'NiTPIUIA5, a "traffic code" i3 necessary to regulate the uee at vehicles '. in and upon tho streets, roadways, alleys and other public rights-of-~ay within the - Village of Dublin to protect the health and welfare of the citizens of said village) and, WY-PREAS, changea by the legislature of the State of Ohio have rendered cer- taj.n portions of previously enacted village ordinances invalid by reason of incon- sistency with said legislation) and, \~',}IEREAS, by virtue of tile fore:going and for the further reason of regulat- ing the flow of traffic upon the streets of the Village of Dublin an emergency exists 'within said Village, NO\~, THfF..Tij'()TIE, be it ordained b;}' the C01.U1cil of the Villa.ge of Dublin: Section 1. All ordinances previously enacted by the Village of Dublin inconsistent with sections 2 through 68 hereinafter Bet fo!~h are hereby repealed. Section 2. Definitions S5 used herein. (A) "Vehicle" means every device in" upon, or by which any person or property may be transported or drawn upon a hlghway, except devices moved by power collected from overhead electric t.rolley wires, or used exclusively upon stationary rails or tracks, and except devices other tharl bicycles moved by human power. ,.... (a) ''Motor vehicleu means every vehtcla propelled or drawn by power other than muscular power or power collected from overhead. electric trolley wires, except road rollers, traction engines, power shovels, power cranes and other equipment used in construction work and not designed for or elmployed in general highway transporta- tion, hole-digging machinery. farm machinery, threshing machinery, hay-baling maChinery, and agricultural tractors and machinery used jn the production of horticultural, ~ floricultural, agricultural, and vegetable products. j (C) t'tfotorcycle" means every motor venicle other than a tractor having a sadella for the use of the operator and designEld to travel on not more than three wheels in contact with the ground. (D) "FJnergency vshide" menns fire departmtmt, po1j.ce, and state highway patrol vehicles, vehicles of salvage corporat:l.oIUl organized under Bections l709.0l to 1709.07, i.nclusive, of the Revised Code of the State of Ohio, emerg(!>.ncy vehicles of municipal or county departments or public utility corporations when identified as such I as required by law, the director of highways, or local authorities, ambulances and motor vehicles when commandeered by a police officer or marshall, and ambulances and motor vehicles when used by volunteer firemen responding to emergency calls in the fire department service when identified as required by the director. (1) "School bus If means every motor vehicle ,,'hich is operated e:x,clusively for the transportation of sellool children to or from a school session, or to or from a. school function, and which is marked on both front and rear with the 'Words !'school busv in plain lettering not leas than six inches in height. (F) "Bicycle" ID(!anS a two-whllel vehicle propelled by hu.1'Zl8J1 power. having a ! tandem arrangement of wheels equipped with tires either of which 1s over twenty inches in diamoter. (0) UCo~~ercial tractorll means Gvery motor vehicle having motive power de- signed or used for drawing other vehicles and not ao constructed as to carTY any load thereon, or designed or used for drawing other vehicles while carr~~ a portion of such other vehicles, or .the load thereon, or both. (R) "Agricultural tractor" means every self-propelling vehicle designed or I ,. used for drawing other vehicles or wheeled machinery but having no provision for carry- 1..'1g loads in(;ependently of such other vehicles, and used principally for agricultural purposes. (I) "Trucktl means every motor vehicles, except trailers and ser:d-trailers, designed and used to carry property. (J) "Bus" means every motor vehicle designed for carrying :more than nine passengers and used for the transportation of persons, and every motor vehicle, automo- bile for hire, or funeral car, other than a tax'1cab, desicned and used for the trans- portation of persons for compensa.tion. -1- I . . . ~ - I (1\) "Trailer" m~ans every vehiol$ designed or used tor carrying persons or property wholly on it. own stru.etl1re and :for being dra1m by a !!Jotor vehicle, including any such vehicle when fomed by or operated as a combination of a "semitrailer" and s. ventole of the dolly type, such as that commonly known as a "trailer dolly.n (L) tlSernitrailerlt mtrans ev(~ry vehicle designed or used. for oarrying pOl'8ons or property with another and separate motor vehicle .0 that in operation a part of ita own weight or that of its load, or both, rests upon and is carried by another vehicle. ..--..... - (M) .Pole trailer" means every trailer or semitrailer attached to the towing vehicle by means of a rench, pole, or bT being boomed or otherwise secured to the tow- ing vehicle, and ordinarilY' used for transporting long or irregular shaped loads such as poles, pipell, or structural members capable generally, of sustaining themselves as beoms betweMl the supporting connections. (N) tlTixplos1.v8sl'1 lleans aI1T ohemiMl compound or meohanical mixture that is intended for the p~rpose of producing an explosion that contains any oxidi2ing and combustible units or other ingredients in such proportions, quantities, or packing that an ignition by tire, by friction, by coneu.lion, by percussion, or by a detonator of any part of the compo\lnd or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of produoing destructive effects on contiguous objects, or of destrny:l..ng life or limb. Manufactured articles shall not be held to be explosives ....hen the individual units contai.n explosives in such limited quantities, of such nature, or in suoh packinfh that it 111 impossible to procure a simultaneous or a. destrictive explosion of such units, to the injury of life, limb or property boY fire, by friction, by concussion, rq percussion, or by R detonator, 8uoh as fixed ammunition for small arms. rirearack'~s, or safety fuse matohes. (0) "Flamable liquid" means any liquid which has a flash point of seventy degrees Fahrenheit, or 108s, ao determined by a tagliabue or equivalent closed cap test device. (p) !tGross weight" moans the weight ot a vehicle plus the weight of any load thereon. (Q) "Person" means every natural person, firm, eo-partnership, association, or corporation. (R) :~Pedostrian" means any naturalpereon afoot. (5) "Driver or operator" m.eans every person who drives or is in actual physical ~~ntrol of a vehicle. (T) ~Police oftioern means every law enforoement ofticer author1~ed to direct or regulate traffiC, or to make arrests tor violations of traffic regulations. (tr) PBtreet or higlmay" !Ueans the entL..-e width between the bo:und.aq lines of every way open to the use of the public as a thoroughfare for purposes of vehicular -travel. (V) If Private road or driveway" means every yay or place in priv~lte ownership used for vehicular travel by the owner and those 11aving express or implied permission from the o~ner but not by other persons. (W) "Roadway. meAns that portion of a highway improved, designed, or ordinar- ily used tor vehicular travel, except the berm or should sr. If a highway includes two or more separate Madways the term ~roadway!ll means any such roadway separately but not all such roadways colleative~. (X) "-'Sidewalk" menas that portion of a atreet bet1reen the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for the use of pedestrians. (1) .tLaned highway" means a highway the roadway of which is divided into two or more clEarly marked lanes for vehicular traffic. (AA) "Intersection" Jn$ans the area embraced within the prolongation or the lateral boundary lines or two or more highways which join one another. - 2- - . . . . . . . (BB) "Crosswalk" meanst (1) That part of a roadwa.v at an interseotion included within t.he connections of the latGral lines of the eidewallts on opposite sides of the highwaT measu.rl'ld .from the curbs" or in the absence of ourbs trom the edge of the traversable roadway} (2) Any portion of a roadway at an intersection or elsewhere, ditttinctly indioated for pedestrian crossing by linea or other markings on the surfaoe. (CO) tlfJUSinoS6 district'" moans the territory fronting upon a street or high- way, including the street or highway, between successive intersections nthin the Village where fifty per cent or more of' th9 frontage between such successive inter- sections is occupied by buildings in use for business. (nD) UResidence dietrictK mesne the territory, not eomprioing a business district, fronting on a street or highway, including the street or hi~hway~ where, tor a di8tanoe of three hundred fP-Ot or more, the frontage is improved with residences or residenoes and buildings in use for business. (~~) "Traffic control devices" means all signs, signals, markings and devioes placed or erected by authority of the Village of Dublin, for t.he purpose of regulating, warning, or guiding traffic, including signa denoting names of streets and highways. (n) f#fraf'fio control signal" means any device, whether manually, electrically, or mechanically operated, bywhich traffic 15 alternately directod to stop, to proceed, to change dir~ction, or not to change direction. Sections 2 through 68, inclusive ot this Ordinance do not apply to persons, teams, motor Tehiales, and othor equipment while actually' engaged in work upon the Burface of a highway within an area designated by traffic control devices, but apply to such persona and vehicles when trav~ling to or from such work. It shall be prima facie lawful for the operator of a motor vehicle to opera:t.e the same at a. apeed not. exceeding the .following s (A) Twenty miles per hour when passing a school building or the groundS thereof during Bchool recess and ",hUe children are going to or leaving sohool during the opening or closing houre, and when appropriate signs giving notice of' the existence of the school are erected, (B) Twenty-five miles per hour within the business d1otriot of the Village of Dublin; (0) Thirty-five miles per. hour in residential arsa.o within the Village of Dublin. It shall 1;e prima facie unlawful for any person to exceed SDY of t.he speed limitations in any section of this ordinance. Section 19. Rules ~ov~rn1ng overtaking and Eas&lng of vehicles. The Council of the V1llage of Lu.blin may, upon applicat;ion in writing ?..nd for good cause shown, issue a special permit in writing authorizing the applicant to operate or m.ove a vehi.c.le or combination of vehicles of a 5i~Q or weight of venicle or load exceeding the mszimum specified in sections 5517.01 to 5577.09, inclusive, ot the RtlVised Code of the State of Ohio within the VillAge of n'lblin. Any- such pemU may be issued for a single or a round trip, or in special instance!!, for a certain period of tme. The application for any such permit shall be in such form I1S prescribed oy the Council ot the '111&g8 of Dublin.
