FORM NO. 10148 ReIn May 6, 1991 19 The regularly scheduled meeting of the Dublin City Council was called to order by Mayor Jan Rozanski at 7:30 P.M. on Monday, May 6, 1991. Mrs. King led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mr. Campbell, Mrs. King, Mayor Rozanski, Mr. Strip and Mr. Sutphen. Ms. Maurer was absent (excused). Mr. Hansley, City Manager, and Mr. Smith, Law Director, were also present. Mr. Amorose moved to approve the minutes of the April 15, 1991 meeting of Council as amended by a memo dated May 3, 1991. Mr. Sutphen seconded the motion. Vote - Mr. Strip, yes; Mrs. King, abstain; Mr. Amorose, yes; Mr. Sutphen, yes; Mr. Campbell, yes; Mayor Rozanski, yes. Mayor Rozanski read a Proclamation recognizing "National Police Week", May 13. 19, 1991, and then presented the signed Proclamation to Officer Susan Sedlock of the Dublin Division of Police. Correspondence There were no objections to two requests for permanent liquor permits. 1. Biddie's Inc., 86 South High Street - D1, D2. 2. Continental Sawmill Inc., 6953 Dublin Center Drive - D5. Comments from Visitors (items not on agenda). Mr. Michael Patton, 8155 Glencree Place, representing Dublin Youth Athletics, said that his group would be making a formal request to the City Council for Bed Tax Funds at the next meeting. The request would be for funds to help the DYA sponsor the 1991 14 Year Old World Series, an event to be held at Avery Park from August 1-11, 1991. He said that the event would be an annual event, and that it is an international tournament with 20 teams, 17 teams from the continental United States with the remaining three teams being from Brazil, Puerto Rico, and a third team from either Korea or Japan. Each team will have 20 participants, 17 players and three coaches. Attendance to be expected would be 2000 persons per day during the week and 4000 persons per day on the weekends. Mr. Patton said that additional revenues will be generated through corporate sponsorships, and that the goal will be to promote businesses, parks, etc. in Dublin as well as baseball in Dublin, Ohio. Mr. Patton also said that they would be requesting the purchase of a portable fence which, after the tournament, will be given to the Parks and Recreation Division of the City. Responding to a question from Mrs. King, Mr. Patton said that the tournament is sponsored by the Continental Amateur Baseball Association (headquartered in Columbus), a non-profit organization. Mr. Strip requested that the amended application be submitted as soon as possible so that the Council Finance Committee can review the application prior to making a recommendation to Council. Ms. Kathy Borinq of 8227 Glencree Place commented regarding the integrity test, saying that she questioned the validity of the test, noting that the City has had other embarrassments and problems in the past with employees, and no testing was initiated. Ms. Boring also questioned the information being given to the media regarding Mr. Justice, saying that she thought that personnel matters were confidential. She felt that the City was targeting a very vulnerable group of people, discouraging some previously employed hard working and loyal young people. Mr. Harding cited research done by the American Psychological Association in regard to this particular test using control groups. He also noted that the two recently hired temporary people are not being paid double the salary and that they are subjected to securi ty checks, a full criminal history screening by the temporary employment agency. Mr. Campbell said that he personally did not like the test, but also said that Council, in light of past incidents, felt that the City needed to elevate its hiring practices. Mr. Campbell once again pointed out that Council, according to the Charter, does not have the authority to hire or fire employees. Mr. Harding noted that as a result of the Public Records Act that employment related documents held by a government entity are not confidential, but are a matter of public record. Those that are considered to be confidential are medical records and any ongoing criminal investigation records. Mr. Hansley noted that the City had offered, especially to returning employees, at City expense, to take a polygraph examination upon failure of the integrity test. He did say that locally there was a high correlation between the results of the integrity test and the polygraph examination. Mr. Strip agreed that testing in itself is a good thing, but that this test has too high a margin of error and that he was publicly, as he had before, asking the administration to reconsider using this test, which has resulted in heartbreak, dissension and unhappiness. Mr. Hansley said that the Dublin City Schools use a similar technique, a perception test, which, however, is given orally, but that it was not possible for the City to test approximately 90 employees orally in such a short period of time. Mrs. King stated that the safety of all persons is of the ultimate importance. She also stated that policies must be in place, and supervisors must be paying attention to those policies. Mayor Rozanski noted that the test is being given to all temporary, part-time and seasonal employees, regardless of age, position, etc. RECORD OF PROCEEDINGS Minutes of Dublin City Council Meeting Meeting DAYTON I FGAI BLANK CO FORM NO 10148 ReIn May 6, 1991 19 Page Three Ordinance No. 13-91 Improvement Program. - Ordinance Adopting Five Year Capital Tabled Ordinance. Mayor Rozanski requested that this Ordinance remain on the table until a decision has been made regarding a force main versus gravity sewer. ORdinance No. 21-91 - Ordinance Amending Section 2 ("Wage and Salary Structure/Administration"), Subsections A and B of Ordinance No. 17-90 ("Compensation Plan"). Tabled Ordinance. Mr. Strip moved to remove the Ordinance from the table. Mr. Sutphen seconded the motion. Vote - Mr. Sutphen, yes; Mrs. King, yes; Mr. Strip, yes; Mr. Campbell, yes; Mr. Amorose, yes; Mayor Rozanski, yes. Mrs. King moved to amend the ordinance by adding the language as drafted by the Law Director and the Director of Personnel and Purchasing regarding the position of Assistant City Manager. Resolution No. 04-91 - Resolution to Extend Water Line Agreement with Sherex Chemical Company, Inc. Third Reading. Ordinance No. 28-91 - Ordinance Authorizing the City Manager to Enter into a Contract with Franklin County Public Defender's Office. First Reading. Mr. Amorose introduced the Ordinance. There will be a second reading of the Ordinance at the Council Meeting on May 20, 1991. Ordinance No. 29-91 - Ordinance to Accept Lowest/Best Bid for Street Lighting at Paul G. Blazer Parkway and Dublin Village Center Drive. First Reading. Emergency. Mr. Sutphen introduced the Ordinance. Mr. Willis noted that all public projects require bonding. Ms. Grigsby referred to Section 3. of the Ordinance which mentions additional appropriations from unappropriated funds in the amount of $363,226.30 which should be $233,226,30 because $130,000.00 was previously appropriated for Paul G. Blazer Memorial Parkway. Ordinance No. 30-91 - Ordinance to Accept Lowest/Best Bid for 1991 Street Improvements. First Reading. Emergency. Mr. Strip introduced the Ordinance. Mr. Willis noted that the bids had come in well below the estimate. With the savings of approximately $100,000.00, Mr. Willis said that it was hoped that the City would do a ditch enclosure program this year. In addition, he said that he would hope to use some of the money for improvements to other intersections that are not a part of this project (curb and gutter). Ms. Grigsby noted that in Section 3. it states that funds need to be appropriated, but that these funds were also appropriated in the cash portion of the capital improvements recently passed by Council; therefore, that section of the Ordinance should simply state that it is authorized to be spent from the particular account so designated in the Ordinance. First Reading. Emergency. Mr. Sutphen introduced the ordinance. Mr. Foegler said that this would be the last of this type of legislation to be brought before Council as an emergency, and that in the future, purchase of similar services would go out to bid. Mr. Foegler said that staff is continuing to find inflow and infiltration but at a slower rate then previously. He also noted that the City is leasing for two months about 30 additional flow meters. Mr. Foegler also said that all of the manholes on the east side of the river are being inspected at this time. Mr. Sutphen moved to waive the treat as an emergency. Mrs. King seconded the motion. Other Discussion Regarding Fire Protection Issues Mr. Smith reported that the City had been notified by the Clerk of the Ohio Supreme Court that the Court has chosen to set the City's case for oral argument on June 4, 1991. Reports from Council Committees. None. Comments from Staff 1. Ms. Clarke submitted a memorandum, at Mr. Foegler's request, to Council relating to the request for five scoreboard signs at Avery Park by the D.Y.A. She noted that the 7-Up Company has fabricated score- boards for donation, the upper 40% of the sign being an advertisement for 7-Up. This type of ground sign, dis- playing an off-premise product or business, is not permitted in Dublin, and staff was requesting policy guidance from Council. She noted that the Parks Division would be responsible for installation of the scoreboards. Mrs. King suggested that Council should perhaps know the cost of a "generic-type" scoreboard, one with no company name included. Following discussion, Council members agreed that they wanted to uphold community standards, but that this year perhaps the 7-Up signs could be used for this one event (the International World Series) and that subsequently the Ci ty could perhaps purchase permanent-type scoreboards with no advertising logos. FORM NO. 10148 ReIn May 6, 1991 19 Page Six Chief Bostic reported that work is almost completed on the renovation of the 1937 fire engine. Ms. Sandra Puskarcik mentioned the "Green Sweep '91" to be held on Thursday, May 9, 1991 and Friday, May 10, 1991, and invited members of Council to participate. Mentioned the new "Dublin Magazine". Council Roundtable Discussion Mrs. King 1. Said that all should celebrate Council's ability to disagree agreeably in the public interest; that members of Council have deemed it important enough to work at it. 2. Storm water permitting. Mr. Foegler said that federal legislation presently applies to cities over 100,000 in population, but that there is a sense that that legislation will apply to smaller cities in the future. At this point Dublin is not affected by those regulations. 3. Complimented staff on the program to get all of staff involved in code enforcement. 4. Mentioned that "black velvet" is being sold out of U-Haul Truck at S.R. 161 and Sawmill Road - the lot on the south- west corner of the intersection. Mayor Rozanski noted that the lot is also being used again for used car sales on the weekends. Ms. Clarke said that the City has an agreement with Shamrock Towing to rid the lot of any vehicles that should not be there. She said that she will ask the towing company to inspect the lot more closely on Sundays. Mr. Strip 1. Mentioned the bridge party on Friday, May 10, 1991. 2. Urged one and all to exercise their right to vote on Tuesday, May 7, 1991 (school bond issue). Mr. Amorose 1. Mentioned the letter from Del-Co Water Co., Inc. regarding their ability to provide service to a property at 8485 Sawmill Road. Mr. Hansley said that that single property cannot be served economically by any other entity. 2. Complimented the Parks and Recreation Division on the beautification project undertaken at S.R. 161/U.S. 33. 3. Mentioned, with gratitude, the positive letters being received by the City regarding positive reactions to efforts by City employees, mentioning specifically the positive nature of letters regarding inspectors. Noted the possible positive uses of the recently purchased 12 person passenger van by the City; to be used by Council, staff, as well as members of the various boards, commissions and committees. Mayor Rozanski 1. Reminded those present of the "Opening of the Northwest Passage" on Friday evening, May 10, 1991. Commented that Columbus will be officially opening the bridge at a later date, probably in two months or so when it is completely finished. 2. Announced that the Ohio Municipal League annual meeting will be held in Columbus in June and that Mr. Smith, Law Director, will be participating on a panel, discussing the role of legal counsel with other government agencies. Mrs. King moved to adjourn the meeting to Executive Session at 9:19 P.M. to discuss a personnel matter. Mr. Sutphen seconded the motion.
