsky said that was long before it was in the Village. That was something in the
Township. It is not known. He said the presumption is that this site has been on Dublin's zoning
map since Dublin had one.
Ms. Reiss said someone issued a building permit and she assumed they checked to see that was
the proper permit. Mr. Gerber said they may have been given a variance

Frank Ciarochi said the direction given to staff was to determine areas that were annexed without
records to a showing that their zoning was changed to a Dublin classification. He said direction
was given to place them in a Dublin category as close as possible to what they were zoned in the
township or what the City records (good or bad) reflect. That was why the staff's position is
showing R -2 zoning. He said staff did not analyze these from the standpoint of existing uses,
conforming or non - conforming, or using the Community Plan. It all stemmed out of a lawsuit
situation where the City realized that it could not go back and document the establishment of
zoning for a site based on township or county records at the time. Mr. Ciarochi said Dublin is
not trying to take anything away from anyone or trying to change the zoning involved in these
situations. He said this is trying to place them into the City's zoning category as closely as
possible, based on direction given by City Council.
Ms. Boring said it makes sense to not change it to create a non - conforming use. She asked if Mr.
Wood could request a rezoning to fit his use.
Mr. Banchefsky said anyone could at any time request a rezoning of their property. He said it
was mentioned at the property owner meetings held that if they wanted to file their own
rezoning, the City would pull that property from this request. He said this could go forward with
an application now, or they could come in the day after it is finalized at City Council.
Mr. Gerber said they are on dangerous footing if they begin to tinker with some of the
designations. He said a perfect case was the gentleman on US 33 and Avery Road who wanted
something different because he thought he could not sell his property. Mr. Gerber said he had
the right to come in at any time and rezone his property. He said on the southwest side, a
property owner was pushing staff very hard to rezone his property. Everybody has the right to
rezone their property. He said just because it was a non - conforming use does not mean that the
City would take the position that they were sorry about the situation. Mr. Gerber did not think
Dublin was that ruthless, He thought because these particular structures have existed for many
years, that most likely the City would grant that variance.
Mr. Wood asked if there were parameters for parking, etc. for eight units. Mr. Gerber said a
variance could be requested for that also. Mr. Wood said they had adequate off - street parking.
Ms. Reiss asked how many dwelling units were permitted in a R -4 District. Mr. Banchefsky said
three to eight unit dwelling structures were permitted. It was not per acre. There are side yards
and area requirements that go with that.
Chris Cline, a Dublin resident, said the Zoning Code was enacted in 1970 (not 1973). Reviewing
the City for lands that were present at different points in time, there is no record of rezonings.
He said he devoted a great deal of attention to this fact with the LI, Limited Industrial District on
Post Road to figure out how this got on the zoning map. He looked through the Table of
Ordinances, Council Minutes, and Township Minutes and found there was no reason to believe
that it was ever, in fact, zoned. His belief as to what happened was that it was sort of a "back
room" deal. When the Zoning Code was enacted it referred to a land use map.
He said through all the minutes and newspaper stories, nothing is ever mentioned about land
being rezoned, it was enacted by City Council. He said it was a 15- minute meeting, and they
made changes to the land use map. He said that was the only reference ever made having

anything to do with land use. Mr. Cline said back then only publication by notice was done. It
has since been changed by the Charter amendment a few years ago. Mr. Cline said it was a "free
for all." Whatever was on the map that was enacted that night became the zoning and showed up
on future maps. For that reason, Mr. Cline said the "dark side" of what is being done with this
process is that the Commission may be validating things that were never valid before. Mr. Cline
said the zoning classifications may or may not have legitimacy. He personally did not think the
map relied upon for all these years was legitimate, and things were done that provided personal
gain.
Mr. Gunderman said the other side of the argument is that for many years it has been treated as
R -2. If someone came into the office and looked at the zoning map, that is what they saw. If
there was a zoning violation enforced, it was based upon that particular zoning. Mr. Gerber said
that was a very good point.
Mr. Banchefsky said if people came in the Planning Division and wanted to refinance, etc. and
asked for a zoning compliance letter, the letter they got would have in this case said R -2.
Adam Reinhart, 155 Waterford Drive, said their greatest concern was the R -4 use on Franklin
Street. He said to now be able to increase that into four or eight units on one particular site
would greatly impact the neighborhood. He said residents have had many complaints about how
the twin- singles that lead into the Waterford subdivision have been maintained. He said an R -4
zoning district there is a great concern of his. He said it should be an R -2, at most, because there
are single - family residences on those three parcels of land. An R -4 in the middle of a residential
neighborhood would have a negative impact.
Mr. Gerber said the question presented tonight was what to zone this area and what
recommendation to make to City Council. He said the Commission's task is simply to best
determine how has the property has been treated from a zoning perspective, and get it officially
on the records. He said Mr. Reinhart's concerns need to be addressed in some other way at a
later time.
Mr. Reinhart said that was his greatest concern. If there is a period of time that allows
developers to move forward with plans that may be detrimental to the neighborhood, then they
are forced as residents to come and battle things that could have been reviewed before they went
to City Council.
Mr. Gerber understood, but said that it was outside the mission of this Commission assignment.
He also understood Mr. Wood's position. Mr. Gerber said there has been this problem on many
properties. This has been a difficult task for the Commission since last August.
Mr. Saneholtz asked if he were a property owner who did not need financing or report any
activities with respect to his property to any third party including the City, could he potentially
have completely been unaware.
Mr. Banchefsky said yes. However, a person is put on constructive notice just by being a citizen
in terms of these public records and documents to the extent they exist.

Mr. Saneholtz said if he owned his property for 30 or 40 years and he did not know what the
zoning was; why should he care or expect that it changed in any way. He understood they were
not trying to change what the City had interpreted the zoning to be, but it is still the City's
interpretation versus the property owner's and there is no documentation that supports either
position (other than staff saying that it has been on the map for a period of years).
Mr. Gunderman said the only point that Mr. Saneholtz was missing was that the average citizen's
most likely point of contact is simply to come to City Hall and look at the map. That is the
dominant communication tool that happens for the regular citizenry. Most of the time, nothing
else ever happens that would create a need for any information from the City. Mr. Banchefsky
added ...other than when you buy your house.
Mr. Saneholtz asked Mr. Wood when he acquired these properties. Mr. Wood guessed 25 to 30
years ago. Mr. Gunderman said from the City's point of view, it was not relevant.
Mr. Wood said the cemetery is adjacent to this site and the property across the street is park, so
there is a buffer area. He was sure that eight- family units could not be built. He said the intent
was just to keep the twin singles, but he did not think it could ever conform on R -2 zoning.
Further discussion took place regarding the type of zoning a property has when it is annexed into
the City. Ms. Reiss knew that the township had a zoning ordinance in the early 60s, so annexed
properties would have had some kind of zoning. She believed Ms. Wanner was not able to find
records, but some kind of zoning would have been in place at the time of annexation.
Mr. Banchefsky said it is a non - conforming use right now, but it may not have been a non-
conforming use under township zoning. He said staff assumes it was a lawfully existing non-
conforming use, although it is not known to be true. It could have been illegal at the time it was
built. They are being given the benefit of the doubt by staff.
Mr. Messineo made a motion to approve this area rezoning because it will provide an appropriate
Dublin zoning classification for land within the City limits to provide for the effective
administration of development standards, procedures, etc., and will maintain the established
development pattern that has been in place for many years, and establishes land uses consistent
with those listed in the Community Plan. Mr. Zimmerman seconded the motion, and the vote
was as follows: Mr. Gerber abstained, because his wife owned a property in this area for which

§ 153.021 R -2, LIMITED SUBURBAN RESIDENTIAL DISTRICT.
(A) Permitted use. Land and buildings in the Limited Suburban Residential Districts shall be used
only for the following purposes:
(1) Dwelling structures. One - family dwelling structures.
(2) Home occupation. Home occupation in association with a permitted dwelling, and in
accordance with the provisions of § 153.073.
(3) Accessory use. Accessory buildings and uses in association with permitted dwellings as
specified in § 153.074.
(4) Public school and parks. Public school offering general educational courses and having no
rooms regularly used for housing or sleeping of students. Parks, playgrounds and playfields.
(5) Private school. Private school offering general educational courses similar to those
ordinarily given in public schools and having no rooms regularly used for housing or sleeping
of students, providing it occupies a lot of not less than five acres.
(6) Religious. Church or other place of worship provided it occupies a lot of not less than five
acres.
(B) Conditional use. The following uses shall be allowed in the Limited Suburban Residential
District subject to approval in accordance with § 153.236.
(1) Child Care. Kindergarten or child care as an accessory use of a dwelling. There shall be
an outdoor play area of 200 square feet or more per child. Such play area shall be arranged in
accordance with the provisions of this district for accessory uses and shall be enclosed with a
chain link fence or its equivalent in strength and protective character to a height of four feet,
but not more than six feet.
(2) Wireless communications facilities as conditional uses in all applicable districts.
(C) Development standards. In addition to the provisions of §§ 153.070 through 153.076, the
following standards for arrangement and development of land and buildings are required in the
Limited Suburban Residential District.
(1) Lot area and coverage. For each dwelling unit there shall be a lot area not less than
20,000 square feet per dwelling unit.
(a) For all other permitted uses and conditional uses, the lot area shall be adequate to
meet the sanitation requirements of the County Board of Health, but shall not be less
than that prescribed for such use.
(b) Only one principal use shall be permitted on a lot, and such lot shall not be covered
more than 20% by structure.
(2) Lot width. For a one - family dwelling there shall be a lot width of 100 feet or more at the
front line of the dwelling, and such lot shall have access to and abut on a public right -of -way
for a distance of 60 feet or more. For a conditional use, the lot width shall be adequate to meet
the development standards of the Limited Suburban Residential District.
(3) Side yard. For dwellings or associated accessory buildings there shall be a total of side
yards of 20 feet or more with a minimum of eight feet on one side. For a conditional use,
except dwellings, and accessory structures thereto, there shall be a side yard on each side of a
building of 25 feet or more.
(4) Rear yard. For main buildings there shall be a rear yard of 20% or more of the lot depth,
except that a rear yard of more than 50 feet shall not be required.
(5) Maximum height. No dwelling structure shall exceed 35 feet in height. Maximum height
for other structures shall not exceed a safe height as determined by the Fire Chief and as

§ 153.023 R -4 SUBURBAN RESIDENTIAL DISTRICT.

access to and abut on a public right -of -way for a distance of 60 feet or more.
(3) Side yard. For a two - family structure there shall be a total of side yards of 20 feet and a
minimum side yard of eight feet on one side.
(4) Rear yard. A minimum rear yard of 30 feet shall be required.
(5) Maximum height. No dwelling structure shall exceed 35 feet in height. Maximum height
for other structures shall not exceed a safe height as determined by the Fire Chief and as
reviewed and accepted by the Planning and Zoning Commission.
(E) Development standards for three through eight family dwelling structures. For three up to eight -
family dwelling structures, the following standards shall apply:
(1) Lot Area. For each dwelling unit there shall be a lot area of 8,500 square feet.
(2) Lot width. Minimum lot width shall be 150 feet.
(3) Side and rear yards. Structures shall be set back from all side and rear property lines a
minimum of 25 feet.
(4) Maximum height. No dwelling structure shall exceed 35 feet in height. Maximum height
for other structures shall not exceed a safe height as determined by the Fire Chief and as
reviewed and accepted by the Planning and Zoning Commission.
(5) Traffic and parking concept. A proposed traffic circulation and parking concept shall be
shown on the development plan, indicating ingress and egress points, resident and guest
parking as well as provision for service vehicles.
(6) Open space concept. The proposed open space concept shall be shown on the,
development plan, indicating proposed recreational or other amenities such as parks, play
areas, pedestrian/bikeway paths, etc., and the proposed ownership, operation and maintenance
of such areas shall be described.

important that all properties in Dublin have a Dublin zoning classification. The City of
Dublin consequently began the process to establish a Dublin zoning classification for many
properties throughout the City. This rezoning will ensure consistent administration within the
City to protect the health, safety, and welfare of its citizens.
In 2003, the City initiated the process of assigning Dublin zoning on your property(s) and
others in the area to the most equivalent zoning classification. It is proposed that this property
be placed in the Dublin R -2, Suburban Residential District. The Dublin zoning
classifications are similar in nature to the land uses and development patterns that exist today.
The Dublin R -2, Suburban Residential District regulations are attached for reference.
An informational meeting was held on October 7, 2003 to address questions related to the
rezoning process and proposed zoning classification. The rezoning received a first ordinance
reading at City Council on September 8, 2003 and was reviewed and approved by the
Planning and Zoning Commission on January 8, 2004. The City is having the rezoning
reheard by the Planning and Zoning Commission in April in order to ensure that all current
property owners are cognizant of the status. Following that, the rezoning will be sent to City
Council for a public hearing and final vote. You will be notified of both the Planning and
Zoning Commission and City Council meetings.
