()Q-7'j , VILLAGE OF DUBLIN, OHIO AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR TO ADVERTISE FOR BIDS FOR GARBAGE AND RUBBISH COLLECTING AND HAULING SERVICE TO THE VILLAGE WHEREAS, the present contract for garbage and rubbish collecting I"'" and hauling for the Village expires March 1, 1974; and i ~ WHEREAS, there is need for a contract for said services subsequent - to said date: NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, ~ of the elected members concurring: SECTION 1. That the Village Administrator be, and he hereby is, authorized and directed to advertise for bids for garbage and rubbish collecting and hauling service to the Village of Dublin, Ohio, for the period commencing March 2, 1974, and ending February 28, 1976, according to the following contract specifications: Garbage and rubbish to be collected from an. residences in the Village of Dublin, Ohio, on the same specified day of each week. If a legal holiday falls on said specified day, then the garbage and rubbish collection may be made on the next day of that week. The term rubbish shall include all household trash, refuse and other waste matter such as bottles, tin cans, food, food containers, ashes, cinders, tree and hedge clippings, grass trimmings, leaves and other waste material accumulating about residential property. The term rubbish does not include waste material accumulated in ~I the construction, remodeling or repair of buildings. The said garbage and rubbish to be removed by contractor must be where contractor can back truck to within 5 feet of containers. The householders' garbage and trash containers shall be twenty (20) or thirty (30) gallons, and shall not exceed one hundred twenty (120) gallons per residence per week. Cans must have tight fitting lids and handles. Plastic bags must be tied. Contractor is to replace lids on containers. Business trash is not to be included in normal household trash. Any tree or hedge clippings shall be tied in bundle s not over four feet (4') long by property owner or placed in plastic bags. Contractor is not required to pick up more than two (2) thirty (30) gallon plastic bags of trimmings or two bundles of such trimmings per home per week. Contractor shall remove weekly all refuse and trash in Village owned trash cans, not to exceed eight (8) in number. Contractor must have closed packer type truck to pick up rUBbish and garbage. The relationship between the Village of Dublin and the contracting party shall be solely contractual and the contractor shall furnish all equipment and labor for all service s to be performed. Contractor shall carry industrial compensation insurance of the State of Ohio and pay all lawful payroll Eleduction and unemployment compensation payments due any governmental agency. Contractor shall be re sponsible for any negligence of -, contractor or any of contractor's agents, officers or employee s. All '" equipment, including trucks and automobiles, but not limited thereto, used in said garbage and trash collection shall be proteCted by public liability and property damage insurance in the amount of at least $50,000.00 to protect ...... the Village of Dublin, Ohio, and its inhabitants against any and all negligent acts of contractor, his agents or employees. Bids shall specify a lump sum price for each month during the continuance of the contract for garbage and rubbish collecting and ha.uling serviee for all of the existing residences in the Village of Dublin at this time and bids shall also specify an additional price for each additional re sidence built and occupied or annexed to the Village after the awarding of this contract and said Bid shall be on a monthly basis for each such additional '.. .. Of: ... residence. The contract price may be modified according to law during the term of this contract to compensate for increased cost of disposal. The i contractor shall be paid on or before the 10th day of each month. That this ordinance be, and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the public health and safety for the reason that garbage and rubbish collection is presently needed to protect the health and safety of the residents of the Village, and that this ordinance shall take effect and be in force immediately upon its passage. WITNESSETH THAT: WHEREAS, the Village of Dublin desires to have garbage and. rubbish oolleo'ted in the Village, and. Swenson Sanitation Servioes, desires to oolleot and dis- pose of the same, for the period oommenoing Maroh 2, 1974 and ending on February 28, 1976: and WHEREAS, by ordinanoe of the Village of Dublin, the Village Administrator and the Clerk-Treasurer haw been authorized on behalf of said Village, to enter into a oontraot with said SWenson Sanitation Servioes, as an independent oontraotor, for said purpose: NOW, THEREFORE, in oonsideration of the mutual promises herein given, the Village and Contraotor agree as follows: 1. Contraotor shall oolleot the garbage and rubbish from all residenoes in the Village of Dublin, Ohio, on the same speoified day ot :eebweek. If a legal holiday falls on said speoified day, then the garbage and. rubbish oolleotion may be made on the next day of that week. 2. The oontract prioe may be modified aooording to law during the term of this oontract to compensate for the inoreased cost of disposal. 11. The Village agrees to pay oontractor for servioes rendered for eaoh month on or before the loth day of the following month. 12. S'aid oontraot to be oanoellable by the Village of Dublin, without liabUit upon sixty day written notioe of oanoellation to the oontraotor. .
