The regularly scheduled meeting of the Dublin city Council was called to order by Mayor Jan Rozanski at 7:30 p.m. on Monday, November 18, 1991 and the Pledge of Allegiance was recited by all in attendance. Members of Council present were: Mr. Amorose, Mr. Campbell, Mrs. King, Ms. Maurer, Mayor Rozanski and Mr. strip. Mr. sutphen was absent (excused). Mr. Hansley, City Manager, and Mr. also present. Smith, Law Director, were Mayor Rozanski acknowledged Anne Clarke as the newly appointed Clerk of Council who officially assumed the position today. Correspondence The Ohio Department of Liquor Control has sent notices to Council regarding two applications for permit: 1. Ohio Indoor Golf Club, Inc., 6255 Corporate Center Drive - D3 class application. 2. Max & Erma'S, 411 Metro Place North - D5 and D6 transfer application. Mrs. King requested clarification regarding location of the Ohio Indoor Golf Club and whether this was the property involved in the Asmo rezoning. Mayor Rozanski responded that this is in fact an adjacent property. Mr. Amorose asked if there are any residential areas which adjoin the property. Mayor Rozanski assured him that there are not; the adjoining lots are office developments. The Dublin Party Barn property lies to the west. Peter Lenz. 6674 willow Grove Lane, representing the community Service Committee of the Dublin AM Rotary approached Council regarding his organization's project, "Zero Deaths". Steve Gunder, 5413 Reserve Drive, from the same committee stated that the "Zero Deaths" project is a safety awareness campaign being undertaken by the Rotary in response to the increase of highway deaths in Franklin County during 1991. Dublin AM Rotary has approved sponsorship of this project and is asking the public to pledge that they will neither be a contributor to nor will they be a highway fatality during the year 1992. The Rotary would like to enlist area law enforcement agencies and corporations as sponsors, but needs more funding to support this expanded effort. The Rotary contacted the Ohio Highway Safety Department and was told that federal monies would be available for this program, but that the application for these funds must be submitted by a government agency. Jim Bever, 57 winter Avenue, Columbus, reiterated that he had contacted the Ohio Highway Safety Department and was made aware that federal monies may be available in April of 1992, and that applications for funding should be prepared at this time. He requested that the i Mayor and Council give the Rotary guidelines as to how they II should proceed. He added that the grant application is I. forthcoming and referred questions regarding the focus of the II program to Mr. Gunder. II 'I II Mr. Gunder again stated that this program consists of a personal pledge signed by an individual that they will not contribute to nor be a traffic fatality in 1992. Focus is greater awareness and promotion of safe driving habits, and thus a reduction in traffic deaths. Ms. Maurer asked if the program has been used elsewhere, what are the causes of increased traffic fatalities in Franklin County, and would this program have some kind of cause and effect relationship in reducing fatalities? Mr. Gunder stated that the Highway Safety Department is not aware of any similar type of program being used elsewhere in the state. He stated that they Highway Patrol cites 6 major causes of traffic fatalities, including lack of seat belts and drunk driving, but could not single out anyone cause as a factor in the increase of fatalities. Mr. Hansley suggested that the issue be referred to staff for investigation and preparation of a resolution for the next meeting. Mayor Rozanski suggested that the issue be instead referred to the Safety Committee of Council for further investigation and recommendation to Council. Mrs. King agreed that the Safety Committee would take a look at the program and make a recommendation. Mayor Rozanski directed any questions to be put into writing to the Safety Committee. Marsha Grigsby requested that she would like to be informed of any restrictions or limitations relating to accounting for this program in conjunction with obtaining federal funds. She will submit this request to the Safety Committee. Mayor Rozanski commended the Dublin AM Rotary members present for their efforts in this worthwhile community program. Mayor Rozanski read a proclamation recognizing "MADD's Project Red Ribbon Tie One On For Safety Campaign", November 6, 1991 through January 1, 1992, and presented the signed Proclamation to Chief Ron Ferrell of the Dublin Division of Police. Mr. Jack Chaisson of Whitecraigs Court brought to Council's attention that as of 9:35 a.m. today, the Delaware County Commissioners approved the redrawing of the boundary lines of Washington Township and that the former Concord Township area residents were now served by Washington Township Fire Department. On behalf of the former Concord Township residents who supported this effort, Mr. Chaisson thanked the Council for their hard work and support in seeing this through. Mr. Smi th stated that the Supreme Court of Ohio last week overruled Concord's request for rehearing on this issue, and the Delaware County prosecutor had at that time informed Mr. Smith Minutes of RECORD OF PROCEEDINGS Dublin City Council Meeting Meeting DAYTON I FGAL AI ANK co. Mr. strip added that this effort was undertaken by the citizens of both townships and spearheaded by Mr. Chaisson who attended countless meetings to see it through. He congratulated Mr. Chaisson on its successful resolution. Ordinance No. 79-91 - Ordinance Accepting the Lowest and Best Bid for single Axle Dump Trucks. Third Reading. Mayor Rozanski asked Mr. Amorose if the issues he had raised at the last Council meeting regarding this ordinance had been resolved. Mr. Amorose stated that the City Manager had responded satisfactorily to his concerns in a letter dated November 13, 1991. Mrs. King commented that in conversation with him last week, Congressman Hobson of Springfield had asked if Navistar bid on the trucks. Danny Johnson responded, with input from Mr. Hansley, that Navistar, under the name International Harvester, had bid on the trucks. .. Vote on the Ordinance: Mrs. King, yes; Mr. strip, Campbell, yes; Ms. Maurer, yes; Mayor Rozanski, Amorose, yes. yes; Mr. yes; Mr. Ordinance No. 81-91 - Ordinance to Approve Renaminq Alleys in the Historic District. Third Reading. Mayor Rozanski requested that Danny Johnson give Council information at this time regarding the signage changes being proposed in the historic districts along with the name changes. Danny Johnson stated that the signs would be black with white letters in order to match the lightposts in the historic district. This is a variance from the brown street signs throughout the rest of the city. Reflective paint would be used on the white lettering, but not on the black background. Mr. Hansley reminded Council that if they approve this ordinance, staff would request they make a parallel motion to approve the color change. Mayor Rozanski requested information on costs for the sign changes. Danny Johnson stated that the cost for black signs with white lettering is $85.15 each, and the brown signs with white lettering are $94.98 each. These costs do not include installation. The existing poles will be painted black. Discussion followed regarding regulations and standards for street signages throughout the city. Council members expressed their desire for consistency. Terry Foegler stated that the Engineering division has approved the color coating for the signs. Held ==~~_cc--==_~ I Page Four , 19_ historic district (for reasons of preservation) has different standards than the rest of the city. 8" Mrs. King stated that she shares Mr. Strip's concerns regarding consistency of standards imposed by the city, and further stated that it was at Mr. Johnson's request that Council adopt standards for street signage in order to facilitate repair and maintenance. She added that the Old Dublin residents requested this change, but expressed concern that precedent is not set for other such requests. Mr. Amorose asked Mr. Johnson about the perimeters of the area where signage would be changed - whether it would include all streets in historic Dublin or just High Street. Mrs. King asked for a definition of the exact boundaries to be affected by this legislation. Mr. Campbell requested the timeframe for implementation of other streets into the plan. Boundar ies of the histor ic district are: Indian Run stream to the north; the western edge of the cemetery to the west; the southern boundary is basically the Cosgray ditch and the southern portions of the cemetery; and the eastern portion is the Scioto River. It encompasses Franklin Street, S. High Street, Riverview Street, Short Street, all of the alleys, Bridge Street from the bridge to the edge of the cemetery, Darby Street and North Street. .. .~ 2. certain elements, such as the monuments, will be installed this year and, hopefully, others will follow next year. High Street has been designated as part of the first phase. Mayor Rozanski called for a vote on Ordinance 81-91 as proposed: Vote on the ordinance: Ms. Maurer, yes; Mr. Campbell, yes; Mr. Amorose, yes; Mrs. King, yes; Mayor Rozanski, yes; Mr. Strip, yes. Mr. Hansley added that staff was officially requesting that a variance be granted under this ordinance for the color of signage from brown to flat black with white lettering in Old Dublin. Danny Johnson confirmed that there are 28 signs affected. Mr. Strip motioned to adopt the recommendation of the waiver. Mrs. King seconded the motion. 1;,;- Discussion followed by Council and staff regarding readability of the new signs as proposed by Maintenance. Mr. Strip motioned to table the adoption of the recommendation of the waiver. Mr. Hansley stated that the name change of the streets will not take effect for thirty days and this should provide ample time to resolve this issue. .. Ordinance No. 84-91 - Ordinance to Authorize the City Manager to Enter Into a contract with the Franklin County Board of Health. Second Reading. In regard to Franklin County Board of Health, Mr. Amorose commented that he had been in touch with them regarding concerns about pollutants flowing into the creeks. They have satisfactorily responded to his concerns, checking the effluence from aerating systems, etc. that flow into the creeks. Mr. Hansley mentioned that there is an issue concerning grease trap regulation and that this contract may yet be modified to address the issue prior to the third reading. He will advise council of any changes in the contract. There will be a third reading of the Ordinance at the Council Meeting on Monday, December 2, 1991. Ordinance No. 85-91 - Ordinance to Accept Annexation of 1.162+/- Acres in washington Township. Second Reading. ... There were no questions or comments. .., There will be a third reading of the Ordinance at the Council Meeting on Monday, December 2, 1991. Ordinance No. 80-91 - Ordinance to Authorize the City Manager to Enter into a Contract for Sewer and Water Reimbursement. First reading. Mr. Amorose introduced the Ordinance. Terry Foegler reminded Council that there is a pending agreement in conjunction with this contract addressing reimbursement for off-site utility extensions. The attorneys are working on this agreement, and this agreement will be provided to Council prior to the second reading of the ordinance. i There will be a second reading of the Ordinance at the Council I Meeting on Monday, December 2, 1991. I I II II Resolution No. 17-91 - Resolution to Set Forth a statement of Services to be Provided to the Area in a Proposed Annexation of 139.183 Acres from washington Township. First reading. Mr. Amorose introduced the Resolution. .. Mr. Hansley stated that the owner of this property in Washington Township had petitioned the City of Dublin, per statute, for annexation. The statement of services is a standard requirement I for a proposed annexation. I Mrs. King reported that there has been a misunderstanding by the public regarding the recent Columbus Dispatch article concerning the status of a "handshake agreement" between Dublin and Columbus over annexation in this area. As reported in the article, a letter sent by Ray Lorello of the city of Columbus to Tim Hansley expressed concern that previous discussions between Minutes of RECORD OF PROCEEDINGS Dublin City Council Meeting Meeting DAYTON I FGAL BLANK co. FORM NO. 10148 Held November 18, 1991 19 Page six .. Dublin and Columbus had resulted in a commitment not to annex in this area. Mrs. King pointed out that the City of Columbus had chosen not to honor the "handshake agreement" reached between city staffs, and therefore no such agreement would present an obstacle to annexation in this instance. Mr. Hansley expanded on this issue, saying: 1. What the City of Dublin and the City of Columbus agreed to do "staff-to-staff" was not a binding agreement on the Council. 2. What was agreed to was that neither Columbus nor Dublin would encourage or initiate requests for annexations in these areas. The annexation in question was freely initiated by the owner of the property, and Dublin certainly did not encourage them; in fact, Dublin told the property owner that Columbus would probably oppose the annexation in a public hearing. 3. The motivation for this annexation is property value enhancement for resale of the property. This is a charitable group trying to maximize their profit in a resale, and the school district factor is very important to prospective buyers. - In response to a question from Mr. Campbell, Mr. Hansley stated that this annexation would not block Columbus to the west - there are still five or six properties in the unincorporated portion of Washington Township between Dublin and Hilliard. There will be a second reading of the Resolution at the Council Meeting on Monday, December 2, 1991. other Records commission Appointment Mr. Hansley stated that there is an opening for a citizen appointment to this Board. The Records Commission works with staff to determine which records can legally be destroyed and/or transferred to the control of the Historical Preservation Society of the State of Ohio. This is an important post, since the City has never gone through this process before. There are two applications for this vacancy, and staff recommends that Council proceed as they wish to choose a candidate. Mr. Amorose motioned that Jean A. Walker be appointed to this position. He stated that she has recently retired as Branch Manager of the Dublin Branch of the Columbus Metropolitan Library and is a long-time resident of the area. Mrs. King seconded the motion. .. Ms. Maurer stated that she believes Ms. Walker is uniquely qualified for such a position with her background in library work and experience with records retention in that capacity. """--- .. , i II Iii Mayor Rozanski requested that the Clerk notify Ms. Walker of her I appointment, and that Mr. Stoycheff be sent a letter thanking I him for his application and encouraging him to apply for other [I boards or commissions. i I I I , I II II II II !I I' ,[ I, I I I I I Page Seven council committee Reports Mr. Campbell stated that the Land Use and Planning Committee may need to meet in the next few weeks as staff is in the process of working up southwest area plans. He and Ms. Maurer will set a date for this meeting. Mrs. King stated that the Public Safety Committee had requested a meeting of the entire Council on Monday, December 9 for further discussion on the fire issue. She would like to request that this meeting be postponed until after a discussion with the trustees. She and Mr. Strip will choose a date to address the Muirfield Boulevard safety issues raised by residents near Scottish Corners School and this will be published. Mrs. King reported that Karen Schwab, Chairperson of the Solid Waste Advisory Commi ttee, may have a presentation for Council on Monday, December 2. Dana McDaniel will check with the Committee in this regard. , , I I II I' Mr. Hansley commented that he had received a draft report of the Goal setting Committee from Mr. Lorz and would have a special mailing sent to Council members shortly. Mr. Strip requested that the media notify the public that bed tax applications should be sent to Council as soon as possible. These applications are reviewed after the first of the year, and the forms are available from the Finance Division. Ms. Maurer stated that budget meetings should be set up at this time. Mr. Hansley commented that he envisions these as informal meetings held in Council chambers to include department/division heads. This is merely a suggestion for format - he is looking for Council's input for modifications or adjustments to the proposed budget. Discussion was held regarding statutory guidelines for adoption of the budget and the option for temporary budget. Various dates were discussed, and Ms. Maurer suggested that three meetings be scheduled for the budget. Council members will let the Clerk know on which nights they would be available. Mayor Rozanski stated that applications for Boards and Commissions should be submitted to Council before the end of November. Ms. Maurer suggested that Council schedule discussion soon on the structure of next year's Council Committees and include Mr. Kranstuber in those discussions. Comments from Staff Mr. Foegler 1. Page Eight information to Council in regard to traffic analysis relating to Muirfield Boulevard opening - and in particular how this information would relate to signalization and traffic safety movements. Staff will be available to present this information at that time. Distributed to Council a letter from MORPC indicating that there appears to be an amendment in state policy which could affect funding for the state Route 161 widening project, possibly resulting in 100% federal funding instead of 75%-25% federal/local match. This could be a significant costs savings measure for the C.I.P. He will keep Council informed as more information becomes available. In response to a question from Mayor Rozanski regarding status of the widening project, Mr. Foegler indicated that requests for proposals for design contract were all submi tted and staff will be interviewing professional design firms this week to initiate the actual design. He stated that Council has the option of waiting to move ahead with the project pending a decision from the state on possible 100% funding or moving ahead with the project as previously proposed at the 75/25 percent federal/local match. Mr. Foegler recommended proceeding with design at this time. He emphasized that all design will be done in accordance with OOOT standards and that this is an important criteria for selection of a design firm. He stated that 161, Bridge & High, Franklin to Dale will probably require some redesign if it is made part of a larger project. This project was a "fast track, quick fix project" and factors such as buried tanks and impacts on adjacent properties will increase the costs of the project. Council needs to determine if the City is willing to spend $750,000 of local monies to get that in service 1 or 2 years earlier rather than waiting to get the 75% federal money. Mrs. King commented that the decision-making process would require input on the shifting of traffic patterns since the opening of Muirfield Boulevard. Mr. Foegler responded that staff is prepared to make a presentation to the Safety Committee on changes in traffic counts since the opening of Muirfield. Mr. Foegler again emphasized that the timeframe would be the determining factor in the decision to choose the option of local funding versus federal funding for this project. Mr. Campbell requested clarification of the type of commi tment we could obtain from the state for proj ect funding. Mr. Foegler responded that we are assured of 75% funding, and he is 90% sure that we could obtain 100% Mr. Campbell'S concerns are the effect this freeing of funds would have on the viability of other projects, such as the Community Center. Mr. Foegler also commented that certain of Dublin's requirements for the project would possibly not be eligible for the federal program, e.g., medians or underground utilities. FORM NO. 10148 Held November 18, 1991 19 Page Nine Janet Jordan Ms. Jordan reported that they are recycling wood chips for City mulching, and that the appearance would differ. Council members were supportive of this cost-saving approach. Peter Lenz Mr. Lenz reported that all indications point to a resurgence in building in Dublin. Factors in the increased building permit activity are the low cost of money and the desirability of the Dublin area, according to local developers. council Roundtable Discussion Mr. Campbell 1. Mr. Campbell extended a welcome to new Council Member Chuck Kranstuber. 2. He requested that a proclamation be prepared for the Dublin High School Championship Football team and for cross- country State Champion J.J. White. 3. Expressed thanks on behalf of the residents of the Concord Township portion of Muirfield Village to all who were involved in the successful effort to change the boundary of Washington Township, enabling the Washington Township Fire Department to now provide coverage for the residents. A special thanks to Jack Chaisson and his committee for their efforts; thanks also to the City Attorney and City staff; the Washington Township trustees and their attorney; and the Washington Township Fire Department who supported our efforts. Mr. Amorose 1. Has observed a huge tent at the corner of Riverside Drive and 161 and expressed concern about permits issued for such a structure in the Corridor Development District. Mr. Hansley believes this is probably a seasonal sales tent for Christmas trees and as such is permitted under City ordinances. Chief Bostic acknowledged that the Washington Township Fire Department had issued a tent permit for this seasonal sales site. Mr. Hansley will check and advise regarding this. 2. The site of the proposed retirement home on the east side of Martin Road is still very unsightly, with houses on blocks and unsafe conditions. Mr. Foegler responded that city staff has been investigating and monitoring this problem. FORM NO. 10148 Held November 18, 1991 19_ .,' Page Ten the Franklin County Board of Health and the owners' attorneys on this problem and that some delinquent tax issues have to be resolved before any substantial progress can be made on site clean-up. 3. Regarding the use of credit cards for payment of Mayor's Court fees, Mr. Amorose asked if there is a policy regarding payment of fines, etc. Mr. Smith responded that the Court has total discretion regarding the payment of fines. Non-payment of fines results in a warrant for the person's arrest and more paperwork for the Clerk of Courts. The option of payment by MasterCard or VISA would possibly help avoid non-payment of fines. Ms. Maurer expressed concern that not everyone can obtain credit, and this could be considered discriminatory. Mayor Rozanski stated that this would simply be another option for payment. Ms. Maurer .. 2. 1. There is a City property at 27-29 S. High Street where the lease has expired which could possibly accommodate City offices. Mr. Hansley responded that the primary purpose of leasing out this space was to increase foot traffic to Old Dublin area merchants. This space would be suitable for civic groups as well. He will take these suggestions into consideration. Council has previously had a goal of joint meetings with other government entities as well as municipalities. This would be a good time to set up a scheduled event for next year. Also proposed was a recognition dinner for members of boards and commissions, as the last one was held in 1986. Encouraged Council to look at structure and membership of various council committees. Would like to see Chuck Kranstuber sit in on these meetings for transition purposes. Mr. Strip Conveyed wishes for a Happy Thanksgiving to everyone and requested they reflect on the true purpose of the holiday. Mayor Rozanski Requested that all candidates make an effort to ensure that all campaign signage is removed from around the city. Also mentioned that banners over State Route 161 be removed in a more timely manner. Mr. Johnson responded that removal of these banners requires shutting down the road, and the best time to do so is Sunday morning. He assured Council that efforts would be made in the future to remove banners at the first opportunity following an event. Mr. Hansley stated that campaign signs are not illegal until 30 days following the election, so there can be no citations issued prior to that time. INF'" ,'" ..
