A RESOLUTION WAIVING COMPETITIVE BIDDING
REQUIREMENTS, PURSUANT TO SECTION 8.04
(`CONTRACTING PROCEDURES'), PARAGRAPH (C)
( "WAIVER OF COMPETITIVE BIDDING ") FOR THE
EMERALD FIELDS BALL FIELD LIGHTING
PROJECT BASED ON THE PRODUCT BEING
AVAILABLE FROM A SINGLE SOURCE AND
AWARDING A CONTRACT TO MUSCO LIGHTING
WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes City Council,
by a vote of no less than five (5) members, to waive competitive bidding requirements
if Council determines that an item is available and can be acquired only from a single
source or when it is in the best interest of the City to do so; and
WHEREAS, during an earlier phase of Emerald Fields, infrastructure was installed for
the three ball fields in the southern end of the park, including the proprietary concrete
columns used for mounting the light poles manufactured by Musco Lighting; and
WHEREAS, all of the City's ball fields have Musco Lighting and they provide a
superior product in terms of light quality, energy efficiency and control of light
trespass; and
WHEREAS, Council has determined that it is in the best interest of the City to waive
competitive bidding for the project to provide lighting of the three Emerald Fields ball
fields; and
WHEREAS, Council has determined that the quote submitted by Musco Lighting in
the amount of approximately $105,000 is fair and appropriate.
NOW, THER�RE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, of the elected members concurring:
Section 1. That competitive bidding requirements are hereby waived for the
procurement of materials for the Emerald Fields ball fields lighting project.
Section 2 . That the City Manager is hereby authorized to enter into an agreement with
Musco Lighting for purchase of lighting fixtures in the amount of approximately
$105,000.00.
Section 3. That this Resolution shall take effect and be in force on the earliest date
permitted by law.

Re: Resolution 05 -10, Emerald Fields Ball Field Lighting -Waiver of Competitive Bidding
Background
In an earlier phase of Emerald Fields, infrastructure was placed for the lighting of the three ball
fields in the southern end of the park. This infrastructure included the proprietary concrete columns
used for mounting the light poles manufactured by Musco Lighting. The reason for placing the
infrastructure at that time was to avoid the trenching and site disturbance that would have been
required in the future to fit the fields with the lighting components. The fields were not lit at the
time because the budget did not allow for it.
All of the City's lit ball fields have Musco Lighting fixtures. Musco provides a superior product in
terms of light quality, energy efficiency and control of light trespass.
The cost of the Musco components to complete the lighting of the three Emerald Fields ball fields is
approximately $105,000. In addition, the labor costs to install the lighting are approximately
$50,000. The budget for the current phase of construction for Emerald Fields provides for this
lighting.
Recommendation
Given the proprietary nature of the components equating to a single source provider, staff
recommends approval of Resolution 05 -10, waiving the competitive bidding requirements per
Section 8.04 (c) of the Revised Charter. Staff believes the price submitted by Musco Lighting is
fair and appropriate, based upon a comparison of unit costs supplied by contractors of previous
competitively bid City projects, in which Musco Lighting was included.
Staff plans to request proposals for the installation of the lights from qualified firms.
