Form No. 30045 Resolution No. 57-09 Pas.cecl ~D AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR RESURFACING U.S. 33 AND S.R. 257 ODOT PID NUMBER 25808 WHEREAS, the Ohio Department of Transportation (ODOT) has identified the need to perform pavement resurfacing on U.S. 33 and S.R. 257; and WHEREAS, this project proposes to plane and resurface pavement with asphalt concrete and replace loop detectors and pavement markings; and WHEREAS, this is an ODOT District Six Urban Paving Project; and WHEREAS, the overall project limits extend on U.S. 33 from the Columbus/Dublin Corp. (0.06 miles south of Martin Road) to the S.R. 257/S.R. 161 intersection, continuing on S.R. 257 from the S.R. 257/S.R. 161 intersection to the pavement break just south of the S.R. 750/Glick Road intersection; and WHEREAS, the City of Dublin (Dublin) hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the Ohio Department of Transportation for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director; and WHEREAS, prior to the construction commencement date of the above-referenced project, Dublin shall install and/or repair all curb ramps which are necessary to ensure compliance with the Americans with Disabilities Act and Dublin agrees to assume and bear one hundred percent (100%) of the cost of such installation and/or repair of curb ramps; and WHEREAS, for the portion of the project which is within Dublin, Dublin will assume and bear one hundred percent (100%) of the cost of construction less the amount of Federal and State funds set aside by the Director of Transportation and the Federal Highway Administration. Dublin will assume and bear one hundred percent (100%) of the cost of curbs, gutters, utility relocations, partial and full-depth pavement repairs and other non-surface related items. Dublin agrees to assume and bear one hundred percent (100%) of the total cost of those features requested by Dublin, which are not necessary for the improvement as determined by the State and Federal Highway Administration; and WHEREAS, Dublin agrees that all right-of--way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. Dublin also understands that right-of--way costs include eligible utility costs; and WHEREAS, Dublin agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual; and WHEREAS, upon completion of the project, and unless otherwise agreed, Dublin shall: (1) provide adequate maintenance for the project in accordance with all applicable state and federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) provide ample financial resources, as necessary, for the maintenance of the project; (3) maintain the right-of--way keeping it free of obstructions; and (4) hold said right-of--way inviolate for public highway purposes. Being in the public interest, the City of Dublin gives consent to the Director of Transportation to complete the above-described work. Section 2. The City Manager be, and hereby is, authorized to enter into an agreement with ODOT for the purpose of pavement repair on U.S. 33 and S.R. 257. Section 3. This Resolution shall be in full force and effect on the earliest date permitted by law. Hammersmith, P.E., Director of Engineering/City Engineer Re: Resolution 57-09 - ODOT Agreement for Resurfacing U.S. 33 and S.R. 257 Summary The Ohio Department of Transportation (ODOT) has identified the need for and has requested cooperation from the City of Dublin (Dublin) for the resurfacing of U.S. 33 and S.R. 257. Project limits include: 1. U.S. 33 from 0.06 miles south of Martin Road to the S.R.-257/S.R.-161 intersection (Dublin pays 20%). 2. From the S.R. 257/S.R. 161 intersection to the Delaware County Line (Dublin pays 20%). From the Franklin County line to just south of S.R. 750/Glick Road intersection (ODOT pays 100%). The ODOT Urban Paving Policy requires the local municipality to contribute 20% of the total cost of the surface treatment. Additionally, the local municipality is required to contribute 100% of the cost of non-surface related items such as curbs, gutters, utility relocation expenses, and partial and full-depth pavement repairs. Based upon initial cost estimates, the preliminary projection for Dublin's contribution for this project is estimated to be $183,000. This does not include any 100% Dublin responsibility items such as pavement repair. Note this is a preliminary figure and will change. Once final plans are developed and quantity splits are determined, Dublin will be invoiced for its share of the project costs approximately six weeks before the project's scheduled bid award. The current schedule is for bid opening in June 2010 with Dublin's share due to ODOT in May 2010. The entire cost of the project is estimated at $1,500,000. Recommendation Staff recommends approval of Resolution 57-09 authorizing the City Manager to enter into an agreement with ODOT for pavement resurfacing of U.S. 33 and S.R. 257. Moore Legislation File* Project File' PRELIMINARY LEGISLATION Ordinance Number Rev. 6/26/00 PID Number 25808 FRA-33/257-3.92/0.00 The following is an Ordinance enacted by the City of Dublin, Franklin County, Ohio, hereinafter referred to as the Local Public Agency (LPA), in the matter of the stated described project. SECTION I -Project Description WHEREAS, the STATE has identified the need for the described project: This project proposes to plane and resurface pavement with asphalt concrete and replace loop detectors and pavement markings. This project is an ODOT District Six Urban Paving Project. Overall project limits extend on FRA-33 from the Columbus/Dublin Corp (0.06 miles south of Martin Road) to the SR-257/SR-161 intersection. Continuing on north on SR-257 from the SR- 257/161 intersection to the pavement break just south of the SR-750/Glick Road intersection. NOW THEREFORE, be it ordained by the City of Dublin, Ohio. SECTION II -Consent Statement Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project.
