FORM NO. 10148 ReIn May 20, 199 1 19 The regularly scheduled meeting of the Dublin City Council was called to order by Mayor Jan Rozanski at 7:32 P.M. on Monday, May 20, 1991. Mr. Strip led the Pledge of Allegiance. Members of Council present were: Mr. Amorose (arrived at 7:39 P.M.), Mr. Campbell, Mrs. King, Ms. Maurer (arrived at 7:39 P.M.), Mayor Rozanski, Mr. Strip and Mr. Sutphen. Mr. Hansley, City Manager, and Mr. Smith, Law Director were also present. Mr. Sutphen moved to approve the minutes of the May 6, 1991 meeting of Council. Mr. Strip seconded the motion. Vote - Mr. Strip, yes; Mr. Campbell, yes; Mrs. King, yes; Mr. Sutphen, yes; Mayor Rozanski, yes. Presentation of Certificate Recognizing Dublin as a 1992 Quincentennial Community. "Christopher Columbus" was present to present the certificate to Mayor Rozanski. Ms. Priscilla Mead, 1992 Quincentennial co-chairperson of the local jurisdictions and suburban communities, was also present to give a brief background on the events and the two themes of the Quincentennial Celebration, those being "Discovery" and "Our Ethnic Heritage". Mayor Rozanski presented the certificate to Mrs. Joy Hansley, Dublin's representative to the Quincentennial Celebration Committee. Officer Jeff Moody of the Dublin Division of Police introduced Nando, the recent canine addition to the Division, trained in tracking and narcotics work, who will also be used as a positive public relations tool for the Division of Police. Mayor Rozanski commented regarding the recent resignation of Mrs. Nan Metz, Finance Director for the City of Dublin for the last ten years, who will be taking a job with the National City Bank. Mayor Rozanski expressed the appreciation of all and wished her well in her new position. Correspondence There was no objection to a request for a C1, C2 liquor permit from Speedway, Inc. for their location on West Dublin-Granville Road. Comments from Visitors (items not on agenda). None. Ordinance No. 13-91 - Ordinance Adopting Five Year Capital Improvement Program. Tabled Ordinance. To remain on the table until a decision has been made regarding the force main versus gravity sewer. Mr. Foegler said that the report is scheduled to be presented to Council at the meeting of July 1, 1991. Second Reading. There will be a third reading of the Ordinance at the Council meeting on Monday, June 3, 1991. Ordinance Continued Emergency. No. 34-91 Employment of Ordinance Authorizing Contract for the City Manager. First Reading. Mr. Amorose introduced the Ordinance. Mayor Rozanski commented that the evaluation of the City Manager is a rather lengthy process. Mr. Amorose moved to waive the three time reading rule and treat as an emergency. Ms. Maurer seconded the motion. Vote - Mr. Campbell, yes; Mrs. King, yes; Mr. Sutphen, yes; Ms. Maurer, yes; Mr. Strip, yes; Mr. Amorose, yes; Mayor Rozanski, yes. No. 35-91 Ordinance First Reading. Establishing a Records Mr. Amorose introduced the Ordinance. Mrs. Metz explained that all municipalities are required to create a City Records Commission. She also said that the City would be using the rules as established by the Ohio Historical Society for records retention. Mr. Campbell noted that the Ordinance reads that the appointment of a citizen to the Commission is appointed by the City Manager. He said that he was not sure that under the City's Charter that the City Manager has the authority to appoint a member of a commission, suggesting that that person perhaps should be appointed by the Council as opposed to the City Manager. Mr. Amorose said that he would like the Council to have the right to approve the City Manager's appointment. Mr. Smith will research the matter further. There will be a second reading of the Ordinance at the next regaularly scheduled Council meeting on June 3, 1991. Ordinance No. 36-91 Ordinance Replacement and Upgrading on U.S. 33. Authorizing Guardrail First Reading. Mr. Strip introduced the Ordinance. It was noted that the City of Dublin's share of the cost would be $340.00 with the State of Ohio's cost being $11,320.00. Vote on the Ordinance - Mr. Sutphen, yes; Mrs. King, yes; Ms. Maurer, yes; Mayor Rozanski, yes; Mr. Amorose, yes; Mr. Strip, yes; Mr. Campbell, yes; Other Discussion of Ward Adjustment Process Mr. Bowman reported that the City Charter requires that the wards be adjusted in a minimum time period of 10 years when census information is available, and that the ward adjustment plan must be adopted by July 1, 1991. He noted that the memorandum distributed to Council gives the population by ward, indicated how much the wards will have to change to get a proper distribution, and suggested a process by which Council can vote by July 1, 1991, as mandated by the Charter. Mr. Bowman said that the ideal ward size, based on the population of 16,888, would be 4,222; at present the ward sizes vary from 1,279 to 8,321. Mr. Campbell suggested that it would be helpful, in making the boundary adjustments, if staff would provide some indication of the population in the various neighborhoods around the periphery of Ward 4 so that there would be an indication of how many people would be changing wards and how that would affect the boundary adjustments. Mr. Campbell also said that he envisioned staff providing several alternatives for Council consideration. Mrs. King suggested that Mr. Don Spicer or Ms. Karen Cotton at the Franklin County Board of Elections might be interested in talking with the City staff, since the precinct boundaries would be affected and that they would appreciate coordination. Mrs. King also wondered to what extent the census information is provided on a precinct basis. Mr. Bowman said that the block information from the current census was minimal, noting that, for instance, the whole mid- section of Brand, Avery and Coffman is almost one block of over 3,000 people. He said that to get a more definitive neighborhood, smaller analysis that staff will go out and actually count other geographical areas, using persons per household figures derived from the census to make estimates in those areas. Precinct boundaries, he said, do not follow it at all, being based on block or either county or other municipal lines. Mrs. King noted that one neighborhood had been split into three different parts (Muirfield) and said that she hoped that that could be avoided in the final analysis. Mr. Bowman said that Exhibit B (map) bears no relationship as to how the boundaries will be adjusted. Mayor Rozanski suggested that members of Council pass on their comments to Mr. Bowman. Whether or not the public participation meeting was necessary was discussed. It was decided to have the appropriate information available prior to the next Council meeting at 6:30 P.M. on June 3, 1991. Discussion Regarding Boundary Change/Fire Issue Mr. Smith said that he would prefer that Council wait until the oral argument before the Supreme Court on June 4, 1991 before discusssing the issue. Reports from Council Committees Mr. Strip reported that the Finance Committee had two bed tax applications which were reviewed by the committee. He said that the committee had elected to defer one of them, lacking sufficient information. Regarding one, the Committee did have a recommendation to Council. The Dublin Youth Athletic Association received a bid whereby Dublin will be the host for an international baseball tournament. Mr. Strip made the following recommendation which was unanimously approved by the Finance Committee that the DYA be granted the application from bed tax as follows: 1. an expenditure of approximately $18,000 for removable, but reusable long-term fencing for events. It is the intent of the DYA that after the event they will donate the fencing back to the City. 2. an outright grant of $5,000 to be used for the event. 3. an allotment of $5,000 to be used for "seed money" with the understanding that, based upon their sponsorship, ticket sales, etc. that if the tournament ends up in the black that the City will be refunded up to $5,000 of the funds available. The terms above are subject to the approval of the Parks and Recreation Department with which they must coordinate the event. Mr. Strip also said that one stipulation was that all events will be held in Dublin, such as the banquet, not outside the city. Mr. Strip also said that his understanding was that Mr. Jimmy Crum will be the speaker at the banquet. Mr. Strip moved to accept the above recommendation of the Finance Committee. Reported that he would be glvlng to Council new Cty street maps which had been prepared, and requested that Council members report to him any errors, misspellings of street names, etc. Mrs. Metz 1. Regarding the Dublin Women's Club application for bed tax funds, Mr. Strip said that that application had been deferred until a few questions had been answered by representatives of the organization. Mr. Willis 1. The Avery Road/Shier-Rings Road traffic signal which has been on flasher for approximately a week and a half was put in operation early on this date. 2. Regarding the Dublin Village Center/Village Parkway traffic signal, bids are scheduled to be opened on Wednesday, May 29, 1991. Chief Ferrell 1. Reported that the Memorial Tournament went well. Mr. Hansley noted that Lt. Geis of the Dublin Division of Police who coordinated the police and sheriff departments involved in the activity did an excellent job. Mayor Rozanski said that he had heard only good reports regarding traffic and other police-type activities. Council Roundtable Discussion Mr. Strip 1. Expressed best wishes to Mrs. Metz. Ms. Maurer 1. Expressed appreciation for Mrs. Metz's support and friendship. 2. Reported that at the recent goal setting meeting that Council reviewed the 1990, 1991 goals and were very pleased at the progress being made towards many of them. Also reported that Council created some tentative goals for 1992 which are now being reviewed by the City's boards commissions and committees and that the boards, commisions and committees are being asked to make suggestions of goals that they feel are important to the City. "'". 1".".1 19 Page Six Ms. Maurer also said that she felt that this type of process was absolutely essential in a Council/Manager form of government, and that the City should feel very positive that this type of process had been so successful in Dublin. Mr. Amorose 1. Thanked Mrs. Metz for a "great job" in the many years she has served the City of Dublin, saying that he was glad that she would continue to be a resident of Dublin. 2. Commented on the fine job that the Division of Police did with the Memorial Tournament, and also had many favorable comments with regard to the "Opening of the Northwest Passage" party. 3. Asked Mr. Foegler about the water level in the water towers, specifically with regard to the warmer weather and additional water consumption. Mr. Hansley said that the Thursday or Friday before the Memorial Tournament that Columbus was prepared to ask Dublin to use the warning system to restrict sprinkling use, coming within 12 hours of some type of modified sprinkling use. Mr. Foegler noted that this is the third driest May on record. Mr. Hansley also pointed out that it is difficult to identify inflow and infiltration when one does not have sufficient rainfall. Mrs. King 1. Thanked Mrs. Metz for a fine job and wished her the very best. 2. Expressed her feeling that the Memorial Tournament atmosphere had been very exhilarating and positive. 3. Asked about the work progress on the Muirfield Drive extension. Mr. Hansley suggested that one visit the south side of the project to see a great deal of activity, almost on a daily basis, but that you cannot see that activity from Brand Road. Mr. Willis said that the project is on schedule. Re also said that the bicycle underpass would be completed within the next couple of days. Mr. Campbell 1. Agreed that there is a great deal of activity on the southern area of the project (Muirfield Drive extension). 2. Had words of praise for the services of the Washington Township medics in a personal situation, as well as the capable assistance of the Concord Township medics. Commended the Dublin Division of Police for their handling of the Tournament, specifically as regards traffic. 4. Also commended the City staff for their cleanup efforts prior to the Tournament. 5. Said that he appreciated the extra effort he had observed recently from the workers of Johnson Disposal. 6. Wondered if it might not be a little less confusing for the general population to try and have a sign that says "Welcome to Dublin", not just at the gateways. He also suggested that perhpas "Enter Corp" and "Leave Corp" signs should be placed, indicating the differentiation between the City and the township boundaries. 7. Noted that it is difficult to tell when you can cross S.R. 161 at Frantz Road, wondering if perhaps a Walk signal could be placed there. Mayor Rozanski 1. Expressed sincere thanks to City staff for the cleanup program. 2. Noted that the number of building permits issued in April was higher then at anytime since June of last year. Mr. Harding 1. Read the following statement - "An article in the May 10, 1991 Columbus Dispatch , Alcohol, chaperoning were bad mix,' indicated that six part-time summer recreation employees were involved with alcohol abuse that led to disciplinary action by the City. We would like to take this opportunity to clarify this matter. The artcile stated that six part-time summer recreation employees - Brian Shipley, Nancy Bell, Tim Bruce, Mike Mitchell, Kendall Redman and Amy Barghausen- were banned from future city employment. It continued to state that these six individuals were accused of alcohol abuse. It should be noted that there was no formal disciplinary action levied against any of these individuals. However, the City did exercise its right not to rehire the above named individuals again in 1991. It should also be noted that the investigation file indicates that in he case of Kendall Redman, there was no evidence of drinking on duty. However, she is not eligible for future employment with the City of Dublin until she agrees to take a polygraph examination. Last summer's investigation revealed conflicting statements. In an effort to uncover the truth and to determine whether or not the allegations contained merit, the City decided to use polygraph examinations as an investigative tool. Consequently, a significant number of individuals were asked to take a polygraph examination. These individuals were informed that taking the polygraph was a condition of future employment and that if they were not willing to take the polygraph, they would be ineligible for future employment." FORM NO. 10148 ReI 19 Page Eight Chief Bostic announced an Open House at Station 93 on Brand Road on May 25, 1991 from 12:00 to 5:00 P.M. Mr. Strip moved to adjourn to Executive Session to discuss land acquisition. Mr. Sutphen seconded the motion.
