HomeMy WebLinkAbout17-74 Ordinance , . t_ /7-'7 'f ORDINANCE NO. , VILLAGE OF DUBLIN, OHIO ORDINANCE AUTHORIZING THE RENTING OF PROPERTY NOT NEEDED FOR ANY MUNICIPAL PURPOSE BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, , of the members elected thereto concurring: ,.., ~ SECTION 1. That the following described real estate belonging to II iiIIo.,.,-, the Village of Dublin, Ohio, is not needed at this time for any municipal purpose. to-wit: Situated in the State of Ohio, County of Franklin, Village of Dublin, Virginia Military Survey Nos. 2542 and 2543. and being a part of a 15.957 acre tract conveyed by deed to the Village of Dublin as recorded in Deed Book 3391, Pages 123, 124 and 125, Recorder's Office, Franklin County, Ohio, and more particularly described as follows: Beginning at a railroad spike in the centerline of Post Road, said railroad spike also being the northwest corner of a 1. 343 acre tract of land owned by W. M. Thomas as recorded in Deed Book 1386. Page 96; Thence N. 57053' 30" W. a distance of 13 feet to a railroad spike in the centerline of said Post Road; Thence N. 1020' 37" W. a distance of 263. 97 feet to an irort pin be ing the northwe st corner of said 15.957 acre tract; Thence N. 880 16' 59" E., a distance of . ,..... approximately 200 feet to a point in the west bank of Indian Run, said !; point being in the northerly property line of said 15.957 acre tract; \ Thence southeastwardly a distance of approximately 325 feet and .... following the west bank of said Indian Run to a point in the northerly boundary of said 1. 343 acre tract owned by W. M. Thomas; The nc e I S. 880 50' 13" W. a distance of approximately 360 feet to a railroad spike in the centerline of said Post Road, said railroad spike being the true place of beginning, together with the buildings located thereon. Said premises also known as 5614 Post Road, Dublin, Ohio. SECTION 2. That the Mayor, the Clerk-Treasurer and the Village Administrator be, and they hereby are, authorized to enter into a rental agreement renting said real estate to the highest bidder according to law upon the following terms: The rental agreement shall be on a month-to-month tenancy; The tenant must deposit with the Village $150.00 as a security deposit; Rent shall be paid in advance; The tenant shall pay all utilities; r The tenant shall keep the grass mowed and the premises in a clean and ""- order ly condition; The tenant must remove all junk vehicles from the the premise s; and tenant must return the premises at the end of his tenancy in good condition, normal wear and tear excepted. Ii SECTION 3. That the Village Administrator be, and he hereby is, ~ authorized and directed to advertise for bids for the rental of said property once a week for five (5) consecutive weeks in a newspaper of general '1. " - - circulation within the Village of Dublin. SECTION 4. That the Mayor, the Village Administrator and the Clerk-Treasurer be, and they hereby are, authorized and directed to enter into an interim rental agreement with Mr. & Mrs. Richard Moats re~pecting the rental of said premises on the terms set forth above at a monthly rental ,. of $130.00 per month for the time period commencing with the execution of ....... such agreement and ending with the execution of a new rental agreement with the highest bidder as provided for in Section 2 hereof. I SECTION 5. That in the event that Mr. & Mrs. Richard Moats are not agreeable to the interim rental agreement set forth in Section 4 hereof, the Village Administrator, with the assistance of the Village Solicitor if necessary, shall take the necessary steps to cause the Moats to vacate the premises forthwith. SECTION 6.
