I
ORDINANCE AUTHORIZING AND DIRECTING
THE EXECUTION AND DELIVERY OF A GRANT
OF EASEMENT AND OTHER RIGHTS; AND
DECLARING AN EMERGENCY
C BE IT ORDAINED by the Council of the Village of Dublin, State of
~
Ohio, of the elected members concurring:
SECTION 1. That the Mayor, the Village Administrator and the
Clerk-Treasurer be, and they hereby are, authorized and directed to
execute and deliver to Muirfield Ltd. the grant of easement and other rights,
a copy of which is attached hereto and hereby made a part hereof.
SECTION 2. That this ordinance be, and the same hereby is,
declared to be an emergency measure necessary for the immediate
preservation of the public health and safety for the reason that the granting
of said easement and other rights is immediately necessary in order for
C commencement of construction of a sewer system serving propertie s of the
Village of Dublin, Ohio; and that this ordinance shall take effect and be in
force immediately upon its passage.

As of January 14, 1974, the Village of Dublin entered into a Sewer
Development Agreement (the "Sewer Agreernent") with Muirfield Ltd. and
certain other parties, pursuant to which Muil'field Ltd. was appointed and
designated agent of the parties thereto for the pu rpos es of constructmg~ or
causing to be constructed, certain sewer facilities described therein.
On or before April 1, 1974, easements have been executed and de-
,.., livered by certain private parties to the Village of Dublin for the purpose of

"". the construction and maintenance of the sewer facili.ties described in th~
Sewer Agreeluent.
The Council of the Village of Dublin, Ohio, 111.0t 011 April I, 1974,
and by action duly taken, authorized and directed the Vi.Hage Mayor) VUlage
Adluinistrator, and Clerk-Treasurer to execute and deliver to Mui.:dield Ltd. s
as agent for the parties to the Sewer Agreelnent) an casen;.c:nt over nh~ abov(~-
luentioned private properties, and to grant to Mui:dield Ltd. as a.gent for the
parties to the Sewer Agreement, the right to enter upon rights-cf-v.ay owned
by or over which Dublin has jurisdicti.on and control, for the purpos e of the
C01HJ-cruction of sewer facilities pursuant to the Sewer Agreement.

- GRANTEE'S OBLIGATIONS

Fo'r purposes of the foregoing,"comp1etion of the sewer facilities
pursuant to the provisions of the Sewer Agreement" shall be deemed to have
occurred 60 days after the 'same shall have become operational pursua:p.t to
~8(c) of the Sewer Agreement and the Village Engineer shall have certified
to the Village Administrator that the same has been completed.
Grantee, for itself and its successors and assigns, hereby agrees
. to indemnify and save harmles s the Grantor from and against any and all
(/IlIa claims, liability, and damages of any nature whatsoeyer in connection with
, the constructi.on activity and work performed pursuant to the Sewer Agree-
'-' Inent by or on behalf of the Grantee on or within the boundaries of such ease-

ment and the rights of way hereinbefore described.
Grantee, also, shall restore all areas within the easement and rights
of way hereinbefore described in which construction activity or work is per-
formed pursua.nt to the Sewer Agreement to substantially as good or better
condition than existed at the Hcne of commencement of such construction
actiyity or work.

DEED OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That Oma Karrer, of the
t' Village of Dublin, .County of Franklin, and State of Ohio, in
consideration of the sum of One Dollar ($1.00), the right to
tap the sewer within the easement granted herein upon payment
of applicable fees, and other valuable considerations to her
paid by the Village of Dublin, the receipt of which is hereby
acknowledged, does grant and release to the Village of Dublin,
its successors and assigns forever, a right of way over and through
the following real estate in said City, and described as follows:
Situated in Washington Township, Franklin County, Ohio,
being a part of Survey No. 4852 (at times also designated as
Survey No. 2419) U.S. Military Lands, also being a 8.044 acres
tract, as conveyed to , by Deed Book ,
Page , Franklin County Ohio Recorder's Office, and said
permanent easement, 20 feet in width and temporary easement
40 feet in width, being more particularly bounded and described
on the attached Exhibit "A".

for the purpose of constructing, using and maintaining a sanitary

force main and access road, tributary connections and appurtenant
works in any part of said strip, including the right to clean, repair
and care for said main, together wj.th the right of access to said
strip for said purpose.
To have and to hold said premises to said Grantee, its successors
and assigns forever, for the uses and purposes hereinbefore mentioned.
IN WITNESS WHEREOF, the said Oma Karrer, who hereby releases
