A RESOLUTION ACCEPTING THE LOWEST
AND BEST BID FOR THE AVERY ROAD
WATER TOWER RE- COATING PROJECT
WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the
Dublin Code, for the Avery Road Water Tower Re- Coating Project; and
WHEREAS, Council has determined that the bid submitted by M.K. Painting, Inc.
constitutes the lowest and best bid; and
WHEREAS, Council has determined that there may be a legitimate need to declare
the relocation of the utilities in connection with the above - referenced project as a
"single source" procurement, for reason that the company owning the utilities in
question has the exclusive rights to relocate such utilities.
NO THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
L 4L � of its elected members concurring that:
Section 1. The bid submitted by M.K. Painting, Inc. in the total amount of
$474,000 is hereby accepted.
Section 2 . The City Manager is hereby authorized to enter into contracts with M.K.
Painting, Inc. for performance and completion of the Avery Road Water Tower Re-
- Coating Project pursuant to the Advertisement, Proposal and Contract Documents for
said project on file in the office of the City Engineer.
Section 3. This Resolution shall take effect and be in force on the earliest date
permitted by law.

Project Update
On June 10, 2010, an informational memo (a copy is attached for reference) was provided to Council
that outlined the project scope and timeline for the re- coating of both the Avery Road and Blazer
Parkway water towers. Subsequently, staff conducted the two mandatory pre -bid meetings. These
meetings were well attended by perspective contractors for this project who provided valuable
feedback to staff. Based on the information learned, and with the concurrence of the Finance, Parks
and Open Space Directors and Washington Township Fire Department staff, staff issued the following
addenda to the bidding documents and scope of the project:
• Removed the Blazer Parkway Water Tower re- coating work. This will be
advertised for bids again in early 2011. With the complexity of the work and
the uncertainty of the weather later in the fall, the previously determined six
week schedule for each tank was not sufficient.
Retained schedule for completion of November 19, 2010. This allows more
time in the schedule for expected non -work days due to weather and high
winds.
• The Parks and Open Space staff will not be able to use the base of the Avery
Road water tower for a period of time during the re- coating. Staff will retain
an area within the existing fencing for equipment storage. The integrity of
the containment would be compromised and the productivity of the
contractor would be impacted, if staff needed to repeatedly enter during the
day.
Reduced the amount of time required for total containment of the Avery
Road water tower. The final coating, including the graphics, will be rolled
onto the water tower (not sprayed). This change will increase productivity
of the contractor as well and have a positive effect on the cost of the project.
This is the first re- coating of the whole exterior on the water towers since the installation of the special
graphics package (children playing silhouettes) in the mid- 1990's. The roof of the Avery Road water
tower was re- coated in 2002, as the original coating had deteriorated.

Bid Acceptance Background
On Tuesday, June 15, 2010, five (5) bids were received, publicly opened and read for the Avery
Road Water Tower Re- coating project. Staff has reviewed all bids. The Engineer's estimate was
$515,000. The 2009 budgeted funds for construction of this project were $515,000 (EW0102).
M.K. Painting, Inc. submitted the lowest and best bid of $474,000. A summary of the bids is

Staff has thoroughly reviewed the M.K. Painting, Inc. bid. The City has no previous experience
with M.K. Painting, Inc.; however, staff did contact several of the references provided as
required in the bid proposals and has found favorable remarks regarding their work. They have
painted water towers in the following locations: City of Marquette, Michigan; City of Kent,
Ohio; Universal City, Texas; City of Huber Heights, Ohio; and Howard County, Maryland.
We anticipate the work to begin mid -July and be completed in approximately eight to ten weeks,
which is well within the contract completion requirement of November 19, 2010. Staff will be
retaining the services of a third party inspection firm to assist staff in determining compliance
with the contract specifications and assuring a quality project.
Recommendation
Staff recommends approval of Resolution 30 -10, accepting the bid of M.K. Painting, Inc. in the
amount of $474,000 as the lowest and best bid, and authorizing the City Manager to enter into a
contract with M.K. Painting, Inc. for this project.

Summary
The 2010 -2014 Capital Improvements Program provides for water tower maintenance in the Water
Distribution System - Non -Major Projects (EW0102). In 2009 and 2010, there is $515,000 and
$495,000 budgeted for exterior painting of the Avery Road and Blazer Parkway water towers,
respectively. This provides a total budget of $1,010,000 for this work. Staff has developed the plans
and specifications for this work to re -coat the tanks with the same graphics packages and a similar high -
performance coating system that is currently on the structures.
For the Avery Park water tower, the existing coating on the tank must be removed entirely before it can
be re- coated. This will be accomplished with an abrasive blasting process. Both the blasting and the re-
coating of the tower will require that the tower be encapsulated in a tent -like structure, similar to that
shown in the picture below. The tenting will not only contain the removed paint and blasting material, it
will aid in eliminating over -spray on homes, cars, and park facilities in the area of the tower. The Parks
and Open Space staff will be able to continue to operate from this water tower during this project.

The Avery Park water tower hosts several wireless communications facilities. Staff has already notified
these carriers of the pending project. A detailed coordination meeting will be held once the contractor is
selected and their work schedule has been determined.
We have requested that bids include two prices for the work on the Blazer Parkway water tower- one to
include complete removal of the existing coating and one to simply apply an over -coat. The existing
coating is not exhibiting the same deterioration as the coating on the Avery Park tower. We would like
to know the cost difference before determining the most cost effective method to re -coat this water
tower. This water tower will also be contained, as demonstrated in the photo, to avoid over- spray.
Also, staff has coordinated with the owners of 5515 Parkeenter Circle for the use of the parking lot at
the southwest corner of Blazer Parkway and Rings Road. This will be for the use of both the contractor
and the firefighters stationed at this location for the duration of this part of the project. The fire station
will also be able to continue their operations from this location during the project.
Staff placed this work out to bid on May 18, 2010. Twelve contractors have downloaded the bid
documents as of June 3"'. The bid opening is scheduled for Tuesday, June I5, 2010. Due to the unique
site operations at both of the water towers — the Parks and Open Space work area at Avery Park and the
Washington Township Fire Station # 95 at Blazer Parkway — we are requiring the contractors to attend a
mandatory pre -bid meeting on Wednesday, June 9, 2010 at either 10 a.m. or 2 p.m. These meetings will
include site visits to both locations. We want the contractor to see and understand the site conditions
and operations to ensure that they provide the best cost possible and to avoid additional costs when they
begin the work. Barring any unusual circumstances with the bidding process, the bid acceptance
resolution is scheduled to be on the July 1, 2010 Council meeting agenda.
Staff believes that the work at each tower will take approximately six weeks to complete and has
selected a completion date of November 19, 2010.
